Jurisdiction and Access
- English1 The Federal Supreme Court hears disputes concerning violations of:
a. federal law;
b. international law;
c. inter-cantonal law;
d. cantonal constitutional rights;
e. the autonomy of the communes and other cantonal guarantees in favour of public law corporations;
f. federal and cantonal provisions on political rights.
2 It hears disputes between the Confederation and Cantons or between Cantons.
3 The jurisdiction of the Federal Supreme Court may be extended by law.
4 Acts of the Federal Assembly or the Federal Council may not be challenged in the Federal Supreme Court. Exceptions may be provided for by law. (Art. 189) - French1 Le Tribunal fédéral connaît des contestations pour violation:

Any citizen can refer [a matter] to the Constitutional Court on the constitutionality of the laws, either directly, or by the procedure of the pleadings [exception] of unconstitutionality invoked in a matter which concerns that citizen before a jurisdiction. That [jurisdiction] must defer until the decision the Constitutional Court which must intervene within a time period of thirty days. (Art. 122)

The Constitutional Council is referred to [a matter] by:

• the President of the National Assembly;
• one-tenth (1/10) at least of the members of the National Assembly.
In addition, any citizen may refer [a matter] to the Constitutional Council concerning the constitutionality of the laws, either directly, or through the procedure of the pleadings [exception] of unconstitutionality invoked in a matter [affaire] which concerns them before a jurisdiction. This must postpone [the matter] until the decision of the Constitutional Council which must intervene within a maximum period of time of thirty days counting from its referral [to the matter].
The Constitutional Council can refer itself to any questions relative to its competence, if it judges it necessary. (Art. 157) - French

2. The Constitutional Tribunal is competent:
a) To take cognizance of the recourses of unconstitutionality of the laws.
b) To take cognizance of the recourses of constitutional amparo against the provisions and acts which violate the rights and freedoms recognized in the Fundamental Law.
c) To proclaim the definitive results of the Presidential, Legislative, [and] Municipal Elections and the Operations of Referendum.
d) To declare the permanent physical or mental incapacity that constitute legal impediment to the fulfillment of the functions of the President of the Republic, of the Vice President of the Republic, of the President of the Chamber of the Deputies and of the President of the Senate.
e) To decide with binding character, concerning the constitutional leglity of the regulatory development of the institutional laws.
