Obligations of the State

    (a) This Constitution guarantees to all persons, in a manner that is not contrary to any tenet of Islam, the rights and freedoms contained within this Chapter4 subject only to such reasonable limits prescribed by a law enacted by the People’s Majlis in a manner that is not contrary to this Constitution. Any such law enacted by the People’s Majlis can limit the rights and freedoms to any extent only if demonstrably justified in a free and democratic society.

    (ހ) މި ބާބުގައި ބަޔާންކޮށްފައިވާ އެންމެހައި ޙައްޤުތަކާއި މިނިވަންކަން އިސްލާމްދީނުގެ އަސްލަކާ ހިލާފި ނުވާނޭ ގޮތުގެމަތީން ކޮންމެ މީހަކަށްމެ ލިބިގެންވާކަން މި ޤާނޫނުއަސާސީ ކަށަވަރުކޮށްދެއެވެ. އަދި މިއިން އެއްވެސް ޙައްޤެއްގެ ނުވަތަ މިނިވަންކަމެއްގެ އެއްވެސް މިންވަރެއް ހިފެހެއްޓޭނީ މި ޤާނުނު އަސާސީއާ ތަޢާތުޟްނުވާ ގޮތެއްގެ މަތީން، ރައްޔިތުންގެ މަޖިލީހުން ފާސްކުރާ ޤާނޫނަކުންނެވެ. ރައްޔިތުންގެ މަޖިލީހުން ފާސްކުރާ ޤާނޫނަކުން ވެސް އެއިން ޙައްޤެއްގެ ނުވަތަ މިނިވަންކަމެއްގެ އެއްވެސްމިންވަރެއް ހިފެހެއްޓޭނީ، މިނިވަން، ދީމިޤްރާތީ މުޖްތަމަޢެއްގައި މިފަދަ ޙައްޤެއް ނުވަތަ މިނިވަންކަމެއް ހިފެހެއްޓިދާނެކަމަށް ޤަބޫލުކުރެވޭ މިންވަރަކަށެވެ.

    It is the duty of the State to follow the provisions of this Constitution, and to protect and promote the rights and freedoms provided in this Chapter. (Art. 18)

    (a) The enumeration of rights and freedoms in this Chapter are guaranteed equally to female and male persons.
    (b) The enumeration of rights and freedoms individually in this Chapter shall not be construed to deny or negate other rights retained by the people which are not specified in this Chapter. (Art. 62)

    Any law or part of any law contrary to the fundamental rights or freedoms guaranteed by this Chapter shall be void or void to the extent of such inconsistency. (Art. 63)

    No provision of the Constitution shall be interpreted or translated in a manner that would grant to the State or any group or person the right to engage in any activity or perform any act aimed at the destruction of the rights and freedoms set out in this Constitution. (Art. 69)

Judicial Protection

    (c) In deciding whether a right or freedom in this Chapter, has been limited in accordance with article (a) and (b), a court must be fully cognisant of and make reference to all the facts, including:
    1. the nature and character of the right or freedom;
    2. the purpose and importance of limiting the right or freedom;
    3. the extent and manner of limiting the right or freedom;
    4. the relationship between the limitation of the right or freedom and the importance of the right or freedom;
    5. the extent to which the objective for which the right or freedom has been limited could have been achieved by limiting the right or freedom to a lesser degree;
    6. the extent to which the right or freedom must be limited in order to protect the tenets of Islam, where the right or freedom has been limited pursuant to article (b).

    (ނ) މި ބާބުގައި ބަޔާންކޮށްފައިވާ ޙައްޤެއްގެ ނުވަތަ މިނިވަންކަމެއްގެ އެއްވެސް މިންވަރެއް ހިފަހައްޓައިފައިވަނީ މި މާއްދާގެ (ހ) އާއި (ށ) ގައިވާ ގޮތުގެ މަތީންތޯ ކަނޑައެޅުމުގައި ކޯޓުން އެ ކަމަކާ ގުޅޭ ހުރިހައި ކަންތައްތަކަށް ފުރިހަމައަށް ރިޢާޔަތްކުރާން ވާނެއެވެ. މީގެތެރޭގައި އަންނަނިވި ކަންތައް ހިމެނެއެވެ.
    1. އެ ޙައްޤެއް ނުވަތަ އެ މިނިވަންކަމެއްގެ ޒާތާއި ބާވަތް.
    2. އެ ޙައްޤެއް ނުވަތަ އެ މިނިވަންކަމެއް ހިފެހެއްޓުމުގެ ބޭނުމާއި، މުހިންމުކަން.
     3. އެ ޙައްޤެއް ނުވަތަ އެމިނިވަންކަމަމެއް ހިފެހައްޓައިފައިވާ ގޮތާއި މިންވަރު.
     4. އެ ޙައްޤެއް ނުވަތަ އެ މިނިވަންކަމެއް ހިފެހެއްޓި ހިފެހެއްޓުމާ އެ ޙައްޤެއް ނުވަތަ އެ މިނިވަންކަމެއްގެ މުހިންމުކަމާ ހުރި ގުޅުން.
     5. އެ ޙައްޤެއް ނުވަތަ އެ މިނިވަންކަމެއް ހިފަހައްޓައިފައިވާ މިންވަތައްވުރެ ކުޑަކޮށް ހިފަހައްޓައިގެން ބޭނުންވާ މަޤްސަދު ޙާޞިލްކުރެވިދާނެތޯ.
     6. އެ ޙައްޤެއް ނުވަތަ އެ މިނިވަންކަމެއް ހިފަހައްޓައިފައިވަނީ މި މާއްދާގެ (ށ) ގެ ދަށުން ނަމަ، އިސްލާމްދީނުގެ އަސްލުތައް ރައްކާތެރިކުރުމަށްޓަކައި އެ ހައްޤެއް ނުވަތަ އެމިނިވަންކަމެއް ކޮންމެހެން ހިފަހައްޓާންޖެހޭތޯ.

Judicial Protection

    Anyone whose rights or freedoms, as guaranteed by this Chapter, have been infringed or denied may apply to a court to obtain a just remedy. (Art. 65)

    މި ބާބުގައި ބަޔާންކޮށްފައިވާ އެއްވެސް ޙައްޤެއް ނުވަތަ މިނިވަންކަމެއް އެއްވެސް މީހެއްގެ ކިބައިން ނިގުޅައިގެންފިނަމަ، ނުވަތަ ހިފަހައްޓައިފިނަމަ، އިންސާފްވެރި ޙައްލެއް ހޯދުމަށްޓަކައި އެ މައްސަލަ ކޯޓަށް ހުށަހެޅުމުގެ ޙައްޤު އެ މީހަކަށް ލިބިގެވެއެވެ. (ޤާނޫނުއަސާސީގެ 65 ވަނަ މާއްދާ)
Judicial Protection

    When interpreting and applying the rights and freedoms contained within this Chapter, a court or tribunal shall promote the values that underlie an open and democratic society based on human dignity, equality and freedom, and shall consider international treaties to which the Maldives is a party. (Art. 68)

    ކޯޓުތަކުންނާއި ޓްރައިބިއުނަލްތަކުން މި ބާބުގައި ބަޔާންކޮށްފައިވާ ޙައްޤުތަކާއިމިނިވަންކަން މާނަކުރުމުގައްޔާއި ލިބިދިނުމުގައި، އިންސާނީ ޝަރަފާއި ހަމަހަމަކަމާއި މިނިވަންކަމަށް ބިނާކޮށް އުފެދިފައިވާ، ހުޅުވިގެންވާ ދީމިޤްތާތީ މިޖްތަމަޢުތަކުން ޤަބޫލުކުރާ އުސޫލުތަކަށް ރިޢާޔަތްކޮށް އެ އުސޫލުތައް ނަގަހައްޓަންވާނެއެވެ. އަދި ދިވެހިރާއްގެ ބައިވެރިވެފައިވާ ބައިނަލްއަޤްވާމީ މުއާހަދާތަކަށް ރިޢާޔަތްކުރާންވާނެއެވެ. National Human Rights Bodies

    (a) There shall be a Human Rights Commission of the Maldives.
    (b) The Human Rights Commission is an independent and impartial institution. It shall promote respect for human rights impartially without favour and prejudice.
    (c) The Human Rights Commission shall function as provided by the statute governing the Human Rights Commission. Such statute shall specify the responsibilities, powers, mandate, qualifications, and ethical standards of members. (Art. 189)

    (ހ) ދިވެހިރާއްޖޭގައި ހިއުމަން ރައިޓްސް ކޮމިޝަނެއް އޮންނާންވާނެއެވެ.
    (ށ) ހިއުމަން ރައިޓްސް ކޮމިޝަނަކީ ވަކިފަރާތަކަށް ބުރަނުވާ، މުސްތަޤިއްލު މުއައްސަސާއެކެވެ. އަދި އެ ކޮމިޝަނުން އިންސާނީ ޙައްޤުތައް ކުރިއެރުވުމުގައި މަސައްކަތް ކުރާންވާނީ އެއްވެސް ފަރާތަކަށް ބުރަވުމެއްނެތި، ތަޢައްސުބުން އެއްކިބާވެ ތިބެގެންނެވެ.
    (ނ) ހިއުމަން ރައިޓްސް ކޮމިޝަން ހިންގާނީ ހިއުމަން ރައިޓްސް ކޮމިޝަންގެ ޤާނޫނުގައި ބާޔާންގެންވާ ގޮތުގެމަތިންނެވެ. އެ ޤާނޫނުގައި، އެ ކޮމިޝަނުގެ މަސްއޫލިޔަތުތަކާއި، ބާރުތަކާއި، އެ ކޮމިޝަނުގެ މަސައްކަތުގެ ދާއިރާއާއި، އެކޮމިޝަނުގެ މެންބަރުންގެ ކިބައިގައި ހުންނަންވާނޭ ޝަރުތުތަކާއި، ސުލޫކީ މިންގަޑުތައް ކަނޑައަޅައިފައި އޮންނަންވާނެއެވެ. National Human Rights Bodies
  • English
    (a) The Human Rights Commission’s responsibilities and powers shall include the following:
    1. to promote respect for human rights;
    2. to promote the protection, development and attainment of human rights;
    3. to monitor and assess the observance of human rights.
    (b)The Human Rights Commission shall have the following functions and powers, as regulated by law:
    1. to investigate and to report on the observance of human rights;
    2. to take steps to secure appropriate redress where human rights have been violated;
    3. to carry out research, and to educate the public;
    4. to exercise such additional powers and functions prescribed by law. (Art. 192)

    (ހ) ހިއުމަން ރައިޓްސް ކޮމިޝަނުގެ މަސްއޫލިއްޔަތުތަކާއި ބާރުތަކުގެ ތެރޭގައި އަންނަނިވި ކަންކަން ހިމެނެއެވެ.
     1. އިންސާނީ ޙައްޤުތަކަށް މީހުންގެ ހިތްތަކުގައި އިޙްތިރާމް އަށަގެންނެވުމަށް މަސައްކަތްކުރުން.
    2. އިންސާނީ ޙައްޤުތައް ރައްކާރެއިކުރުމާއި، ކުރިއެރުވުމަށާއި، އެ ޙާއްޤުތައް ހޯދައިދިނުމަށް މަސައްކަތްކުރުން.
    3. އިންސާނީ ޙައްޤުތަކަށް ޙުރުމަތްތެރިކޮށް ހިތާމިންވަރު ބަލައި ވަޒަންކުރުން.
    (ށ) ހިއުމަން ރައިޓްސް ކޮމިޝަނުގެ މަސްއޫލިއްޔަތުތައް އަދާކުރުމަށްޓަކައި، ޤާނޫނެއް ކަނޑައަޅާ ބާރުތަކެއް އެ ކޮމިޝަނަށް ލިބިގެންވެއެވެ. އޭގެ ތެރޭގައި އަންނަނިވި ކަންތައްތައް ހިމެނެއެވެ.
    1. އިންސާނީ ޙައްޤުތަކަށް ޙުރުމަތްރެއިކޮށް ހިތާމިންވަރު ތަޙުޤީޤުކޮށް އަންގާންޖެހޭ ފަރާތްތަކށް އެންގުން.
    2. އިންސާނީ ޙައްގެއް ނިގުޅައިގެންފިނަމަ، ޤާނޫނުގައިވާ ގޮތުގެމަތީން އަޅަންޖެހޭ ފިޔަވަޅުތައް އެޅުން.
    3.އިންސާނީ ޙައްޤުތަކާ ގުޅޭ އެކިއެކި ދިރާސާތައްކުރުމާއި އެޙައްގުތަކާ ބެހޭ ގޮތުން ޢާންމު ހޭލުންތެރިކަން އިތުރު ކުރުވުން.
    4. ހިއުމަން ރައިޓްސް ކޮމިޝަނަށް ޤާނޫނުން ލިބިދޭ އިތުރު ބާރުތަކާއި ހަވާލުކުރެވޭ އިތުރު މަސްއޫލިއްޔަތުތައް. (ޤާނޫނުއަސާސީގެ 192 ވަނަ މާއްދާ)
