The persons whose constitutional rights have been violated or are in danger of being so, may interpose the recourse of personal exhibition [exhibicidn personal habeas corpus], of amparo, or of habeas data, according to the case and in accordance with the Law of Constitutional Justice. (Art. 45)

- EnglishThe State is obliged to investigate and legally punish offenses against human rights committed by its authorities.
Actions to punish the offense of violating humanity rights, serious violations of human rights and war crimes shall not be subject to statute of limitation. Human rights violations and the offense of violating humanity rights shall be investigated and adjudicated by the courts of ordinary competence. These offenses are excluded from any benefit that might render the offenders immune from punishment, including pardons and amnesty. - EnglishAny person may seek amparo before the Constitutional Chamber of the Supreme Court of Justice for violation of the rights granted by this Constitution.
The habeas corpus may be sought before the Constitutional Chamber of the Supreme Court of Justice or before the Chambers of Second Instance that do not reside in the capital. The resolution of the Chamber that denies the freedom of the favored person [favorecido] may be the object of review [revisión], at the request of the interested party, by the Constitutional Chamber of the Supreme Court of Justice. - EnglishEvery person against whom a Public Officer shall issue or execute a mandatory order or an injunction violating the rights and guarantees established by this Constitution, shall have the right of the order being revoked upon his/her petition or the petition of any other person.
The writ for protection of constitutional guarantee (amparo de garantías constitucionales), to which this Article refers, shall be subject to summary proceedings and the Cognizance of Courts of Law. 1. Rights can be exercised, promoted and enforced individually or collectively before competent authorities; these authorities shall guarantee their enforcement.

- EnglishThe state recognizes the guarantee of amparo.
Consequently, any aggrieved person, or any other in his name, has the right to interpose the recourse of amparo:
1) so that the enjoyment and benefit [goce y disfrute] of the rights and guarantees that the Constitution, the treaties, conventions and other international instruments establish[,] are maintained or restituted; and
2) so that in specific [concretos] cases that a regulation, act [hecho], act [acto] or resolution of authority is declared to not obligate the petitioner [recurrente] or is not applicable to contravene, diminish or distort any of the rights recognized by this Constitution.
When the action of amparo is interposed before a non-competent Jurisdictional Organ, the written original must be remitted to the competent Jurisdictional Organ.
The recourse of amparo must be interposed in conformity with the law. (Art. 183) - SpanishEl Estado reconoce la garantía de amparo.
En consecuencia toda persona agraviada o cualquiera en nombre de ésta, tiene derecho a interponer recurso de amparo:
1) Para que se le mantenga o restituya en el goce y disfrute de los derechos o garantías que la Constitución, los tratados, convenciones y otros instrumentos internacionales establecen; y,
2) Para que se declare en casos concretos que un reglamento, hecho, acto o resolución de autoridad, no obliga, al recurrente ni es aplicable por contravenir, disminuir o tergiversar cualesquiera de los derechos reconocidos por esta Constitución.
Cuando la acción de amparo se interrumpiese ante un órgano Jurisdiccional incompetente éste debe remitir el escrito original al órgano Jurisdiccional competente.
El recurso de Amparo se debe interponer de conformidad con la Ley. (Art. 183)
