Limitations and/or Derogations

The statute specifying the scope of limitation of the freedoms and rights of persons and citizens in times of martial law and states of emergency shall not limit the freedoms and rights specified in Article 30 (the dignity of the person), Article 34 and Article 36 (citizenship), Article 38 (protection of life), Article 39, Article 40 and Article 41, para.4 (humane treatment), Article 42 (ascription of criminal responsibility), Article 45 (access to a court), Article 47 (personal rights), Article 53 (conscience and religion), Article 63 (petitions), as well as Article 48 and Article 72 (family and children).
2. Limitation of the freedoms and rights of persons and citizens only by reason of race, gender, language, faith or lack of it, social origin, ancestry or property shall be prohibited.
3. The statute specifying the scope of limitation of the freedoms and rights of persons and citizens during states of natural disasters may limit the freedoms and rights specified in Article 22 (freedom of economic activity), Article 41, paras. 1, 3 and 5 (personal freedom), Article 50 (inviolability of the home), Article 52, para. 1 (freedom of movement and sojourn on the territory of the Republic of Poland), Article 59, para. 3 (the right to strike), Article 64 (the right of ownership), Article 65, para. 1 (freedom to work), Article 66, para. 1 (the right to safe and hygienic conditions of work) as well as Article 66, para. 2 (the right to rest). - EnglishI. The rights recognized in this Constitution are inviolable, universal, interdependent, indivisible and progressive. The State has the duty to promote, protect and respect them.
II. The rights declared in this Constitution shall not be understood to deny other rights that are not enumerated.
III. The classification of the rights established in this Constitution does not determine any hierarchy or superiority of some rights over others.
IV. International treaties and conventions ratified by the Pluri-National Legislative Assembly (Asamblea Legislativa), which recognize human rights and prohibit their limitation in States of Emergency, prevail over internal law. The rights and duties consecrated in this Constitution shall be interpreted in accordance with the International Human Rights Treaties ratified by Bolivia. (Art. 13) - SpanishI. (1) Obligations can only be imposed:
a) by the law or on the basis of a law, within its limits and in the respect of fundamental rights and liberties.
b) by international agreement according to art. 7, paragr. 4, which directly determines the rights and obligations of physical and legal persons, or
c) by directive of the Government according to art. 119, paragr. 2.
(2) Limitation of fundamental rights and freedoms shall be imposed only under the conditions set forth in this Constitution.
(3) Restrictions of constitutional rights and freedoms shall be applied equally and consistently in all similar cases.
(4) When imposing restrictions on constitutional rights and freedoms, respect must be given to the essence and meaning of these rights and freedoms and such restrictions shall be used only for specifically defined purposes. (Art. 13) - Slovak
(1) Povinnosti moţno ukladať
a) zákonom alebo na základe zákona, v jeho medziach a pri zachovaní základných práv a slobôd,
b) medzinárodnou zmluvou podľa čl. 7 ods. 4, ktorá priamo zakladá práva a povinnosti fyzických osôb alebo právnických osôb, alebo
c) nariadením vlády podľa čl. 120 ods. 2.
(2) Medze základných práv a slobôd moţno upraviť za podmienok ustanovených touto ústavou len zákonom.
(3) Zákonné obmedzenia základných práv a slobôd musia platiť rovnako pre všetky prípady, ktoré spĺňajú ustanovené podmienky.
(4) Pri obmedzovaní základných práv a slobôd sa musí dbať na ich podstatu a zmysel.
Takéto obmedzenia sa môţu pouţiť len na ustanovený cieľ. (Čl. 13)

- EnglishBy the declaration of a state of assembly, the President of the Republic is enabled to suspend or restrict personal liberty, the right of assembly and the freedom to work. He can, also, restrict the exercise of the right of association, intercept, open, or record documents and all classes of communications, order [disponer] requisition of assets and establish limitations on the exercise of the right of ownership [propiedad].
By the declaration of a state of siege, the President of the Republic can restrict the freedom of movement and detain [arrestar] persons in their own homes or in places and which the laws determines that are neither jails nor those used for the detention or imprisonment of common criminals. He can also suspend or restrict the exercise of the right of assembly.
By the declaration of a state of catastrophe, the President of the Republic can restrict the freedoms of movement and of assembly. He can, also, order the requisition of assets, establish limitations on the exercise of the right of ownership and adopt all the extraordinary measures of administrative character necessary for the prompt re-establishment of normalcy in the affected zone.
By the declaration of a state of emergency, the President of the Republic can restrict the freedoms of movement and of assembly. Podrá, asimismo, disponer requisiciones de bienes, establecer limitaciones al ejercicio del derecho de propiedad y adoptar todas las medidas extraordinarias de carácter administrativo que sean necesarias para el pronto restablecimiento de la normalidad en la zona afectada.
Por la declaración del estado de emergencia, el Presidente de la República podrá restringir las libertades de locomoción y de reunión. (Art. 43)

- English1. Rights and freedoms of an individual and citizen may be limited only by law and only to the extent necessary for the protection of the constitutional system, defense of public order, human rights and freedoms, and the health and morality of the population.
2. Any acts capable of violating inter-ethnic and inter-religious harmony shall be recognized as unconstitutional.
3. Restriction of the rights and freedoms of citizens for political reasons shall not be allowed in any form. The rights and freedoms provided for by articles 11, 13–15, paragraph 1 of article 16, article 17, article 19, article 22, paragraph 2 of article 26 of the Constitution, are not subject to limitation in any case. - EnglishIn the case of the national sovereignty or the territorial integrity being seen as in grave and imminent danger by external armed aggressions, the Executive Power, without prejudice to the inherent abilities of his office, may request from the National Congress the declaration of State of Defense. In this state the following may not be suspended:
1. The right to life, following the provisions of Article 37.
2. The right to personal integrity, following the provisions of Article 42.
3. Liberty of conscience and religions, following the provisions of Article 45.
4. The protection of the family, following the provisions of Article 55.
5. The right to one’s name, following the provisions of Article 55, number 7.
6. The rights of the child, following the provisions of Article 56.
7. The right to nationality, following the provisions of Article 18.
8. The rights of citizenship, following the provisions of Article 22.
9. The prohibition of slavery and servitude, following the provisions of Article 41.
10. The principle of legality and of non-retroactivity, following that established in Article 40, numbers 13 and 15.
11. The right to the recognition of juridical personality, following the provisions of Articles 43 and 55, number 7.
12. The judicial, process, and institutional guarantees indispensable for the protection of those rights, following the provisions of Article 69, 71, and 72. (1) In case a grave emergency arises in sovereignty, territorial integrity or the security of any part of Nepal by the reason of war, external aggression, armed rebellion, extreme economic disarrays, natural disaster or epidemic; the President may, by Proclamation, declare or order a state of emergency in respect of the whole of Nepal or of any particular part thereof.

(10) At the time of issuance of the Proclamation or order of a state of emergency pursuant to clause (1), the fundamental rights as provided for in Part-3 may be suspended until the proclamation or order is in operation.
Provided that Article 16, sub-clauses (c) and (d) of clause (2) of Article 17, Article 18, clause (2) of Article 19, Articles 20, 21, 22 and 24, clause (1) of Article 26, Articles 29, 30, 31, 32, 35, clauses (1) and (2) of Article 36, Articles 38, 39, clauses (2) and (3) of Article 40, Articles 41, 42, 43, 45, and the right to constitutional remedy in relation to such Articles pursuant to Article 46 and the right to seek the remedy of habeas corpus shall not be suspended.
(11) In case any Article of this Constitution is suspended pursuant to clause (10), no petition may lie in any court for the enforcement of the fundamental right conferred by that Article nor may a question be raised in any Court in that respect.
