- EnglishThe Constitutional Court takes cognizance of the recourses for interpretation of the Constitution on being referred to [the matter] by the President of the Republic, by the Government, by the President of the Senate, by the President of the National Assembly, by one-tenth of the members of each of the parliamentary Chambers, by the provincial Governors and by the Presidents of the Provincial Assemblies.
It resolves disputes concerning the presidential and legislative elections as well [concerning the] referendum.
It takes cognizance of the conflicts of competence between the Executive Power and the Legislative Power as well as between the State and the Provinces.
It takes cognizance of the recourses against the orders rendered by the Court of Cassation and the Council of State, only insofar as it decides on the attribution of the litigation to the jurisdiction of the judicial order or [to the] administrative [order]. This recourse is only receivable if a denial of jurisdiction has been raised by or before the Court of Cassation or the Council of State.
The modalities and the effects of the recourses referred to in the preceding paragraphs are determined by the law. - EnglishThe processes promoted before the Constitutional Court in the matters to which this Article refers will be regulated by the law in conformity with the following provisions:
1. Any citizen can exercise the public recourses [acciones] provided for in the preceding Article and intervene as impugnor or defender of the norms submitted to control in the processes promoted by others, as well as in those cases where no public action exists.
2. The Procurator General of the Nation must intervene in all these processes.

The Supreme Court shall have the following powers:

(2) Review, revise, reverse, modify, or affirm on appeal or certiorari, as the law or the Rules of Court may provide, final judgments and orders of lower courts in:
(a) All cases in which the constitutionality or validity of any treaty, international or executive agreement, law, presidential decree, proclamation, order, instruction, ordinance, or regulation is in question.

(5) Promulgate rules concerning the protection and enforcement of constitutional rights, pleading, practice, and procedure in all courts, the admission to the practice of law, the Integrated Bar, and legal assistance to the underprivileged. – the treaties and international agreements before their entry into force, concerning their conformity with the Constitution, after the adoption by the Parliament of the law of authorization;
– the constitutionality of the organic laws and of the laws before their promulgation, as well as of the ordinances after their publication;
– the regulations of the National Assembly and of the Senate, the regulations of procedure of the Constitutional Court and the regulations of the Economic, Social and environmental Council, before their implementation, concerning their conformity with the Constitution;
– the regulations of the independent administrative authorities determined by the law, before their implementation, concerning their conformity with the Constitution;
– the conflicts of attribution between the institutions of the State;
– the regularity of the presidential [and] parliamentary elections, and of the operations of the referendum of which it proclaims the results.
The Constitutional Court is referred to [the matter] in case of dispute concerning the validity of an election, by any elector, any candidate, any political party or delegate of the Government under the conditions provided for by the organic law on the Constitutional Court. - English1. It is incumbent upon the Supreme Court of Justice, on legal and constitutional matters:
a) To review and declare the unconstitutionality and illegality of normative and legislative acts by the organs of the State;
b) To provide an anticipatory verification of the legality and constitutionality of the statutes and referenda;

b) To certify at last instance the regularity and validity of the acts of the electoral process, in accordance with the respective law;

(1) Except for Part IX Land and Titles Court and the laws administered thereunder, the Supreme Court shall:
(a) have such original, appellate and, revisional jurisdiction; and
(b) possess and exercise all the jurisdiction, power, and authority, which may be necessary to administer the laws of Samoa.
(2) Except for Part IX Land and Titles Court and without prejudice to any appellate or revisional jurisdiction of the Supreme Court, where in any proceedings before another Court (except the Court of Appeal) a question arises as to the interpretation or effect of any provision of this Constitution, the Supreme Court may, on the application of any party to the proceedings, determine that question and either dispose of the case or remit it to that other Court to be disposed of in accordance with the determination.
(3) Except for Part IX Land and Titles Court, the Head of State, acting on the advice of the Prime Minister, may refer to the Supreme Court for its opinion any question as to the interpretation or effect of any provision of this Constitution which has arisen or appears likely to arise, and the Court shall pronounce its opinion on any question so referred to it. - English1. In cases submitted for trial, tribunals may not apply rules that contravene the Constitution or the principles enshrined therein.
2. Matters of unconstitutionality may be raised by the tribunal of its own motion, by the Public Attorney’s Office, or by any of the parties.
3. After acknowledging the matter of unconstitutionality, the incident will be separately submitted to the Superior Tribunal of Justice, which will decide in a plenary session.

a. To take cognizance in sole [unique] instance of the challenges interposed against the laws or provisions of general character, objected to for partial or total unconstitutionality;
b. To take cognizance in sole instance in its status of Extraordinary Tribunal of [the recourse of] amparo, of actions of amparo interposed against the Congress of the Republic, the Supreme Court of Justice, [or] the President or [the] Vice-President of the Republic;
c. To take cognizance on appeal of all [recourses of] amparo interposed before any of the tribunals of justice. If the appeal should be against a resolution of amparo of the Supreme Court of Justice, the Court of Constitutionality shall be expanded by two members [vocales] in the form specified in Article 268;
d. To take cognizance on appeal of all the challenges against the laws objected to for unconstitutionality in specific cases, in any trial, in cassation, or in the cases contemplated by the law in the matter;
e. To issue an opinion regarding the constitutionality of treaties, agreements, and bills of law at the request of any of the organs of the State;
f. To take cognizance and resolve [the] issues concerning to any conflict of jurisdiction in matters of constitutionality;
g. To compile the doctrine and constitutional principles that have been invoked with the purpose of resolving them through [the recourse of] amparo and [through the recourse] of unconstitutionality of the laws, [and] maintain the jurisprudential bulletin or gazette;
h. To issue an opinion on the unconstitutionality of the laws vetoed by the Executive alleging unconstitutionality; and
i. To act, to render opinions [opinar], to dictate, or to take cognizance of those matters under its competence established in the Constitution of the Republic. (Art. 272) - SpanishLa Corte de Constitucionalidad tiene las siguientes funciones:

f) Conocer y resolver lo relativo a cualquier conflicto de jurisdicción en materia de constitucionalidad;
g) Compilar la doctrina y principios constitucionales que se vayan sentando con motivo de las resoluciones de amparo y de inconstitucionalidad de las leyes, manteniendo al día el boletín o gaceta jurisprudencial;
h) Emitir opinión sobre la inconstitucionalidad de las leyes vetadas por el Ejecutivo alegando inconstitucionalidad; e
i) Actuar, opinar, dictaminar o conocer de aquellos asuntos de su competencia establecidos en la Constitución de la República. (Art. 272)
