Status of International Law
- EnglishWhen a judge, by virtue of his/her office or at the request of a party, considers that a legal norm is contrary to the Constitution or to international human rights instruments that provide for rights that are more favorable than those enshrined in the Constitution, it shall suspend the case and refer it for consultation to the Constitutional Court, which within no more than forty-five (45) days shall rule on the constitutionality of the norm.
If the Court issues no ruling within the established time-limits, the affected party is entitled to file the corresponding complaint. (Art. 428) - SpanishCuando una jueza o juez, de oficio o a petición de parte, considere que una norma jurídica es contraria a la Constitución o a los instrumentos internacionales de derechos humanos que establezcan derechos más favorables que los reconocidos en la Constitución, suspenderá la tramitación de la causa y remitirá en consulta el expediente a la Corte Constitucional, que en un plazo no mayor a cuarenta y cinco días, resolverá sobre la constitucionalidad de la norma.
Si transcurrido el plazo previsto la Corte no se pronuncia, el perjudicado podrá interponer la acción correspondiente. (Art. 428)

- EnglishI. Every person, natural and legal, as well as public organs, public functions and institutions, are subject to the present Constitution.
II. The Constitution is the supreme norm of Bolivian law and enjoys supremacy before any other normative disposition. The components of constitutional law include the international Treaties and Conventions in the matter of human rights and the norms of Communitarian Law, which have been ratified by the country. The application of the legal norms shall be governed by the following hierarchy, in accordance with the authority of the territorial entities:
1. Constitution of the State.
2. International treaties.
3. National laws, statutes of the autonomies, organic charters and the other departmental, municipal and indigenous legislation.
4. Decrees, regulations and other resolutions issued by the corresponding executive organs. (Art. 410) - SpanishI. Todas las personas, naturales y jurídicas, así como los órganos públicos, funciones públicas e instituciones, se encuentran sometidos a la presente Constitución.
II. La Constitución es la norma suprema del ordenamiento jurídico boliviano y goza de primacía frente a cualquier otra disposición normativa. El bloque de constitucionalidad está integrado por los Tratados y Convenios internacionales en materia de Derechos Humanos y las normas de Derecho Comunitario, ratificados por el país. La aplicación de las normas jurídicas se regirá por la siguiente jerarquía, de acuerdo a las competencias de las entidades territoriales:
1. Constitución Política del Estado.
2. Los tratados internacionales.
3. Las leyes nacionales, los estatutos autonómicos, las cartas orgánicas y el resto de legislación departamental, municipal e indígena.

- EnglishEveryone has the right, on the terms established by the human rights treaties, pacts and conventions ratified by the Republic, to address petitions and complaints to the intentional organs created for such purpose, in order to ask for protection of his or her human rights.
The State shall adopt, in accordance with the procedures established under this Constitution and by the law, such measures as may be necessary to enforce the decisions emanating from international organs as provided for under this article. - EnglishInternational treaties and agreements ratified by the Congress that recognize human rights and that prohibit their limitation in the states of emergency, have prevalence in the internal order. The rights and duties consecrated in this Charter will be interpreted in conformity with international treaties on human rights ratified by Colombia.
The Colombian State can recognize the jurisdiction of the International Criminal Court in the terms specified in the Statute of Rome adopted on 17 of July of 1998 by the Plenipotentiary Conference of the United Nations and, consequently, to ratify this treaty in accordance within the procedure established in this Constitution.
The admission of a substantial disparity in treatment by the Statute of Rome with respect to the guarantees contained in the Constitution will have effects exclusively within the scope of the matter regulated in it. (Art. 93) - SpanishLos tratados y convenios internacionales ratificados por el Congreso, que reconocen los derechos humanos y que prohíben su limitación en los estados de excepción, prevalecen en el orden interno.
Los derechos y deberes consagrados en esta Carta, se interpretarán de conformidad con los tratados internacionales sobre derechos humanos ratificados por Colombia.
El Estado Colombiano puede reconocer la jurisdicción de la Corte Penal Internacional en los términos previstos en el Estatuto de Roma adoptado el 17 de julio de 1998 por la Conferencia de Plenipotenciarios de las Naciones Unidas y, consecuentemente, ratificar este tratado de conformidad con el procedimiento establecido en esta Constitución. La admisión de un tratamiento diferente en materias sustanciales por parte del Estatuto de Roma con respecto a las garantías contenidas en la Constitución tendrá efectos exclusivamente dentro del ámbito de la materia regulada en él.
