- EnglishThe persons in possession of political rights have the right to equal, direct, secret and publicly scrutinized universal suffrage, in conformity with the following provisions:
1. Voting shall be mandatory for persons over eighteen years of age. Detained persons who have not been convicted and sentenced shall exercise their right to vote.
2. Voting shall be optional for persons between sixteen and eighteen years of age, elderly persons over sixty-five years of age, Ecuadorians who live abroad, members of the Armed Forces and National Police Force, and persons with disabilities. - EnglishThe State shall promote equality with respect to the representation of women and men in publicly appointed or elected office, in its executive and decision-making institutions, and political parties and movements. As for candidacies in multi-person elections, their participation shall be respected by rotation of power and sequencing.
The State shall adopt affirmative action measures to guarantee the participation of discriminated sectors. (Art. 65) - SpanishEl Estado promoverá la representación paritaria de mujeres y hombres en los cargos de nominación o designación de la función pública, en sus instancias de dirección y decisión, y en los partidos y movimientos políticos. En las candidaturas a las elecciones pluripersonales se respetará su participación alternada y secuencial.
El Estado adoptará medidas de acción afirmativa para garantizar la participación de los sectores discriminados. (Art. 65)

Political Parties
- EnglishPolitical parties and movements are non-State public organizations, which constitute the expressions of political plurality of the people and are sustained by philosophical, political, ideological, inclusive and nondiscriminatory concepts.
Their organization, structure and functioning shall be democratic and shall guarantee rotation of power, accountability, and parity membership between women and men on their governing boards. They shall choose their board members and candidates by means of internal electoral processes or primaries. (Art. 108) - SpanishLos partidos y movimientos políticos son organizaciones públicas no estatales, que constituyen expresiones de la pluralidad política del pueblo y sustentarán concepciones filosóficas, políticas, ideológicas, incluyentes y no discriminatorias.
Su organización, estructura y funcionamiento será democráticos y garantizarán la alternabilidad, rendición de cuentas y conformación paritaria entre mujeres y hombres en sus directivas. Seleccionarán a sus directivas y candidaturas mediante procesos electorales internos o elecciones primarias. (Art. 108)
Political Parties
- EnglishPolitical parties and movements shall be funded by membership dues paid by their members and followers, and as long as they meet the requirements stipulated by law, the political parties shall receive State allocations subject to monitoring.
The political movement that, on two successive multi-person elections, obtains at least five percent (5%) of all valid votes nationwide, shall acquire the same rights and must meet the same obligations as political parties. (Art. 110) - SpanishLos partidos y movimientos políticos se financiarán con los aportes de sus afiliadas, afiliados y simpatizantes, y en la medida en que cumplan con los requisitos que establezca la ley, los partidos políticos recibirán asignaciones del Estado sujetas a control.
El movimiento político que en dos elecciones pluripersonales sucesivas obtenga al menos el cinco por ciento de votos válidos a nivel nacional, adquirirá iguales derechos y deberá cumplir las mismas obligaciones que los partidos políticos. (Art. 110)
Political Parties
- EnglishIn these elections, political organizations and alliances participating in the election of Assembly persons shall be entitled to submit candidacies.
Other political organizations are also entitled to submit candidacies, for which purpose they must show support based on a list of signatures accounting for one percent (1%) of the citizens on the corresponding voter registration list. To this end, the National Electoral Council shall provide the necessary forms.
The mum-persons candidacies shall be submitted in complete slates with principal candidates and their respective alternates. The slates shall be established in an egalitarian fashion with a sequence of woman, man or man, woman until the total number of candidates has been completed. (Transition System, Art. 4) - SpanishEn estas elecciones, las organizaciones políticas y alianzas que participaron en la elección de asambleístas podrán presentar candidaturas.
Podrán también hacerlo otras organizaciones políticas, para lo cual deberán presentar el uno por ciento (1%) de firmas de adhesión de los ciudadanos y ciudadanas del correspondiente registro electoral. Al efecto, el Consejo Nacional Electoral entregará los formularios necesarios.
Las candidaturas pluripersonales se presentarán en listas completas con candidatos principales y sus respectivos suplentes. Las listas se conformarán paritariamente con secuencia de mujer, hombre u hombre, mujer hasta completar el total de candidaturas. (Régimen De Transición, Art. 4)
Electoral Bodies
- EnglishThe Electoral Branch of Government shall guarantee the exercise of political rights as expressed by voting, as well as those referring to the political organization of the citizenry.
The Electoral Branch shall be comprised of the National Electoral Council and the Electoral Dispute Settlement Court. Both bodies shall have their seat in Quito and shall have national jurisdiction, administrative, financial, and organizational autonomy, and their own legal status. They shall be governed by the principles of autonomy, independence, publicity, transparency, equity, interculturalism, gender equality, swiftness and rectitude. (Art. 217) - SpanishLa Función Electoral garantizará el ejercicio de los derechos políticos que se expresan a través del sufragio, así como los referentes a la organización política de la ciudadanía.
La Función Electoral estará conformada por el Consejo Nacional Electoral y el Tribunal Contencioso Electoral. Ambos órganos tendrán sede en Quito, jurisdicción nacional, autonomías administrativa, financiera y organizativa, y personalidad jurídica propia. Se regirán por principios de autonomía, independencia, publicidad, transparencia, equidad, interculturalidad, paridad de género, celeridad y probidad. (Art. 217)
Electoral Bodies
- EnglishThe members of the National Electoral Council and the Electoral Dispute Settlement Court shall be designated by the Council for Public Participation and Social Control, after selection by a competitive and merit-based examination, with candidacies submitted by the citizenry and citizen right to challenge, as well as the guarantee of equity and parity between men and women, in accordance with the law. (Art. 224)

Vice-President

The Vice-President of the Republic, when not replacing the President of the Republic, shall perform the duties that the latter assigns him/her. (Art. 149) - SpanishQuien ejerza la Vicepresidencia de la República cumplirá los mismos requisitos, estará sujeto a las mismas inhabilidades y prohibiciones establecidas para la Presidenta o Presidente de la República, y desempeñará sus funciones por igual período.

Government
- EnglishThe Ministers of State shall be appointed and recalled at the discretion of the President of the Republic and shall represent him/her in matters inherent to the respective ministries for which they are responsible. They shall be held liable politically, civilly and criminally for the actions and contracts they enter into during the performance of their duties, regardless of the State's subsidiary civil responsibility.
To be a standing Minister of State, one is required to be an Ecuadorian national, to be in possession of political rights and to not have incurred any disqualification or incompatibility, as provided for by the Constitution. The number of Ministers of State, their name and the competencies assigned to them shall be established by means of a decree issued by the Office of the President of the Republic. (Art. 151) - SpanishLas ministras y los ministros de Estado serán de libre nombramiento y remoción por la Presidenta o Presidente de la República, y lo representarán en los asuntos propios del ministerio a su cargo. Serán responsables política, civil y penalmente por los actos y contratos que realicen en el ejercicio de sus funciones, con independencia de la responsabilidad civil subsidiaria del Estado.
Para ser titular de un ministerio de Estado se requerirá tener la nacionalidad ecuatoriana, estar en goce de los derechos políticos y no encontrarse en ninguno de los casos de inhabilidad o incompatibilidad previstos en la Constitución. El número de ministras o ministros de Estado, su denominación y las competencias que se les asigne serán establecidos mediante decreto expedido por la Presidencia de la República. (Art. 151)
