Status of the Constitution

    The rights and duties of Guatemalans, besides those consigned in other norms of the Constitution and the laws of the Republic, are the following:

Status of the Constitution
  • English
    No law may contradict the provisions of the Constitution. The laws that violate or distort [tergiversen] the constitutional mandates are null ipso jure.
    The laws qualified as constitutional require, for their reform, the vote of the two- thirds part of the total number of deputies that integrate the Congress, prior to the favorable ruling of the Court of Constitutionality. (Art. 175)

    Ninguna ley podrá contrariar las disposiciones de la Constitución. Las leyes que violen o tergiversen los mandatos constitucionales son nulas ipso jure.
    Las leyes calificadas como constitucionales requieren, para su reforma, el voto de las dos terceras partes del total de diputados que integran el Congreso, previo dictamen favorable de la Corte de Constitucionalidad. (Art. 175)

    In all their decisions or sentences, the tribunals of justice will obligatorily observe the principle that the Constitution of the Republic prevails over any law or treaty. (Art. 204)

    All the Constitutions of the Republic of Guatemala and the constitutional reforms decreed prior to the present, are abrogated, as well as any laws and provisions that may have had equal effects. (Transitory and Final Provisions, Art. 22)

    Se derogan todas las Constituciones de la República de Guatemala y reformas constitucionales decretadas con anterioridad a la presente, así como cualesquiera leyes y disposiciones que hubiesen surtido iguales efectos. (Disposiciones Transitorias y Finales, Art. 22)
