Status of International Law

Status of International Law
- EnglishThe minimum social rights that form the basis of the labor legislation and the activity of the tribunals and [the] authorities [are]:
…
t. The State will participate in international or regional agreements and treaties relating to labor matters and which grant better protection of conditions to [the] workers.
In such cases, what is established in said agreements and treaties will be considered as part of the minimum rights enjoyed by the workers of the Republic of Guatemala. (Art. 102) - SpanishSon derechos sociales mínimos que fundamentan la legislación del trabajo y la actividad de los tribunales y autoridades:

t. El Estado participará en convenios y tratados internacionales o regionales que se refieran a asuntos de trabajo y que concedan a los trabajadores mejores protecciones o condiciones.
En tales casos, lo establecido en dichos convenios y tratados se considerará como parte de los derechos mínimos de que gozan los trabajadores de la República de Guatemala. (Art. 102)
Status of International Law
- EnglishIn all their decisions or sentences, the tribunals of justice will obligatorily observe the principle that the Constitution of the Republic prevails over any law or treaty. (Art. 204)
