- EnglishThe interpretation and regulation of the fundamental rights and guarantees, recognized in the present Constitution, shall be ruled by the following principles:
1. They do not have limiting character and consequently, do not exclude other rights and guarantees of an equal nature.
2. Only by law, in the cases permitted by this Constitution, may the exercise of the fundamental rights and guarantees be regulated, respecting their essential content and the principle of reasonableness.
3. Treaties, pacts, and conventions related to human rights, adopted and ratified by the Dominican State have constitutional hierarchy and are for direct and immediate application by the courts and other organs of the State.
4. The public powers interpret and apply the norms related to fundamental rights and their guarantees, in the sense most favorable to the person in possession of the same, in the case of conflict between fundamental rights, they shall attempt to harmonize the assets and interests protected by this Constitution. To the extent provided for in Articles 21 to 24, the following rights and freedoms may be restricted in law:
1. freedom of expression, freedom of information, freedom of assembly, freedom to demonstrate and freedom of association (Article 1, points 1 to 5);
2. protection against any physical violation in cases other than cases under Articles 4 and 5, against body searches, house searches and other such invasions of privacy, against violations of confidential items of mail or communications and otherwise against violations involving surveillance and monitoring of the individual’s personal circumstances (Article 6);
3. freedom of movement (Article 8); and
4. public court proceedings (Article 11, paragraph two, sentence two).
With authority in law, the rights and freedoms referred to in paragraph one may be restricted by other statute in cases under Chapter 8, Article 5, and in respect of prohibition of the disclosure of matters which have come to a person’s knowledge in the performance of public or official duties. Följande fri- och rättigheter får, i den utsträckning som medges i 21–24 §§, begränsas genom lag:
1. yttrandefriheten, informationsfriheten, mötesfriheten, demonstrationsfriheten och föreningsfriheten (1 § första stycket 1–5),
2. skyddet mot annat kroppsligt ingrepp än som avses i 4 och 5 §§, mot kroppsvisitation, husrannsakan och liknande intrång, mot intrång i förtroliga försändelser och meddelanden samt i övrigt mot intrång som innebär övervakning och kartläggning av den enskildes personliga förhållanden (6 §),
3. rörelsefriheten (8 §), och
4. offentligheten vid domstolsförhandling (11 § andra stycket andra meningen).
Efter bemyndigande i lag får de i första stycket angivna fri- och rättigheterna begränsas genom annan författning i de fall som anges i 8 kap. 5 § och i fråga om förbud att röja sådant som någon fått kännedom om i allmän tjänst eller under utövande av tjänsteplikt. - EnglishIn the case of [an] armed international conflict, formally declared or not, or of a grave internal commotion that puts in imminent danger the rule [imperio] of this Constitution or the regular functioning of the organs created by it, the Congress or the Executive Power may declare the State of Exception in all or in part of the national territory, for a term of sixty days maximum. In the case that such declaration is effected by the Executive Power, the measure must be approved or rejected by the Congress within a time period of forty-eight hours.

… (Art. 288) - SpanishEn caso de conflicto armado internacional, formalmente declarado o no, o de grave conmoción interior que ponga en inminente peligro el imperio de esta Constitución o el funcionamiento regular de los órganos creados por ella, el Congreso o el Poder Ejecutivo podrán declarar el Estado de Excepción en todo o en parte del territorio nacional, por un término de sesenta días como máximo. En el caso de que dicha declaración fuera efectuada por el Poder ejecutivo, la medida deberá ser aprobada o rechazada por el Congreso dentro del plazo de cuarenta y ocho horas.

El decreto o la ley que declare el Estado de Excepción contendrá las razones y los hechos que se invoquen para su adopción, el tiempo de su vigencia y el territorio afectado, así como los derechos que restrinja.
