The freedom to constitute political parties, trade unions [syndicats] and associations is guaranteed.
The political parties, the trade unions and the associations commit in their statutes and their activities to respect the provisions of the Constitution and of the law, as well as the financial transparency and the rejection of violence. (Art. 40) - Arabic
حرّية تكوين الأحزاب والنّقابات والجمعيّات مضمونة.
تلتزم الأحزاب والنّقابات والجمعيّات في أنظمتها الأساسيّة وفي أنشطتها بأحكام الدّستور والقانون وبالشّفافيّة الماليّة ونبذ العنف. (الفصل 40) - French
La liberté de constituer des partis politiques, des syndicats et des associations est garantie.
Les partis politiques, les syndicats et les associations s’engagent dans leurs statuts et leurs activités à respecter les dispositions de la Constitution et de la loi, ainsi que la transparence financière et le rejet de la violence. (Art. 40)
Political Parties
- EnglishThe political Parties and groups concur in the exercise of suffrage, as well as in the civic and political instruction [formation] of the people. They form and exercise their activities freely in accordance with the law.
They must respect the national unity, sovereignty and the inviolability [intangibilité] of the frontiers, such as they are internationally recognized, as well as the principles of democracy.
The constitution of insular political parties, regional or local or having a paramilitary character or [having] recourse to subversive methods, is prohibited.
The law determines the juridical status of the political parties and regulates the benefits that may be grated to them by the State. (Art. 35) - Arabicتوافق الأحزاب والمجموعات السياسية على ممارسة الاقتراع، إلى جانب التوجيه المدني والسياسي للشعب. تشكل وتمارس أنشطتها بحرية وفقاً للقانون.
ويترتب عليها احترام الوحدة الوطنية وسيادة وحرمة الحدود كما هو معترف بها دولياً، إلى جانب مبادئ الديمقراطية. يحظر إنشاء أحزاب سياسية جزيرية إقليمية أو محلية أو ذات طابع شبه عسكري أو تلجأ إلى أساليب هدامة.
يحدد القانون المركز القانوني للأحزاب السياسية وينظم المزايا الممنوحة لها من الدولة. (المادة 35) - FrenchLes Partis et groupements politiques concourent à l’expression du suffrage, ainsi qu’à la formation civique et politique du peuple. Ils se forment et exercent librement leurs activités conformément à la loi.
Ils doivent respecter l’unité nationale, la souveraineté et l’intangibilité des frontières, telles qu’internationalement reconnues, ainsi que les principes de la démocratie.
Est interdite la constitution de partis politiques insulaires, régionaux ou locaux ou ayant un caractère paramilitaire ou recourant à des moyens subversifs.
La loi détermine le statut juridique des partis politiques et réglemente les avantages qui peuvent leur être accordés par l'État. (Art. 35)

- EnglishAll citizens shall have the right to form political parties by notification as regulated by Law. No political activity may be practiced and no political parties may be formed on the basis of religion or discrimination based on sex, or origin, or on sectarian basis or geographic location. No activity that is hostile to democratic principles, secretive, or of military or quasi-military nature may be practiced.
Political parties may not be dissolved except by virtue of a court judgment. (Art. 74) - Arabicللمواطنين حقّ تكوين الأحزاب السّياسية، بإخطار ينظّمه القانون. ولا يجوز مباشرة أى نشاط سياسى، أو قيام أحزاب سياسية على أساس دينى، أو بناء على التّفرقة بسبب الجنس أو الأصل أو على أساس طائفى أو جغرافى، أو ممارسة نشاط معاد لمبادئ الدّيمقراطية، أو سرّى، أو ذى طابع عسكرى أو شبه عسكرى.
ولا يجوز حل الأحزاب إلا بحكم قضائى. (المادّة 74)

- EnglishThe State shall guarantee the freedom of forming political parties, societies and other civil society organisations, and a law shall be promulgated to regulate same. The establishment of clandestine or armed groups, or groups in violation of public order or of public morals and others which may be detrimental to the State or the unity of national territory shall be prohibited. (Art. 15)
- Arabicتكفل الدّولة حُرّية تكوين الأحزاب السياسية والجمعيات وسائر مُنظمات المُجتمع المدني، ويصدر قانون بتنظيمها، ولا يجوز إنشاء جمعيات سرية أو مسلحة أو مُخالفة للنظام العام أو الآداب العامة، وغيرها مما يضر بالدولة ووحدة التراب الوطني. (المادة 15)

- English1. The political system of the state shall be based on the principle of political pluralism, and exercising power democratically through the ballot box;
2. Licensed political parties and constituencies shall contribute to the national political life, and shall respect the principles of national sovereignty and democracy;
3. The law shall regulate the provisions and procedures related to the formation of political parties;
4. Carrying out any political activity or forming any political parties or groupings on the basis of religious, sectarian, tribal, regional, class-based, professional, or on discrimination based on gender, origin, race or color may not be undertaken;
5. Public office or public money may not be exploited for a political, electoral or party interest. (Art. 8) - Arabic1. يقوم النظام السياسي للدّولة على مبدأ التعددية السياسية، وتتم ممارسة السلطة ديمقراطياً عبر الاقتراع.
2. تسهم الأحزاب السياسية المرخصة والتجمعات الانتخابية في الحياة السياسية الوطنية، وعليها احترام مبادئ السيادة الوطنية والديمقراطية.
3. ينظم القانون الأحكام والإجراءات الخاصة بتكوين الأحزاب السياسية.
4. لا يجوز مباشرة أي نشاط سياسي أو قيام أحزاب أو تجمعات سياسية على أساس ديني أو طائفي أو قبلي أو مناطقي أو فئوي أو مهني، أو بناءً على التفرقة بسبب الجنس أو الأصل أو العرق أو اللون.
5. لا يجوز تسخير الوظيفة العامّة أو المال العام لمصلحة سياسية أو حزبية أو انتخابية. (المادّة 8)
