Composition and Appointment
- EnglishThe Constitutional Court consists of nine (9) members including at least four (4) women, who hold the title of Constitutional Judge.
The duration of the mandate of the Constitutional Judges is of seven (7) years, non-renewable.
The members of the Constitutional Court are designated as follows:
– two (2) Magistrates including one women, elected by their peers;
– two (2) Attorney including one woman, elected by their peers;
– two (2) [members] of a Faculty of Law [enseignants-chercheurs de Droit] including one woman, elected by their peers;
– one (1) member appointed by the President of the Republic;
– one (1) member appointed by the President of the National Assembly;
– one (1) member appointed by the President of the Senate.

The Constitutional Court is referred [to a matter] by the President of the Republic, the President of the Council of the Nation, the President of the National People's Assembly or by the Prime Minister or the Head of the Government, according to the case.
It may equally be referred [to a matter] by forty (40) Deputies or twenty-five (25) members of the Council of the Nation.

تخطر المحكمة الدستورية من رئيس الجمهورية أو رئيس مجلس األمة أو رئيس المجلس الشعبي الوطني أو من الوزير األول أو رئيس الحكومة، حسب الحالة.

La Cour constitutionnelle est saisie par le Président de la République, le Président du Conseil de la Nation, le Président de l’Assemblée Populaire Nationale ou par le Premier ministre ou le Chef du Gouvernement, selon le cas.
Elle peut être également saisie par quarante (40) députés ou vingt-cinq (25) membres du Conseil de la Nation.
L’exercice de la saisine énoncée aux deux alinéas précédents ne s’étend pas à la saisine en exception d’inconstitutionnalité énoncée à l’article 195 ci-dessous. (Art. 193)

In the case of [a] plea of unconstitutionality, the referred jurisdiction postpones [its] decision and grants [impartit] the petitioner a time period of one (1) month from the notification of the decision to refer [the matter] to the Constitutional Court. The Constitutional Court decides obligatorily on:
– the treaties and international agreements before their entry into force, concerning their conformity with the Constitution, after the adoption by the Parliament of the law of authorization;
– the constitutionality of the organic laws and of the laws before their promulgation, of the ordinances as well as the regulatory acts [that] supposedly infringe the fundamental rights of the human person and the public freedoms, after their publication;
– the regulations of the National Assembly and of the Senate, the regulations of procedure of the Constitutional Court and the regulations of the Economic, Social and environmental Council, before their implementation, concerning their conformity with the Constitution;
– the regulations of the independent administrative authorities determined by the law, before their implementation, concerning their conformity with the Constitution;
– the conflicts of attribution between the institutions of the State;
– the regularity of the presidential [and] parliamentary elections, and of the operations of the referendum of which it proclaims the results.
The Constitutional Court is referred to [the matter] in case of dispute concerning the validity of an election, by any elector, any candidate, any political party or delegate of the Government under the conditions provided for by the organic law on the Constitutional Court. (Art. 84) - French

-les conflits d'attribution entre les institutions de l'Etat ;
-la régularité des élections présidentielles, parlementaires et des opérations de référendum dont elle proclame les résultats.
La Cour Constitutionnelle est saisie, en cas de contestation sur la validité d'une élection, par tout électeur, tout candidat, tout parti politique ou délégué du Gouvernement dans les conditions prévues par la loi organique sur la Cour Constitutionnelle. (Art. 84)
