Constitution of the Republic of the Union of Myanmar 2008, as amended to 2020
Head of State
- EnglishThe Head of the Union and the Head of Executive of the Union is the President. (Sec. 16)
- Burmeseနိုင်ငံတော်အကြီးအကဲ နှင့် နိုင်ငံတော်အုပ်ချုပ်ရေးအကြီးအကဲသည် နိုင်ငံတော် သမ္မတဖြစ်သည်။ (ပုဒ်မ-၁၆)
Head of State
- EnglishQualifications of the President and Vice-Presidents are as follows :
(a) shall be loyal to the Union and its citizens;
(b) shall be a citizen of Myanmar who was born of both parents who were born in the territory under the jurisdiction of the Union and being Myanmar Nationals;
(c) shall be an elected person who has attained at least the age of 45;
(d) shall be well acquainted with the affairs of the Union such as political, administrative, economic and military;
(e) shall be a person who has resided continuously in the Union for at least 20 years up to the time of his election as President;
Proviso: An official period of stay in a foreign country with the permission of the Union shall be counted as a residing period in the Union;
(f) shall he himself, one of the parents, the spouse, one of the legitimate children or their spouses not owe allegiance to a foreign power, not be subject of a foreign power or citizen of a foreign country. They shall not be persons entitled to enjoy the rights and privileges of a subject of a foreign government or citizen of a foreign country;
(g) shall possess prescribed qualifications of the President, in addition to qualifications prescribed to stand for election to the Hluttaw. (Sec. 59) - Burmeseနိုင်ငံတော်သမ္မတ နှင့် ဒုတိယသမ္မတများ၏ အရည်အချင်းများမှာ အောက်ပါအတိုင်း ဖြစ်သည် -
(က) နိုင်ငံတော်နှင့် နိုင်ငံသားများအပေါ် သစ္စာရှိသူဖြစ်ရမည်၊
(ခ) မိမိနှင့် မိမိ၏မိဘနှစ်ပါးလုံး နိုင်ငံတော်၏အာဏာ ပိုင်နက်အတွင်း၌ မွေးဖွားသော တိုင်းရင်းသားမှ ဖြစ်သည့် မြန်မာနိုင်ငံသား ဖြစ်ရမည်၊
(ဂ) ရွေးချယ်တင်မြှောက်ခြင်းခံရသူသည် အနည်းဆုံး အသက်(၄၅) နှစ်ပြည့်ပြီးသူ ဖြစ်ရမည်၊
(ဃ) နိုင်ငံတော်အရေးအရာများဖြစ်သော နိုင်ငံရေး၊ အုပ်ချုပ်ရေး၊ စီးပွားရေး၊ စစ်ရေး စသည့် အမြင်များရှိရမည်၊
(င) သမ္မတအဖြစ် ရွေးချယ်တင်မြှောက်ခံရသည့် အချိန်နှင့်တစ်ဆက်တည်း အနည်းဆုံး အနှစ်(၂၀) နိုင်ငံတော်တွင် အခြေချနေထိုင်ခဲ့သူဖြစ်ရမည်၊
ခြွင်းချက်။ နိုင်ငံတော်၏ခွင့်ပြုချက်ဖြင့် နိုင်ငံခြားသို့တရားဝင်သွားရောက်သည့် ကာလ များကိုလည်း နိုင်ငံတော်တွင် အခြေချနေထိုင်ခဲ့သည့် ကာလအဖြစ် ထည့်သွင်းရေတွက် ရမည်။
(စ) မိမိကိုယ်တိုင်သော်လည်းကောင်း၊ မိမိ၏မိဘတစ်ပါးပါးသော်လည်းကောင်း၊ မိမိ၏ ဇနီး သို့မဟုတ် ခင်ပွန်းသော်လည်းကောင်း၊ မိမိ၏တရားဝင် သားသမီးတစ်ဦးဦးသော် လည်းကောင်း၊ ထိုတရားဝင်သားသမီးတစ်ဦးဦး၏ ဇနီး သို့မဟုတ် ခင်ပွန်းသော်လည်းကောင်း၊ နိုင်ငံခြားအစိုးရ၏ ကျေးဇူးသစ္စာတော်ကို ခံယူစောင့်ရှောက်ရိုသေသူ သို့မဟုတ် နိုင်ငံ ခြားအစိုးရ၏ လက်အောက်ခံဖြစ်သူ သို့မဟုတ် တိုင်းတစ်ပါး၏ နိုင်ငံသားဖြစ်သူများ မဖြစ်စေရ၊ ထိုသူများသည် နိုင်ငံခြားအစိုးရ၏ လက်အောက်ခံဖြစ်သူသော်လည်းကောင်း၊ တိုင်းတပါး၏ နိုင်ငံသားသော်လည်းကောင်း၊ ခံစားရသောအခွင့်အရေးများ နှင့် ကျေးဇူးခံ စားခွင့်များကို ခံစားနိုင်ခွင့်ရှိသူများ မဖြစ်စေရ၊
(ဆ) လွှတ်တော်ရွေးကောက်ပွဲ၌ ရွေးကောက်ခံပိုင်ခွင့်အတွက် သတ်မှတ်ထားသည့် အရည်အချင်းများအပြင် နိုင်ငံတော်သမ္မတအတွက် သီးခြားသတ်မှတ်ထားသော အရည် အချင်းများနှင့်လည်း ပြည့်စုံရမည်။ (ပုဒ်မ-၅၉)
Head of State
- English(a) The President shall be elected by the Presidential Electoral College.
(b) The Presidential Electoral College shall be formed with three groups of the Pyidaungsu Hluttaw representatives as follows :
(i) group formed with elected Hluttaw representatives in the Hluttaw with an equal number of representatives elected from Regions and States;
(ii) group formed with elected Hluttaw representatives in the Hluttaw elected on the basis of township and population;
(iii) group formed with the Defence Services personnel Hluttaw representatives nominated by the Commander-in-Chief of the Defence Services for the said two Hluttaws.
(c) Each group shall elect a Vice-President from among the Hluttaw representatives or from among persons who are not Hluttaw representatives.
(d) The Pyidaungsu Hluttaw and a Body comprising the Heads and Deputy Heads of the two Hluttaws in the Pyidaungsu Hluttaw shall scrutinize whether or not the Vice-Presidents possess the qualifications prescribed for the President.
(e) The Presidential Electoral College comprising all the Pyidaungsu Hluttaw representatives shall elect by vote one of the three Vice-Presidents who are Presidential candidates, as the President.
(f) Necessary law shall be enacted for the election of President and Vice Presidents. (Sec. 60) - Burmese(က) နိုင်ငံတော်သမ္မတကို သမ္မတရွေးချယ်တင်မြှောက်ရေးအဖွဲ့ဖြင့် ရွေးချယ် တင်မြှောက်ရမည်၊
(ခ) သမ္မတရွေးချယ်တင်မြှောက်ရေးအဖွဲ့ကို ပြည်ထောင်စုလွှတ်တော်ကိုယ်စားလှယ် အစုအဖွဲ့သုံးဖွဲ့ဖြင့် အောက်ပါအတိုင်း ဖွဲ့စည်းရမည် -
(၁) တိုင်းဒေသကြီးများ နှင့် ပြည်နယ်များမှ ကိုယ်စားလှယ်ဦးရေတူညီစွာ ရွေးကောက် တင်မြှောက်သည့် လွှတ်တော်ရှိ ရွေးကောက်တင်မြှောက်ခြင်းခံရသော လွှတ်တော်ကိုယ် စားလှယ်များ အစုအဖွဲ့၊
(၂) မြို့နယ်ကိုအခြေခံ၍လည်းကောင်း၊ လူဦးရေကိုအခြေခံ၍လည်းကောင်း ရွေးကောက် တင်မြှောက်သည့်လွှတ်တော်ရှိ ရွေးကောက်တင်မြှောက်ခြင်းခံရသည့် လွှတ်တော်ကိုယ် စားလှယ်များ အစုအဖွဲ့၊
(၃) ဖော်ပြပါလွှတ်တော်နှစ်ရပ်အတွက် တပ်မတော်ကာကွယ်ရေးဦးစီးချုပ်က အမည် စာရင်းတင်သွင့်သည့် တပ်မတော်သားလွှတ်တော်ကိုယ်စားလှယ်များအစုအဖွဲ့။
(ဂ) ယင်းအစုအဖွဲ့တစ်ဖွဲ့စီက ဒုတိယသမ္မတတစ်ဦးစီကို လွှတ်တော်ကိုယ်စားလှယ်များ ထဲမှ ဖြစ်စေ၊ လွှတ်တော်ကိုယ်စားလှယ်မဟုတ်သူများထဲမှဖြစ်စေ ရွေးချယ်တင်မြှောက် ရမည်၊
(ဃ) ဒုတိယသမ္မတများသည် နိုင်ငံတော်သမ္မတအတွက်သတ်မှတ်ထားသည့် အရည် အချင်းများနှင့် ပြည့်စုံခြင်း ရှိ၊ မရှိကို ပြည်ထောင်စုလွှတ်တော်နှင့် ပြည်ထောင်စုလွှတ်တွင် ပါဝင်သော လွှတ်တော်နှစ်ရပ်၏ အကြီးအမှူးများနှင့် ဒုတိယအကြီးအမှူးများ ပါဝင်သည့် အဖွဲ့က စိစစ်ရမည်၊
(င) ပြည်ထောင်စုလွှတ်တော်ကိုယ်စားလှယ်အားလုံးပါဝင်သော သမ္မတရွေးချယ် တင်မြှောက်ရေးအဖွဲ့က နိုင်ငံတော်သမ္မတလောင်းများဖြစ်သည့် ဒုတိယသမ္မတသုံးဦး အနက် မိမိတို့ကြိုက်နှစ်သက်သည့် ဒုတိယသမ္မတတစ်ဦးကို နိုင်ငံတော်သမ္မတအဖြစ် ဆန္ဒမဲပေး ရွေးချယ်တင်မြှောက်ရမည်၊
(စ) ထိုသို့ နိုင်ငံတော်သမ္မတနှင့် ဒုတိယသမ္မတများရွေးချယ်တင်မြှောက်နိုင်ရန် လိုအပ် သည့် ဥပဒေကို ပြဌာန်းပေးရမည်။ (ပုဒ်မ-၆၀)
Vice-President

(ဂ) ယင်းအစုအဖွဲ့တစ်ဖွဲ့စီက ဒုတိယသမ္မတတစ်ဦးစီကို လွှတ်တော်ကိုယ်စားလှယ်များ ထဲမှ ဖြစ်စေ၊ လွှတ်တော်ကိုယ်စားလှယ်မဟုတ်သူများထဲမှဖြစ်စေ ရွေးချယ်တင်မြှောက် ရမည်၊
(ဃ) ဒုတိယသမ္မတများသည် နိုင်ငံတော်သမ္မတအတွက်သတ်မှတ်ထားသည့် အရည် အချင်းများနှင့် ပြည့်စုံခြင်း ရှိ၊ မရှိကို ပြည်ထောင်စုလွှတ်တော်နှင့် ပြည်ထောင်စုလွှတ်တွင် ပါဝင်သော လွှတ်တော်နှစ်ရပ်၏ အကြီးအမှူးများနှင့် ဒုတိယအကြီးအမှူးများ ပါဝင်သည့် အဖွဲ့က စိစစ်ရမည်၊

The President, with the approval of the Pyidaungsu Hluttaw, may :
(a) designate the Ministries of the Union Government as necessary, and may make changes and additions to the ministries;

Government

(a) The President shall appoint the Union Ministers who possess the following qualifications :
(i) person who has attained the age of 40 years;
(ii) person who has qualifications, with the exception of age limit, entitled to be elected as Pyithu Hluttaw representatives prescribed in Section 120;
(iii) person whose qualifications does not breach the provisions under Section 121 which disqualify the person from standing for election as the Pyithu Hluttaw representative;
(iv) person loyal to the Union and its citizens.

(၃) ပုဒ်မ ၁၂၁ တွင် ဖော်ပြထားသည့် ပြည်သူ့လွှတ်တော်ကိုယ်စားလှယ်များအဖြစ် ရွေးကောက်တင်မြှောက်ခံပိုင်ခွင့် မရှိစေသော ပြဌာန်းချက်များနှင့်လည်း ငြိစွန်းခြင်းမရှိသူ၊
(၄) နိုင်ငံတော်နှင့် နိုင်ငံသားများအပေါ် သစ္စာရှိသူ။

Legislature
- English(a) The legislative power of the Union is shared among the Pyidaungsu Hluttaw, Region Hluttaws and State Hluttaws. Legislative power stipulated by this Constitution shall be shared to the Self-Administered Areas.
(b) The Pyidaungsu Hluttaw consisting of two Hluttaws, one Hluttaw elected on the basis of township as well as population, and the other on an equal number of representatives elected from Regions and States. (Sec. 12) - Burmese(က) နိုင်ငံတော်၏ ဥပဒေပြုရေးအာဏာကို ပြည်ထောင်စုလွှတ်တော်၊ တိုင်းဒေသ ကြီးလွှတ်တော် နှင့် ပြည်နယ်လွှတ်တော်များအား ခွဲဝေအပ်နှင်းသည်။ ကိုယ်ပိုင်အုပ်ချုပ်ခွင့်ရ စီရင် စုများအား ဤဖွဲ့စည်းပုံအခြေခံဥပဒေက သတ်မှတ်သော ဥပဒေပြုရေးအာဏာကို ခွဲဝေအပ်နှင်းသည်၊
(ခ) ပြည်ထောင်စုလွှတ်တော်တွင် မြို့နယ်ကိုအခြေခံ၍လည်းကောင်း၊ လူဦးရေကို အခြေခံ၍လည်းကောင်း၊ ရွေးကောက်တင်မြှောက်သည့် လွှတ်တော်တစ်ရပ်၊ တိုင်းဒေသကြီးများ နှင့် ပြည်နယ်များမှ ကိုယ်စားလှယ်ဦးရေတူညီစွာ ရွေးကောက်တင် မြှောက်သည့် လွှတ်တော်တစ်ရပ်ဟူ၍ လွှတ်တော်နှစ်ရပ် ပါရှိသည်။ (ပုဒ်မ-၁၂)
Legislature
- EnglishThe Pyidaungsu Hluttaw comprises of the following two Hluttaws :
(a) in accord with the provisions of Section 109, the Pyithu Hluttaw formed with Hluttaw representatives elected on the basis of township as well as population and Hluttaw representatives being the Defence Services Personnel nominated by the Commander-in-Chief of the Defence Services;
(b) in accord with the provisions of Section 141, the Amyotha Hluttaw formed with Hluttaw representatives elected in equal numbers from Regions and States and Hluttaw representatives being the Defence Services Personnel nominated by the Commander-in-Chief of the Defence Services. (Sec. 74) - Burmeseပြည်ထောင်စုလွှတ်တော်တွင် အောက်ပါလွှတ်တော်နှစ်ရပ်ပါဝင်သည် -
(က) ပုဒ်မ-၁၀၉ ပါ ပြဌာန်းချက်များနှင့်အညီ မြို့နယ်ကို အခြေခံ၍လည်းကောင်း၊ လူဦးရေကို အခြေခံ၍လည်းကောင်း ရွေးကောက်တင်မြှောက်သည့် လွှတ်တော်ကိုယ်စားလှယ် နှင့် တပ်မတော်ကာကွယ်ရေးဦးစီးချုပ်က အမည်စာရင်းတင်သွင်းသော တပ်မတော်သား လွှတ်တော်ကိုယ်စားလှယ်များဖြင့် ဖွဲ့စည်းသည့် ပြည်သူ့လွှတ်တော်၊
(ခ) ပုဒ်မ-၁၄၁ ပါ ပြဌာန်းချက်များနှင့်အညီ တိုင်းဒေသကြီးများနှင့် ပြည်နယ်များမှ ဦးရေတူညီစွာ ရွေးကောက်တင်မြှောက်သည့် လွှတ်တော်ကိုယ်စားလှယ်များနှင့် တပ်မတော် ကာကွယ်ရေးဦးစီးချုပ်က အမည်စာရင်းတင်သွင်းသော တပ်မတော်သား လွှတ်တော် ကိုယ်စားလှယ်များဖြင့် ဖွဲ့စည်းသည့် အမျိုးသားလွှတ်တော်။ (ပုဒ်မ-၇၄)
Legislature
- EnglishPersons who possess the following qualifications shall be entitled to be elected as the Pyithu Hluttaw representatives :
(a) person who has attained the age of 25 years;
(b) citizen who was born of both parents who are citizens;
(c) person who has resided in the Union of Myanmar for at least ten consecutive years up to the time of his election as Pyithu Hluttaw representative;
Proviso: The official period of stay in a foreign country with the permission of the Union shall be counted as a residing period in the Union,
(d) person who possesses qualifications prescribed by the Election Law. (Sec. 120) - Burmeseအောက်ပါအရည်အချင်းများနှင့် ပြည့်စုံသူသည် ပြည်သူ့လွှတ်တော်သို့ လွှတ်တော်ကိုယ်စားလှယ်အဖြစ် ရွေးကောက်တင်မြှောက်ခံပိုင်ခွင့်ရှိသည် -
(က) အသက် ၂၅ နှစ်ပြည့်ပြီးသူ၊
(ခ)နိုင်ငံသားမိဘနှစ်ပါးမှ မွေးဖွားသောနိုင်ငံသားဖြစ်သူ၊
(ဂ) ပြည်သူ့လွှတ်တော် ကိုယ်စားလှယ် အဖြစ်ရွေးကောက်တင်မြောက်ခံရသည့် အချိန်နှင့် တစ်ဆက်တည်း ပြည်ထောင်စုမြန်မာနိုင်ငံတော်တွင် အနည်းဆုံး ၁၀ နှစ် အခြေချနေထိုင်ခဲ့သူ၊
ခြွင်းချက်။ နိုင်ငံတော်၏ခွင့်ပြုချက်ဖြင့် နိုင်ငံခြားသို့တရားဝင်သွားရောက်သည့်ကာလများကိုလည်းနိုင်ငံတော်တွင်အခြေချနေထိုင်ခဲ့သည့် ကာလအဖြစ် ထည့်သွင်းရေတွက်ရမည်။
(ဃ) ရွေးကောက်တင်မြောက်ခြင်း ဆိုင်ရဥပဒေတွင် သတ်မှတ်ထားသည့် အရည်းအချင်းများနှင့်ပြည်စုံသူ။ (ပုဒ်မ-၁၂၀)

(a) persons who have attained the age of 30 years;
(b) persons who have qualifications, with the exception of the age limit, entitled to be elected as Pyithu Hluttaw representatives prescribed under Section 120;
(c) persons whose qualifications does not breach the provisions under Section 121 which disqualified a person from standing for election as the Pyithu Hluttaw representatives. (Sec. 152) - Burmeseအမျိုးသားလွှတ်တော် ကိုယ်စားလှယ်များသည် -
(က) အသက်၃၀နှစ်ပြည့်ပြီးသူများဖြစ်ရမည်၊
(ခ) အသက်ကန့်သတ်ချက်မှအပ ပုဒ်မ၁၂၀ တွင် ဖော်ပြထားသည့် ပြည်သူ့လွှတ်တော်ကိုယ်စားလှယ်များအဖြစ် ရွေးကောက်တင်မြှောက်ခံပိုင်ခွင့်ရှိသော အရည်အချင်းများနှင့် ပြည့်စုံရမည်၊
(ဂ) ပုဒ်မ ၁၂၁တွင် ဖော်ပြထားသည့် ပြည်သူ့လွှတ်တော်ကိုယ်စားလှယ်အဖြစ်ရွေးကောက်တင်မြောက်ခံပိုင်ခွင့် မရှိစေသော ပြဌာန်းချက်များနှင့်လည်းသက်ဆိုင်စေရမည်။ (ပုဒ်မ-၁၅၂)
