Judicial Protection
- EnglishEvery person against whom a Public Officer shall issue or execute a mandatory order or an injunction violating the rights and guarantees established by this Constitution, shall have the right of the order being revoked upon his/her petition or the petition of any other person.
The writ for protection of constitutional guarantee (amparo de garantías constitucionales), to which this Article refers, shall be subject to summary proceedings and the Cognizance of Courts of Law. (Art. 54) - SpanishToda persona contra la cual se expida o se ejecute, por cualquier servidor público, una orden de hacer o de no hacer, que viole los derechos y garantías que esta Constitución consagra, tendrá derecho a que la orden sea revocada a petición suya o de cualquier persona.

- English(1) For the removal of doubts it is hereby declared that if any person alleges that any of the provisions of this Chapter4 has been, is being, or is likely to be contravened in relation to him, then without prejudice to any other action with respect to the same matter which is lawfully available, that person may apply to the High Court for redress by way of originating motion.
(2) The High Court shall have original jurisdiction—
(a) to hear and determine any application made by any person in pursuance of subsection (1); and
(b) to determine any question arising in the case of any person which is referred to it in pursuance of subsection (4),
and may, subject to subsection (3), make such orders, issue such writs and give such directions as it may consider appropriate for the purpose of enforcing, or securing the enforcement of, any of the provisions of this Chapter to the protection of which the person concerned is entitled.
(3) The State Liability and Proceedings Act shall have effect for the purpose of any proceedings under this section.
(4) Where in any proceedings in any Court other than the High Court or the Court of Appeal any question arises as to the contravention of any of the provisions of this Chapter the person presiding in that Court may, and shall if any party to the proceedings so requests, refer the question to the High Court unless in his opinion the raising of the question is merely frivolous or vexatious.
(5) Any person aggrieved by any determination of the High Court under this section may appeal therefrom to the Court of Appeal and shall be entitled as of right to a stay of execution of the order and may in the discretion of the Court be granted bail.
(6) Nothing in this section shall limit the power of Parliament to confer on the High Court or the Court of Appeal such powers as Parliament may think fit in relation to the exercise by the High Court or the Court of Appeal, as the case may be, of its jurisdiction in respect of the matters arising under this Chapter. - English1. An appeal to the Court of appeal shall lie as of right from final decisions of the Supreme Court given in exercise of the jurisdiction conferred on the Supreme Court by Article 28 of this Constitution (which relates to the enforcement of fundamental rights and freedoms).
2. An appeal shall lie as of right to the Judicial Committee of Her Majesty's Privy Council or to such other court as may be prescribed by Parliament under Article 105(3) of this Constitution form any decisions given by the Court of Appeal in any such case. (Art. 104)

- EnglishEveryone has the right to be protected by the courts in the enjoyment and exercise of constitutional rights and guarantees, including even those inherent individual rights not expressly mentioned in this Constitution or in international instruments concerning human rights.
Proceedings on a claim for constitutional protection shall be oral, public, brief, free of charge and unencumbered by formalities, and the competent judge shall have the power to restore immediately the legal situation infringed upon or the closest possible equivalent thereto. All time shall be available for the holding of such proceedings, and the court shall give constitutional claims priority over any other matters.
The action for the protection of liberty or safety, may be exercised by any person and the physical custody of the person of the detainee shall be transferred immediately to the court, without delay.
The exercise of this right shall not be affected in any way by the declaration of a state of exception or restriction of constitutional guarantees. (Art. 72) - SpanishToda persona tiene derecho a una acción de amparo para reclamar ante los tribunales, por sí o por quien actúe en su nombre, la protección inmediata de sus derechos fundamentales, no protegidos por el hábeas corpus, cuando resulten vulnerados o amenazados por la acción o la omisión de toda autoridad pública o de particulares, para hacer efectivo el cumplimiento de una ley o acto administrativo, para garantizar los derechos e intereses colectivos y difusos. De conformidad con la ley, el procedimiento es preferente, sumario, oral, público, gratuito y no sujeto a formalidades.
Párrafo.- Los actos adoptados durante los Estados de Excepción que vulneren derechos protegidos que afecten irrazonablemente derechos suspendidos están sujetos a la acción de amparo. (Art. 72)
