    The National Assembly and all bodies with legal and regulatory authority shall be obligated to adjust, formally and materially, the laws and other legal standards related to the rights provided for in the Constitution and international treaties and those that are needed to guarantee the dignity of human beings or communities, peoples and nations. In no case shall amending the Constitution, laws, other legal and regulatory frameworks or actions by the government endanger the rights recognized by the Constitution. (Art. 84)

    The National Equality Councils are bodies responsible for ensuring the full observance and exercise of the rights enshrined in the Constitution and in international human rights instruments. The Councils shall exercise their attributions for the drafting, cross-cutting application, observance, follow-up and evaluation of public policies involving the issues of gender, ethnic groups, generations, interculturalism, and disabilities and human mobility, in accordance with the law. To achieve their objectives, they shall coordinate with leading and executive entities and with specialized organizations for the protection of rights at all levels of government. (Art. 156)

    Los consejos nacionales para la igualdad son órganos responsables de asegurar la plena vigencia y el ejercicio de los derechos consagrados en la Constitución y en los instrumentos internacionales de derechos humanos. Los consejos ejercerán atribuciones en la formulación, transversalización, observancia, seguimiento y evaluación de las políticas públicas relacionadas con las temáticas de género, étnicas, generacionales, interculturales, y de discapacidades y movilidad humana, de acuerdo con la ley.     In the event of any conflict between regulations from different hierarchical levels, the Constitutional Court, judges, administrative authorities and public servants, it shall be settled by the application of the standard of higher order of precedence.

    All persons, authorities and institutions are subject to the Constitution.
    The judges, administrative authorities, and public servants shall directly apply constitutional standards and those provided for in international human rights instruments, as long as the latter are more favorable than those set forth in the Constitution, although the parties do not invoke them expressly.
    The rights enshrined in the Constitution and international human rights instruments shall be for immediate observance and enforcement. The absence of a law or lack of knowledge about the norms cannot be alleged to justify the violation of rights and guarantees enshrined in the Constitution, to dismiss proceedings for their defense, or to refuse recognition of these rights. (Art. 426)

    Todas las personas, autoridades e instituciones están sujetas a la Constitución.
    Las juezas y jueces, autoridades administrativas y servidoras y servidores públicos, aplicarán directamente las normas constitucionales y las previstas en los instrumentos internacionales de derechos humanos siempre que sean más favorables a las establecidas en la Constitución, aunque las partes no las invoquen expresamente.
    Los derechos consagrados en la Constitución y los instrumentos internacionales de derechos humanos serán de inmediato cumplimiento y aplicación. No podrá alegarse falta de ley o desconocimiento de las normas para justificar la vulneración de los derechos y garantías establecidos en la Constitución, para desechar la acción interpuesta en su defensa, ni para negar el reconocimiento de tales derechos.     When a judge, by virtue of his/her office or at the request of a party, considers that a legal norm is contrary to the Constitution or to international human rights instruments that provide for rights that are more favorable than those enshrined in the Constitution, it shall suspend the case and refer it for consultation to the Constitutional Court, which within no more than forty-five (45) days shall rule on the constitutionality of the norm.
    If the Court issues no ruling within the established time-limits, the affected party is entitled to file the corresponding complaint. (Art. 428)

    Cuando una jueza o juez, de oficio o a petición de parte, considere que una norma jurídica es contraria a la Constitución o a los instrumentos internacionales de derechos humanos que establezcan derechos más favorables que los reconocidos en la Constitución, suspenderá la tramitación de la causa y remitirá en consulta el expediente a la Corte Constitucional, que en un plazo no mayor a cuarenta y cinco días, resolverá sobre la constitucionalidad de la norma.
    Si transcurrido el plazo previsto la Corte no se pronuncia, el perjudicado podrá interponer la acción correspondiente. (Art. 428)

    The Constitutional Court shall perform the following duties, in addition to those granted to it by the law:
    1. To be the supreme body for interpreting the Constitution and international human rights treaties ratified by the Ecuadorian State by its rulings and judgments. Its decisions shall be binding.

To hear and resolve, at the request of the party, claims of noncompliance that are filed to guarantee enforcement of general administrative regulations or acts, regardless of their nature or hierarchy, as well for enforcement of rulings or reports from international organizations for the protection of human rights that are not enforceable through regular judiciary channels.
