- EnglishCitizens individually or collectively shall be entitled to file a special petition for protection against judgments, final writs or resolutions that have the force of sentencing. For ruling on the admissibility of this appeal, the court shall check compliance with the following requirements:
1. That the judgments, writs and resolutions are final and fully enforceable.
2. That the complainant shows that, in the judgment, there has been a breach, either by deed or omission, of due process of law or other rights enshrined in the Constitution. - English(1) An appeal to the Court of Appeal shall lie as of right from decisions of the High Court in the following cases, that is to say -
(a) final decisions in any civil or criminal proceedings on questions as to the interpretation of this Constitution; and
(b) final decisions given in exercise of the jurisdiction conferred on the High Court by article 153 (which relates to the enforcement of fundamental rights and freedoms).
(2) Nothing in paragraph (1) shall apply to the matters for which provision is made by article 163. (Art. 133)

- English(1) Where any question as to the interpretation of this Constitution arises in any court of law established for Saint Lucia (other than the Court of Appeal, the High Court or a court martial) and the court is of opinion that the question involves a substantial question of law, the court shall refer the question to the High Court.
(2) Where any question is referred to the High Court in pursuance of this section, the High Court shall give its decision upon the question and the court in which the question arose shall dispose of the case in accordance with that decision or, if the decision is the subject of an appeal to the Court of Appeal or Her Majesty in Council, in accordance with the decision of the Court of Appeal or, as the case may be, Her Majesty in Council. Interpretations established by the Constitutional Division concerning the contents or scope of constitutional rules and principles are binding on the other division of the Supreme Tribunal of Justice and on all of the other courts of the Republic. - EnglishI. The Popular Action shall be filed during the period in which the violation or threat to the rights and collective interests continues. To file this action it is not necessary to exhaust the judicial or administrative processes that might exist.
II. Any person, in his or her individual name or on behalf of a collective, may file this action, and it shall be filed obligatorily by the Public Ministry and the Public Defender (Ministerio Público y el Defensor del Pueblo) when, in the exercise of their functions, they have knowledge of these acts. The procedure for the Action for Constitutional Protection shall be applied. (Art. 136) - SpanishI. La Acción Popular podrá interponerse durante el tiempo que subsista la vulneración o la amenaza a los derechos e intereses colectivos. Para interponer esta acción no será necesario agotar la vía judicial o administrativa que pueda existir.
II. Podrá interponer esta acción cualquier persona, a título individual o en representación de una colectividad y, con carácter obligatorio, el Ministerio Público y el Defensor del Pueblo, cuando por el ejercicio de sus funciones tengan conocimiento de estos actos. - EnglishThe Supreme Court of Justice through the Constitutional Chamber will be the sole tribunal competent to declare the unconstitutionality of the laws, decrees, and regulations, in their form and content, in a general and obligatory manner, and it may do so on petition by any citizen. (Art. 183)

- EnglishThe declaration of unconstitutionality of a law and its abrogation [derogación], may be solicited, by anyone who considers himself injured in his direct, personal, and legitimate interest:
1) By way of action that must be brought [entablar] before the Supreme Court of Justice;
2) By way of exception. which may be opposed in any judicial proceeding; and
3) Also[,] the Jurisdictional Organ that takes cognizance in any Judicial proceeding may solicit[,] of office[,] the declaration of unconstitutionality of a Law and its abrogation before dictating a decision [resolución].
In the cases contemplated in numerals 2) and 3), the activity [actuaciones] must be elevated to the Supreme Court of Justice[,] the procedure following from the moment of summons for decision [sentencia], after which the judicial procedure of the partial question in the sphere of the resolution concerning the unconstitutionality must be suspended. (Art. 185) - SpanishLa declaración de inconstitucionalidad de una ley y su derogación, debe solicitarse, por quien se considere lesionado en su interés directo, personal y legítimo:
1) Por vía de acción que se debe entablar ante la Corte Suprema de Justicia;
2) Por vía de excepción, que podrá oponer en cualquier procedimiento judicial; y,
3) También el Órgano Jurisdiccional que conozca en cualquier procedimiento judicial, podrá solicitar de oficio la declaración de inconstitucionalidad de una ley y su derogación antes de dictar resolución.
