Limitations and/or Derogations
- EnglishThe limitations that can be imposed on the exercise of the rights and freedoms guaranteed in this Constitution will be established by law, without compromising their essence. Any such limitations can only be put in place for reasons necessary to a civil and democratic state and with the aim of protecting the rights of others, or based on the requirements of public order, national defence, public health or public morals, and provided there is proportionality between these restrictions and the objective sought.
Judicial authorities ensure that rights and freedoms are protected from all violations.
There can be no amendment to the Constitution that undermines the human rights and freedoms guaranteed in this Constitution. (Art. 49) - Arabicيحدّد القانون الضوابط المتعلقة بالحقوق والحرّيات المضمونة بهذا الدستور وممارستها بما لا ينال من جوهرها. ولا توضع هذه الضوابط إلّا لضرورة تقتضيها دولة مدنية ديمقراطية وبهدف حماية حقوق الغير، أو لمقتضيات الأمن العام، أو الدفاع الوطني، أو الصّحة العامة، أو الآداب العامة، وذلك مع احترام التّناسب بين هذه الضوابط وموجباتها.
وتتكفّل الهيئات القضائية بـحماية الحقوق والحريات من أي انتهاك.
لا يجوز لأيّ تعديل أن ينال من مكتسبات حقوق الإنسان وحرياته المضمونة في هذا الدستور. (الفصل 49) - FrenchSans porter atteinte à leur substance, la loi fixe les restrictions relatives aux droits et libertés garantis par la Constitution et à leur exercice. Ces restrictions ne peuvent être établies que pour répondre aux exigences d’un État civil et démocratique, et en vue de sauvegarder les droits d’autrui ou les impératifs de la sûreté publique, de la défense nationale, de la santé publique ou de la moralité publique tout en respectant la proportionnalité entre ces restrictions et leurs justifications. Les instances juridictionnelles assurent la protection des droits et libertés contre toute atteinte.
Aucune révision ne peut porter atteinte aux acquis en matière de droits de l’Homme et de libertés garantis par la présente Constitution. (Art. 49)
