    – be already [révolus] 50 years of age on the day of their designation or of their election;
    – enjoy a professional experience of at least twenty (20) years in law [droit] and have followed a training in constitutional right;
    – enjoy their civic and political rights and have not been made the object of any conviction to a penalty involving deprivation of liberty;
    – not adhere to a political party.
    As soon as they are elected or designated, the members of the Constitutional Court cease any other mandate, function, responsibility, mission, as well as all other liberal activities or professions.

    The Constitutional Court may be referred to [the matter] of the constitutionality of the treaties before their ratification, and of the laws before their promulgation.
    The Constitutional Court may be referred to [the matter] of the constitutionality of the regulations within a time period of one month, counting from the date of their publication.
    The Constitutional Court decides equally by decision on the conventionality of the laws and of the regulations within the conditions established respectively in paragraphs 2 and 3 above.
    The Constitutional Court is obligatorily referred to [the matter] of the conformity of the organic laws with the Constitution by the President of the Republic after their adoption by the Parliament. It decides by a decision on the whole of the text.
    The Constitutional Court equally decides in the same forms provided for in the previous paragraph of the conformity of the internal regulations of each of the two chambers of the Parliament.

    When a provision of an ordinance or of a regulation is judged unconstitutional, this loses all effect, counting from the day of the decision of the Court.
    When the Constitutional Court judges that a legislative or regulatory provision is unconstitutional on the basis of Article 195 above, it loses all effect, counting from the day established by the decision of the Court.
    The decisions of the Constitutional Court are definitive. They impose themselves on the whole of the public powers and on the administrative and jurisdictional authorities.

    إذا قررت المحكمة الدستورية عدم دستوريّة معاهدة أو اتّفاق أو اتّفاقيّة، فلا يتمّ التّصديق عليها.
    إذا قررت المحكمة الدستورية عدم دستورية قانون، لا يتم إصداره.
    إذا قررت المحكمة الدستورية عدم دستورية أمر أو تنظيم، فإن هذا النص يفقد أثره، ابتداء من يوم صدور قرار المحكمة الدستورية.
    إذا قررت المحكمة الدستورية أنّ نصّا تشريعيّا أو تنظيميّا غير دستوريّ على أساس المادة 195 أعلاه، يفقد أثره ابتداء من اليوم الذي يحدّده قرار المحكمة الدستورية.
    تكون قرارات المحكمة الدستورية نهائية وملزمة لجميع السلطات العمومية والسلطات الإدارية والقضائية.

    Lorsque la Cour constitutionnelle juge qu’un traité, accord ou convention est inconstitutionnel, sa ratification ne peut avoir lieu.
    Lorsque la Cour constitutionnelle juge qu’une loi est inconstitutionnelle, celle-ci ne peut être promulguée.
    Lorsqu’une disposition d’une ordonnance ou d’un règlement est jugée inconstitutionnelle, celle-ci perd tout effet, à compter du jour de la décision de la Cour.
    Lorsque la Cour constitutionnelle juge qu’une disposition législative ou réglementaire est inconstitutionnelle sur le fondement de l’article 195 ci-dessus, celle-ci perd tout effet, à compter du jour fixé par la décision de la Cour.
    Les décisions de la Cour constitutionnelle sont définitives. Elles s’imposent à l’ensemble des pouvoirs publics et aux autorités administratives et juridictionnelles.
