Status of the Constitution
- EnglishIn the United Mexican States all persons will enjoy the human rights recognized in this Constitution and in the treaties to which the Mexican State is a party, as well as the guarantees for their protection, of which [the] exercise may not be restricted or suspended, except in the cases and under the conditions that this Constitution establishes.
The norms concerning human rights will be interpreted in accordance with this Constitution and with the international treaties of the matter[,] favoring at all times to persons the greatest possible [más amplia] protection.
… (Art. 1) - SpanishEn los Estados Unidos Mexicanos todas las personas gozarán de los derechos humanos reconocidos en esta Constitución y en los tratados internacionales de los que el Estado Mexicano sea parte, así como de las garantías para su protección, cuyo ejercicio no podrá restringirse ni suspenderse, salvo en los casos y bajo las condiciones que esta Constitución establece.
Las normas relativas a los derechos humanos se interpretarán de conformidad con esta Constitución y con los tratados internacionales de la materia favoreciendo en todo tiempo a las personas la protección más amplia.

Communities composed of an indigenous people, [are] those that form a social, economic and cultural unity, living in a territory and that recognized their own authorities in accordance with their habits [usos] and customs.

A. This Constitution recognizes and guarantees the right of indigenous peoples and communities to self-determination and, consequently, to the autonomy to:

II. Apply their own normative systems in the regulation and solution of their internal conflicts, subject to the general principles of this Constitution, respecting individual guarantees, human rights and, in relevant manner, the dignity and integrity of women. The law will establish the cases and procedures of validation by the corresponding judges or courts.

VIII. Accede fully to jurisdictions of the State. To guarantee this right, in all the trials and proceedings in which they are parties, individually or collectively, their cultural customs and specifications must be taken into account respecting the precepts of this Constitution.

Son comunidades integrantes de un pueblo indígena, aquellas que formen una unidad social, económica y cultural, asentadas en un territorio y que reconocen autoridades propias de acuerdo con sus usos y costumbres.

Aplicar sus propios sistemas normativos en la regulación y solución de sus conflictos internos, sujetándose a los principios generales de esta Constitución, respetando las garantías individuales, los derechos humanos y, de manera relevante, la dignidad e integridad de las mujeres. La ley establecerá los casos y procedimientos de validación por los jueces o tribunales correspondientes.

VIII. Acceder plenamente a la jurisdicción del Estado. Para garantizar ese derecho, en todos los juicios y procedimientos en que sean parte, individual o colectivamente, se deberán tomar en cuenta sus costumbres y especificidades culturales respetando los preceptos de esta Constitución.

- EnglishThe Tribunals of the Federation will resolve any dispute that arises[:]
I. From general norms, acts or omissions of the authority that violates the human rights and the guarantees granted for their protection by this Constitution, as well as from the international treaties to which the Mexican State is party;

- EnglishThe Supreme Court of Justice of the Nation will take cognizance of, in the terms that the regulatory law specifies, the following matters:
…
II. Of the actions of unconstitutionality that have for their object to establish [plantear] the possible contradiction between a norm of general character and this Constitution.
The actions of unconstitutionality can be exercised, during the thirty natural days following the date of publication of the norm, by:
…
g) The National Commission of Human Rights, against laws of federal character or of the federative entities, as well as international treaties celebrated by the Federal Executive and approved by the Senate of the Republic, that make vulnerable the human rights consecrated in this Constitution and in the international treaties to which Mexico is party. Also the equivalent organs [organismos] of protection of human rights in the federative entities, against laws enacted by the Legislatures.
h) The guarantor organ [organismo] that Article 6 of this Constitution establishes against laws of federal and local character, as well as [against] international treaties celebrated by the Federal Executive and approved by the Senate of the Republic, which infringe [vulneren] the right of the access to public information and the protection of personal data. In the same way, the equivalent guarantor organs [organismos] in the federative entities, against laws enacted [expedidas] by the local Legislatures; and
… (Art. 105) - SpanishLa Suprema Corte de Justicia de la Nación conocerá, en los términos que señale la ley reglamentaria, de los asuntos siguientes:

II. De las acciones de inconstitucionalidad que tengan por objeto plantear la posible contradicción entre una norma de carácter general y esta Constitución.
Las acciones de inconstitucionalidad podrán ejercitarse, dentro de los treinta días naturales siguientes a la fecha de publicación de la norma, por:
…
g) La Comisión Nacional de los Derechos Humanos, en contra de leyes de carácter federal o de las entidades federativas, así como de tratados internacionales celebrados por el Ejecutivo Federal y aprobados por el Senado de la República, que vulneren los derechos humanos consagrados en esta Constitución y en los tratados internacionales de los que México sea parte. Asimismo, los organismos de protección de los derechos humanos equivalentes en las entidades federativas, en contra de leyes expedidas por las Legislaturas;
h) El organismo garante que establece el artículo 6° de esta Constitución en contra de leyes de carácter federal y local, así como de tratados internacionales celebrados por el Ejecutivo Federal y aprobados por el Senado de la República, que vulneren el derecho al acceso a la información pública y la protección de datos personales. Asimismo, los organismos garantes equivalentes en las entidades federativas, en contra de leyes expedidas por las Legislaturas locales; e

Status of the Constitution
- EnglishThis Constitution, the laws of the Congress of the Union that emanate from it, and all the Treaties that are in accord with them, celebrated and that are celebrated by the President of the Republic, with the approval of the Senate, will be the Supreme Law of all of the Union. The judges of each federative entity will be bound to the said Constitution, laws, and treaties, regardless of provisions to the contrary that may be [haber] in the Constitutions or laws of the federative entities. (Art. 133)
- SpanishEsta Constitución, las leyes del Congreso de la Unión que emanen de ella y todos los tratados que estén de acuerdo con la misma, celebrados y que se celebren por el Presidente de la República, con aprobación del Senado, serán la Ley Suprema de toda la Unión. Los jueces de cada entidad federativa se arreglarán a dicha Constitución, leyes y tratados, a pesar de las disposiciones en contrario que pueda haber en las Constituciones o leyes de las entidades federativas. (Art. 133)
Status of the Constitution
- EnglishThe Constitution will not lose its force and effect, even when its observance is interrupted by any rebellion. In case that by any public disorder [tastorno], a government contrary to the principles that it sanctions is established, as soon as the people recover their liberty, its observance will be reestablished, and in accordance with it and the laws that have been adopted [expedido] by virtue of it, those who have figured in the government emanating from the rebellion, as well as those who have cooperated with it, will be tried [juzgados]. (Art. 136)
- SpanishEsta Constitución no perderá su fuerza y vigor, aun cuando por alguna rebelión se interrumpa su observancia. En caso de que por cualquier trastorno público, se establezca un gobierno contrario a los principios que ella sanciona, tan luego como el pueblo recobre su libertad, se restablecerá su observancia, y con arreglo a ella y a las leyes que en su virtud se hubieren expedido, serán juzgados, así los que hubieren figurado en el gobierno emanado de la rebelión, como los que hubieren cooperado a ésta. (Art. 136)
