Political Rights and Association

Political Rights and Association
- EnglishAll Nigeriens are born and remain free and equal in rights and in duties. However, the access of certain categories of citizens to electoral mandates, to elective functions and to public employments may be favored by particular measures specified by the law. (Art. 10)

Political Rights and Association

Political Parties
- EnglishUnder the framework [cadre] of the freedom of association recognized and guaranteed by this Constitution, the political parties, groups of political parties, trade-unions [syndicats], the non-governmental organizations and other associations or groups of associations are formed and exercise their activities freely, within respect for the laws and regulations in force.
The political parties and the groups of political parties concur in the expression of the suffrage. The same prerogatives are recognized to all Nigerien citizens enjoying their civil and political rights and meeting the conditions of eligibility provided by the law.
The political parties with an ethnic, regionalist or religious character are prohibited. No party may be knowingly created with the purpose of promoting an ethnic group, a region or a religion, under penalty of the sanctions provided by the law. (Art. 9) - FrenchDans le cadre de la liberté d'association reconnue et garantie par la présente Constitution, les partis politiques, groupements de partis politiques, syndicats, organisations non gouvernementales et autres associations ou groupements d'associations se forment et exercent leurs activités librement, dans le respect des lois et règlements en vigueur.
Les partis et groupements de partis politiques concourent à l'expression des suffrages. Les mêmes prérogatives sont reconnues à tout citoyen nigérien jouissant de ses droits civils et politiques et remplissant les conditions d'éligibilité prévues par la loi.
Les partis politiques à caractère ethnique, régionaliste ou religieux sont interdits. Aucun parti ne saurait être créé dans le but de promouvoir une ethnie, une région ou une religion, sous peine des sanctions prévues par la loi. (Art. 9)

Une loi organique précise les conditions d'éligibilité, de présentation des candidatures, de déroulement du scrutin, de dépouillement et de proclamation des résultats.

Legislature

Nigeriens of the two (2) sexes, at least twenty-one (21) years old and enjoying their civil and political rights[,] are eligible to the National Assembly.
The lists of the political parties, of the groups of parties as well as those of the independent candidates must obligatorily include [compter], at least, 75% of [their] candidates holding, at least, the Brevet d'Etudes du Premier Cycle (BEPC), [Certificate of Studies of the First Cycle] or its equivalent and 25%, at most, of [their candidates] not fulfilling this condition.
Within this quota, the special circumscriptions are integrated within the regions to which they belong.
An organic law establishes the number of members of the National Assembly, the indemnity of the Deputies and the benefits [avantages], their conditions of eligibility, the regime of ineligibilities and of incompatibilities, the modality of the ballot as well as the conditions under which the vacancy of [a] seat of [a] Deputy is provided for. Sont éligibles à l'Assemblée nationale, les Nigériens des deux (2) sexes, âgés de vingt et un (21) ans au moins et jouissant de leurs droits civils et politiques.
Les listes des partis politiques, des groupements de partis ainsi que celles des candidats indépendants doivent obligatoirement compter, au moins, 75% de candidats titulaires, au moins, du Brevet d'études du premier cycle (BEPC) ou de son équivalent et 25%, au plus, de ceux ne remplissant pas cette condition.
Dans ce quota, les circonscriptions spéciales sont intégrées dans les régions dont elles relèvent.
Une loi organique fixe le nombre des membres de l'Assemblée nationale, l'indemnité des députés et leurs avantages, leurs conditions d'éligibilité, le régime des inéligibilités et des incompatibilités, les modalités du scrutin ainsi que les conditions dans lesquelles il est pourvu au siège vacant d'un député. (Art. 84)
