Political Constitution of the Plurinational State of Bolivia 2009
Limitations and/or Derogations
  • English
    I. The rights recognized in this Constitution are inviolable, universal, interdependent, indivisible and progressive. The State has the duty to promote, protect and respect them.
    II. The rights declared in this Constitution shall not be understood to deny other rights that are not enumerated.
    III. The classification of the rights established in this Constitution does not determine any hierarchy or superiority of some rights over others.
    IV. International treaties and conventions ratified by the Pluri-National Legislative Assembly (Asamblea Legislativa), which recognize human rights and prohibit their limitation in States of Emergency, prevail over internal law. The rights and duties consecrated in this Constitution shall be interpreted in accordance with the International Human Rights Treaties ratified by Bolivia. (Art. 13)

    I. Los derechos reconocidos por esta Constitución son inviolables, universales, interdependientes, indivisibles y progresivos. El Estado tiene el deber de promoverlos, protegerlos y respetarlos.
    II. Los derechos que proclama esta Constitución no serán entendidos como negación de otros derechos no enunciados.
    III. La clasificación de los derechos establecida en esta Constitución no determina jerarquía alguna ni superioridad de unos derechos sobre otros.
    IV. Los tratados y convenios internacionales ratificados por la Asamblea Legislativa Plurinacional, que reconocen los derechos humanos y que prohíben su limitación en los Estados de Excepción prevalecen en el orden interno. Los derechos y deberes consagrados en esta Constitución se interpretarán de conformidad con los Tratados internacionales de derechos humanos ratificados por Bolivia. (Art. 13)

    In the case of danger to the security of the State, external threat, internal disturbance or national disaster, the President of the State shall have the power to declare a state of emergency, wherever necessary in all or part of the territory. The declaration of the state of emergency shall not, in any case, suspend the guarantees of rights, nor the fundamental rights, the right of due process, the right to information and the rights of persons deprived of liberty. (Art. 137)

    En caso de peligro para la seguridad del Estado, amenaza externa, conmoción interna o desastre natural, la Presidenta o el Presidente del Estado tendrá la potestad de declarar el estado de excepción, en todo o en la parte del territorio donde fuera necesario. La declaración del estado de excepción no podrá en ningún caso suspender las garantías de los derechos, ni los derechos fundamentales, el derecho al debido proceso, el derecho a la información y los derechos de las personas privadas de libertad. (Art. 137)

    I. The validity of the declaration of the state of emergency shall depend on the subsequent approval of the Pluri-National Legislative Assembly, which shall take place as soon as circumstances permit, and in all cases, within seventy two hours following the declaration of the state of emergency. The approval of the declaration shall indicate the powers conferred, and it shall maintain strict relation and proportion to the case of necessity addressed by the state of emergency. In general, the rights consecrated in the Constitution shall not be suspended by the declaration of the state of emergency.

    I. La vigencia de la declaración del estado de excepción dependerá de la aprobación posterior de la Asamblea Legislativa Plurinacional, que tendrá lugar apenas las circunstancias lo permitan y, en todo caso, dentro de las siguientes setenta y dos horas a la declaración del estado de excepción. La aprobación de la declaración indicará las facultades conferidas y guardará estricta relación y proporción con el caso de necesidad atendida por el estado de excepción. Los derechos consagrados en la Constitución no quedarán en general suspendidos por la declaración del estado de excepción.

Limitations and/or Derogations

    I. The Executive shall report to the Pluri-National Legislative Assembly concerning the reasons for the declaration of the state of emergency, as well as the use that has been made of the powers conferred by the Constitution and the law.
    II. Those persons who violate the rights established in this Constitution shall be subject to criminal process for violation of rights.
    III. The states of emergency shall be regulated by law. (Art. 139)

    I. El Ejecutivo rendirá cuentas a la Asamblea Legislativa Plurinacional de los motivos que dieron lugar a la declaración del estado de excepción, así como del uso que haya hecho de las facultades conferidas por la Constitución y la ley.
    II. Quienes violen los derechos establecidos en esta Constitución serán objeto de proceso penal por atentado contra los derechos.
    III. Los estados de excepción serán regulados por la ley. (Art. 139)
Limitations and/or Derogations
  • English
    I. Neither the Pluri-National Legislative Assembly, nor any other body or institution, nor association or popular group of any kind, shall grant to a body or person any extraordinary authorities different than those established in this Constitution.
    II. Public Power may not be accumulated, nor may any body or person be granted supremacy over the rights and guarantees recognized in this Constitution.
    III. The reform of the Constitution may not be initiated while there is a state of emergency in force. (Art. 140)

    I. Ni la Asamblea Legislativa Plurinacional, ni ningún otro órgano o institución, ni asociación o reunión popular de ninguna clase, podrán conceder a órgano o persona alguna facultades extraordinarias diferentes a las establecidas en esta Constitución.
    II. No podrá acumularse el Poder Público, ni otorgarse supremacía por la que los derechos y garantías reconocidos en esta Constitución queden a merced de órgano o persona alguna.
    III. La reforma de la Constitución no podrá iniciarse mientras esté vigente un estado de excepción. (Art. 140)
