Obligations of the State

    (a) This Constitution guarantees to all persons, in a manner that is not contrary to any tenet of Islam, the rights and freedoms contained within this Chapter4 subject only to such reasonable limits prescribed by a law enacted by the People’s Majlis in a manner that is not contrary to this Constitution. Any such law enacted by the People’s Majlis can limit the rights and freedoms to any extent only if demonstrably justified in a free and democratic society.

    (ހ) މި ބާބުގައި ބަޔާންކޮށްފައިވާ އެންމެހައި ޙައްޤުތަކާއި މިނިވަންކަން އިސްލާމްދީނުގެ އަސްލަކާ ހިލާފި ނުވާނޭ ގޮތުގެމަތީން ކޮންމެ މީހަކަށްމެ ލިބިގެންވާކަން މި ޤާނޫނުއަސާސީ ކަށަވަރުކޮށްދެއެވެ. އަދި މިއިން އެއްވެސް ޙައްޤެއްގެ ނުވަތަ މިނިވަންކަމެއްގެ އެއްވެސް މިންވަރެއް ހިފެހެއްޓޭނީ މި ޤާނުނު އަސާސީއާ ތަޢާތުޟްނުވާ ގޮތެއްގެ މަތީން، ރައްޔިތުންގެ މަޖިލީހުން ފާސްކުރާ ޤާނޫނަކުންނެވެ. ރައްޔިތުންގެ މަޖިލީހުން ފާސްކުރާ ޤާނޫނަކުން ވެސް އެއިން ޙައްޤެއްގެ ނުވަތަ މިނިވަންކަމެއްގެ އެއްވެސްމިންވަރެއް ހިފެހެއްޓޭނީ، މިނިވަން، ދީމިޤްރާތީ މުޖްތަމަޢެއްގައި މިފަދަ ޙައްޤެއް ނުވަތަ މިނިވަންކަމެއް ހިފެހެއްޓިދާނެކަމަށް ޤަބޫލުކުރެވޭ މިންވަރަކަށެވެ.

    It is the duty of the State to follow the provisions of this Constitution, and to protect and promote the rights and freedoms provided in this Chapter. (Art. 18)

    މިޤާނޫނުއަސާސީއާ އެއްގޮތަށް އަމަލުކުރުމާއި، މި ބާބުގައި ބަޔާންވެގެންވާ ޙައްޤުތަކާއި މިނިވަންކަން ޙިމާޔަތްކޮށް، ކުރިއެރުވުމަކީ ދައުލަތުގެ ވާޖިބެކެވެ. (ޤާނޫނުއަސާސީގެ 18 ވަނަ މާއްދާ)

    (a) The enumeration of rights and freedoms in this Chapter are guaranteed equally to female and male persons.
    (b) The enumeration of rights and freedoms individually in this Chapter shall not be construed to deny or negate other rights retained by the people which are not specified in this Chapter. (Art. 62)

    (ހ) މި ބާބުގައި ބަޔާންކުރެވިފައިވާ އެންމެހާ ޙައްޤުތަކާއި މިނިވަންކަން އަންހެނުންނަށާއި ފިރިހެނުންނަށް ހަމަހަމަކަމާއެކު ލިބިގެންވެއެވެ.
    (ށ) މި ބާބުގައި ވަކިވަކީން ޙައްޤުތަކާއި މިނިވަންކަން ކަނޑައެޅި، ބަޔާންކުރެވިފައިވުމަކީ މި ބާބުގައި ނުހިމެނޭ އެހެނިހެން ޙައްޤުތަކާއި މިނިވަންކަން ހޯދުމަށް ނުވަތަ ލިބިގަތުމަށް ހުރަސްއަޅާ ކަމެއް ނޫނެވެ . (ޤާނޫނުއަސާސީގެ 62 ވަނަ މާއްދާ)

    Any law or part of any law contrary to the fundamental rights or freedoms guaranteed by this Chapter shall be void or void to the extent of such inconsistency. (Art. 63)

    އެއްވެސް ޤާނޫނެއް ނުވަތް ޤާނޫނަކުން ބައެއް ވިޔަސް މި ބާބުގައި ބަޔާންވެގެންވާ އަސާސީ ހައްޤަކާ ނުވަތަ މިނިވަންކަމަކާ ތަޢާރުޟްވާ ނަމަ، އެޤާނޫނެއް ނުވަތަ އެ ޤާނޫނަކުން އެ ޙައްޤަކާ ނުވަތަ އެ މިނިވަންކަމަކާ ތަޢާރުޟްވާ މިންވަރެއް ވާނީ ބާތިލް އެއްޗަކަށެވެ. (ޤާނޫނުއަސާސީގެ 63 ވަނަ މާއްދާ)

    No provision of the Constitution shall be interpreted or translated in a manner that would grant to the State or any group or person the right to engage in any activity or perform any act aimed at the destruction of the rights and freedoms set out in this Constitution. (Art. 69)

    މި ޤާނޫނުއަސާސީގައި ބަޔާންކޮށްފައިވާ އެއްވެސް ޙައްޤަކަށް ނުވަތަ މިނިވަންކަމަކަށް އުނިކަމެއް ލިބޭނޭފަދަ ޢަމަލެއް ކުރުމުގެ، ނުވަތަ އެފަދަ ޢަމަލެއްގައި ބައިވެރިވުމުގެ ޙައްޤު އެއްވެސް މީހަކަށް ނުވަތަ ޖަމާޢަތަކަށް ނުވަތަ ދައުލަތަށް ލިބޭނޭފަދަ ގޮތަކަށް މި ޤާނޫނުއަސާސީގައި ހިމެނޭ އެއްވެސް މާއްދާއެއް މާނަކޮށް ނުވަތަ ތަރުޖަމާކޮށްގެނެއް ނުވާނެއެވެ.
