Sexual and Reproductive Rights
- English1 Human beings shall be protected against the misuse of reproductive medicine and gene technology.
2 The Confederation shall legislate on the use of human reproductive and genetic material. In doing so, it shall ensure the protection of human dignity, privacy and the family and shall adhere in particular to the following principles:
a. All forms of cloning and interference with the genetic material of human reproductive cells and embryos are unlawful.
b. Non-human reproductive and genetic material may neither be introduced into nor combined with human reproductive material.
c. The procedures for medically-assisted reproduction may be used only if infertility or the risk of transmitting a serious illness cannot otherwise be overcome, but not in order to conceive a child with specific characteristics or to further research; the fertilisation of human egg cells outside a woman’s body is permitted only under the conditions laid down by the law; no more human egg cells may be developed into embryos outside a woman’s body than are required for medically-assisted reproduction.
d. The donation of embryos and all forms of surrogate motherhood are unlawful.
e. The trade in human reproductive material and in products obtained from embryos is prohibited.

a. Alle Arten des Klonens und Eingriffe in das Erbgut menschlicher Keimzellen und Embryonen sind unzulässig.
b. Nichtmenschliches Keim- und Erbgut darf nicht in menschliches Keimgut eingebracht oder mit ihm verschmolzen werden.
c. Die Verfahren der medizinisch unterstützten Fortpflanzung dürfen nur angewendet werden, wenn die Unfruchtbarkeit oder die Gefahr der Übertragung einer schweren Krankheit nicht anders behoben werden kann, nicht aber um beim Kind bestimmte Eigenschaften herbeizuführen oder um Forschung zu betreiben; die Befruchtung menschlicher Eizellen ausserhalb des Körpers der Frau ist nur unter den vom Gesetz festgelegten Bedingungen erlaubt; es dürfen nur so viele menschliche Eizellen ausserhalb des Körpers der Frau zu Embryonen entwickelt werden, als für die medizinisch unterstützte Fortpflanzung notwendig sind.
d. Die Embryonenspende und alle Arten von Leihmutterschaft sind unzulässig.
e. Mit menschlichem Keimgut und mit Erzeugnissen aus Embryonen darf kein Handel getrieben werden.

2 La Confederazione emana prescrizioni sull’impiego del patrimonio germinale e genetico umano. In tale ambito provvede a tutelare la dignità umana, la personalità e la famiglia e si attiene in particolare ai principi seguenti:
a. tutti i tipi di clonazione e gli interventi nel patrimonio genetico di cellule germinali e embrioni umani sono inammissibili;
b. il patrimonio germinale e genetico non umano non può essere trasferito nel patrimonio genetico umano né fuso con quest’ultimo;
c. le tecniche di procreazione assistita possono essere applicate solo quando non vi sono altri modi per curare l’infecondità o per ovviare al pericolo di trasmissione di malattie gravi, non però per preformare determinati caratteri nel nascituro o a fini di ricerca; la fecondazione di oociti umani fuori del corpo della donna è permessa solo alle condizioni stabilite dalla legge; fuori del corpo della donna può essere sviluppato in embrioni soltanto il numero di oociti umani necessario ai fini della procreazione assistita;
d. la donazione di embrioni e ogni altra forma di maternità sostitutiva sono inammissibili;
e. non può essere fatto commercio di patrimonio germinale umano né di prodotti da embrioni;
