Obligations of the State
- EnglishThe declarations, rights and guarantees enumerated in this Constitution shall not be construed as a denial of other declarations, rights and guarantees not specified that spring from the national sovereignty, from the democratic and representative form of government, and from the dignity of man. (Art. 63)
- SpanishLas declaraciones, derechos y garantías que enumera esta Constitución, no serán entendidos como negación de otras declaraciones, derechos y garantías no especificadas, que nacen de la soberanía, de la forma republicana, democrática y representativa de gobierno y de la dignidad del hombre. Obligations of the State
- EnglishLaws and governmental provisions or any other provisions that regulate the exercise of declarations, rights and guarantees recognized by this Constitution shall not be enforced if they diminish, restrict, or evade such rights and guarantees. (Art. 64)
- SpanishNo se aplicarán leyes y disposiciones gubernativas o de cualquier otro orden, que regulen el ejercicio de las declaraciones, derechos y garantías establecidos en esta Constitución, si los disminuyen, restringen o tergiversan. (Art. 64)
Obligations of Private Parties
- EnglishThe rights of every man are limited by the rights of all others, by collective security, and by the just demands of the general welfare and democratic development. (Art. 62)

Judicial Protection
- EnglishThe state recognizes the guarantee of amparo.
Consequently, any aggrieved person, or any other in his name, has the right to interpose the recourse of amparo:
1) so that the enjoyment and benefit [goce y disfrute] of the rights and guarantees that the Constitution, the treaties, conventions and other international instruments establish[,] are maintained or restituted; and
2) so that in specific [concretos] cases that a regulation, act [hecho], act [acto] or resolution of authority is declared to not obligate the petitioner [recurrente] or is not applicable to contravene, diminish or distort any of the rights recognized by this Constitution.
When the action of amparo is interposed before a non-competent Jurisdictional Organ, the written original must be remitted to the competent Jurisdictional Organ.
The recourse of amparo must be interposed in conformity with the law. (Art. 183) - SpanishEl Estado reconoce la garantía de amparo.
En consecuencia toda persona agraviada o cualquiera en nombre de ésta, tiene derecho a interponer recurso de amparo:
1) Para que se le mantenga o restituya en el goce y disfrute de los derechos o garantías que la Constitución, los tratados, convenciones y otros instrumentos internacionales establecen; y,
2) Para que se declare en casos concretos que un reglamento, hecho, acto o resolución de autoridad, no obliga, al recurrente ni es aplicable por contravenir, disminuir o tergiversar cualesquiera de los derechos reconocidos por esta Constitución.
Cuando la acción de amparo se interrumpiese ante un órgano Jurisdiccional incompetente éste debe remitir el escrito original al órgano Jurisdiccional competente.
El recurso de Amparo se debe interponer de conformidad con la Ley. (Art. 183)

Judicial Protection
- EnglishThe action to prosecute violators of the rights or guarantees established in this Constitution may be instituted by any person without bond or any formality and by simple denunciation. (Art. 326)
- SpanishEs pública la acción para perseguir a los infractores de los derechos y garantías establecidas en esta Constitución, y se ejercitara sin caución ni formalidad alguna y por simple denuncia. (Art. 326)
National Human Rights Bodies
- EnglishThe human person is the supreme end [fin] of society and of the State. All have the obligation to respect it and protect it.
The dignity of the human being is inviolable.
To guarantee the rights and freedoms recognized in this Constitution, the Institution of the National Commissioner of Human Rights is created.
The organization, prerogatives and attributions of the National Commissioner of Human Rights will be the object of a special law. (Art. 59) - SpanishLa persona humana es el fin supremo de la Sociedad y del Estado. Todos tienen la obligación de respetarla y protegerla. La dignidad del ser humano es inviolable. Para garantizar los derechos y libertades reconocidos en esta Constitución, créase la institución del Comisionado Nacional de los Derechos Humanos. La organización, prerrogativas y atribuciones del Comisionado Nacional de los Derechos Humanos será objeto de una Ley Especial. (Art. 59)
