It corresponds to the Constitutional Tribunal:
1. To take cognizance, in sole instance, of the action of unconstitutionality.
2. To take cognizance, in final and definitive instance, of resolutions denying habeas corpus, amparo, habeas data, and action of cumplimiento.

- EnglishI. The Pluri-National Constitutional Court (Tribunal Constitucional Plurinacional) assures the supremacy of the Constitution, exercises constitutional control, and safeguards respect for and enforcement of constitutional rights and guarantees.
II. As criteria to be applied in its interpretive role, the Pluri-National Constitutional Court shall give preference to the intent of the constituent assembly as demonstrated in its documents, acts and resolutions, as well as the literal tenor of the text. - EnglishThe declaration of the unconstitutionality of a law and the inapplicability of the provisions affected thereby, may be requested by any person who considers that his direct, personal, and legitimate interest is injured:
1. By means of lawsuit, which must be filed before the Supreme Court of Justice;
2. By plea of exception, which may be made in any judicial proceeding.
A judge or court which hears any judicial proceeding, or the Contentious-Administrative Tribunal, as the case may be, may also request the declaration of unconstitutionality of a law and its inapplicability, before rendering a decision.
In this case and in that provided in subparagraph 2 above, the proceedings shall be suspended and the case referred to the Supreme Court of Justice. (Art. 258) - SpanishLa declaración de inconstitucionalidad de una ley y la inaplicabilidad de las disposiciones afectadas por aquélla, podrán solicitarse por todo aquel que se considere lesionado en su interés directo, personal y legítimo:
1º) Por vía de acción, que deberá entablar ante la Suprema Corte de Justicia.
2º) Por vía de excepción, que podrá oponer en cualquier procedimiento judicial.
El Juez o Tribunal que entendiere en cualquier procedimiento judicial, o el Tribunal de lo Contencioso Administrativo, en su caso, también podrá solicitar de oficio la declaración de inconstitucionalidad de una ley y su inaplicabilidad, antes de dictar resolución.

- EnglishIf a judicial body considers, when hearing a case, that a regulation having the force of an act which is applicable thereto and upon the validity of which the judgment depends, might be contrary to the Constitution, it may bring the matter before the Constitutional Court in the circumstances, manner and subject to the consequences to be laid down by law, which shall in no case have a suspensive effect. (Sec. 163)

- EnglishIt will correspond to a specialized Chamber of the Supreme Court of Justice to declare, by absolute majority of its members, the unconstitutionality of the norms of any nature and of the acts subject to the Public Law. The jurisdictional acts of the Judicial Power, the declaration of election made by the Supreme Tribunal of Elections and the others determined by the law[,] will not be impugnable by this way.
It will also correspond to it:
a. To settle the conflicts of competence between the powers of the State, the Supreme Tribunal of Elections included, as well as with the other entities or organs that the law indicates.
b. To take cognizance of the consultations on bills of constitutional reform, of approval of international agreements or treaties and of other bills of law, as provided in the law. (Art. 10) - SpanishCorresponderá a una Sala especializada de la Corte Suprema de Justicia declarar, por mayoría absoluta de sus miembros, la inconstitucionalidad de las normas de cualquier naturaleza y de los actos sujetos al Derecho Público. Le corresponderá además:

- EnglishAmong the constitutional and legal functions of the Supreme Court of Justice shall be the following:
1. To guard the integrity of the Constitution. For this purpose, and after hearing the opinion of the Attorney General of the Nation or the Solicitor General of the Administration, the Court in plenary session shall try and rule on cases concerning the unconstitutionality of laws, decrees, decisions, resolutions and other acts that for reasons of substance or form are challenged before it, by any person.
When during the proceedings of a case, the public official entrusted with the administration of Justice considers, or it is observed by one of the parties, that the legal or regulatory provision applicable to the case is unconstitutional, he/she shall submit the question to the cognizance of the Court in plenary session, except when the provision has already been the subject of a decision, and shall order a continuance of the case, until the question of constitutionality is decided.
The parties only shall be able to formulate such observations one time during the process of a case;
… (Art. 206) - SpanishLa Corte Suprema de Justicia tendrá, entre sus atribuciones constitucionales y legales, las siguientes:
1. La guarda de la integridad de la Constitución para lo cual la Corte en pleno conocerá y decidirá, con audiencia del Procurador General de la Nación o del Procurador de la Administración, sobre la inconstitucionalidad de las Leyes, decretos, acuerdos, resoluciones y demás actos que por razones de fondo o de forma impugne ante ella cualquier persona.
Cuando en un proceso el funcionario público encargado de impartir justicia advirtiere o se lo advirtiere alguna de las partes que la disposición legal o reglamentaria aplicable al caso es inconstitucional, someterá la cuestión al conocimiento del pleno de la Corte, salvo que la disposición haya sido objeto de pronunciamiento por parte de ésta, y continuará el curso del negocio hasta colocarlo en estado de decidir.
Las partes sólo podrán formular tales advertencias una sola vez por instancia.
