- EnglishThe Constitutional Council sees to respect for the constitutional principles. It controls the constitutionality of the laws.
It guarantees the fundamental rights of the human person and the public freedoms.
It is the regulatory organ of the functioning of the institutions and of the activity of the public powers. (Art. 75) - Arabicيحرص المجلس الدستوري على احترام المبادئ الدستورية.
يراقب دستورية القوانين، ويضمن حقوق الإنسان الأساسية والحريات العامة،

- EnglishThe organic laws, before their promulgation and the regulations of the National Assembly before their implementation [mise en application], must be submitted to the Constitutional Council which decides concerning their conformity with the Constitution.
To the same ends, the laws can be referred [déférées] to the Constitutional Council, before their promulgation, by the President of the Republic, the President of the National Assembly, or by one-third (1/3) of the Deputies composing the National Assembly.

The Constitutional Council is competent to take cognizance of a pleadings [exception] of unconstitutionality raised in the course of a process, when it is asserted [soulevée] by one of the parties that the law on which the issue at litigation depends, infringes the rights and freedoms guaranteed by the Constitution. (المادّة 86) - FrenchLes lois organiques, avant leur promulgation et les règlements de l’Assemblée Nationale avant leur mise en application, doivent être soumis au Conseil Constitutionnel qui se prononce sur leur conformité à la Constitution.
Aux mêmes fins, les lois peuvent être déférées au Conseil Constitutionnel, avant leur promulgation, par le Président de la République, le Président de l'Assemblée Nationale, ou par le tiers des députés composant l'Assemblée Nationale.

The Constitutional Court is referred [to a matter] by the President of the Republic, the President of the Council of the Nation, the President of the National People's Assembly or by the Prime Minister or the Head of the Government, according to the case.
It may equally be referred [to a matter] by forty (40) Deputies or twenty-five (25) members of the Council of the Nation.
The exercise of the referral enunciated in the two preceding paragraphs does not extend to the referral [to a matter] in a pleading [exception] of unconstitutionality enunciated in Article 195 below. (Art. 193) - Arabic
تخطر المحكمة الدستورية من رئيس الجمهورية أو رئيس مجلس األمة أو رئيس المجلس الشعبي الوطني أو من الوزير األول أو رئيس الحكومة، حسب الحالة.
يمكن إخطارها كذلك من أربعين (40) نائبا أو خمسة وعشرين (25) عضوا في مجلس األمة.
ال تمتد ممارسة اإلخطار المبين في الفقرتين األولى والثانية إلى اإلخطار بالدفع بعدم الدستورية المبّين في المادة 195 أدناه. (المــادة 193) - French
La Cour constitutionnelle est saisie par le Président de la République, le Président du Conseil de la Nation, le Président de l’Assemblée Populaire Nationale ou par le Premier ministre ou le Chef du Gouvernement, selon le cas.
Elle peut être également saisie par quarante (40) députés ou vingt-cinq (25) membres du Conseil de la Nation.
L’exercice de la saisine énoncée aux deux alinéas précédents ne s’étend pas à la saisine en exception d’inconstitutionnalité énoncée à l’article 195 ci-dessous. (Art. 193)

(a) The Constitutional Court, if the challenge is directed at any infringement of the constitutional order or constitutional freedoms, protections or rights.

- EnglishThe Supreme Constitutional Court shall be solely competent to decide on the constitutionality of laws and regulations, to interpret legislative provisions, and to adjudicate on disputes pertaining to the affairs of its members, on jurisdictional disputes between judicial bodies and entities that have judicial jurisdiction, on disputes pertaining to the implementation of two final contradictory judgments, one of which is rendered by a judicial body or an authority with judicial jurisdiction and the other is rendered by another, and on disputes pertaining to the execution of its judgments and decisions.
The law shall determine the Court’s other competences and regulate the procedures that are to be followed before the Court. (Art. 192) - Arabicتتولى المحكمة الدّستورية العليا دون غيرها الرّقابة القضائيّة على دستوريّة القوانين، واللّوائح، وتفسير النّصوص التّشريعية، والفصل فى المنازعات المتعلّقة بشؤون أعضائها، وفى تنازع الاختصاص بين جهات القضاء والهيئات ذات الاختصاص القضائى، والفصل فى النزاع الذي يقوم بشأن تنفيذ حكمين نهائيين متناقضين صادر أحدهما من أى جهة من جهات القضاء، أو هيئة ذات اختصاص قضائيّ، والآخر من جهة أخرى ، والمنازعات المتعلّقة بتنفيذ أحكامها، والقرارات الصّادرة منها.
يضبط القانون الاختصاصات الأخرى للمحكمة، وينظّم الإجراءات التى تتّبع أمامها. (المادّة 192)

The Constitutional Court may be referred to [the matter] of the disputes which may arise between the constitutional powers, by the instances enumerated in Article 193 below.
These instances may equally refer to the Constitutional Court to [a matter] with a view to the interpretation of one or more constitutional provisions. The Constitutional Court gives, in this regard, an opinion. (Art. 192) - Arabic

La Cour constitutionnelle peut être saisie, par les instances énumérées à l’article 193 ci-dessous, des différends qui peuvent surgir entre les pouvoirs constitutionnels.

تختص المحكمة الدستورية بالنظر في كل دفع متعلق بعدم دستورية قانون، أثير أثناء النظر في قضية، وذلك إذا دفع أحد الأطراف بأن القانون، الذي سيطبق في النزاع، يمس بالحقوق وبالحريات التي يضمنها الدستور.
يحدد قانون تنظيمي شروط وإجراءات تطبيق هذا الفصل. (الفصل 133)

- EnglishThe provisions of law which concern the fundamental rights recognized to any person by the Constitution may be submitted to the Constitutional Council by way of pleadings if it involves an instance in course before a jurisdiction.
The pleadings of unconstitutionality may be raised by any plaintiff before any jurisdiction.
… (Art. 80) - Arabicيجوز تقديم أحكام القوانين المتعلقة بالحقوق الأساسية التي يعترف بها الدستور لأي شخص عبر تقديم مذكرة إذا كانت تتعلق بقضية ماثلة أمام سلطة قضائية.
ويجوز أن يقدم أي مدع دفوع بعدم الدستورية أمام أي سلطة قضائية.
