- English(1) The Supreme Court shall have an exclusive original jurisdiction—
(a) for the interpretation or enforcement of any provision of this Constitution other than any provision of sections 18 to 33 or section 36(5) (which relate to fundamental rights and freedoms);
(b) on any question whether any law was made in excess of the powers conferred by this Constitution or any other law upon the National Assembly or any other person or authority;
(c) on any question as to whether or not any person was validly elected to the office of President or was validly elected to, or vacated his or her seat in, the National Assembly;
(d) on any question whether any official document should be produced, or its contents disclosed, in proceedings before a court where such production is resisted on the grounds that its production or the disclosure of its contents would be prejudicial to the security of the State or be injurious to the public interest.
(2) Where any question referred to in paragraphs (a), (b) or (d) of subsection (1) arises in any proceedings in any other court, that court shall stay its proceedings and refer the matter to the Supreme Court for its determination, and such other court shall give effect to any decision of the Supreme Court in the matter.

- EnglishWhere any person or any association alleges that any of the rights granted under this Constitution or any legislation or directives are constitutionally contravened, that person or association may invoke the privilege and benefit of court direction, order or writ, including a judgment of unconstitutionality; and anyone injured by an act of the Government or any person acting under its authority, whether in property, contract, tort or otherwise, shall have the right to bring suit for appropriate redress. All such suits brought against the Government shall originate in a Claims Court; appeals from judgment of the Claims Court shall lie directly to the Supreme Court. (Art. 26)

- EnglishThe declaration of unconstitutionality of a law and its abrogation [derogación], may be solicited, by anyone who considers himself injured in his direct, personal, and legitimate interest:
1) By way of action that must be brought [entablar] before the Supreme Court of Justice;
2) By way of exception. which may be opposed in any judicial proceeding; and
3) Also[,] the Jurisdictional Organ that takes cognizance in any Judicial proceeding may solicit[,] of office[,] the declaration of unconstitutionality of a Law and its abrogation before dictating a decision [resolución].
In the cases contemplated in numerals 2) and 3), the activity [actuaciones] must be elevated to the Supreme Court of Justice[,] the procedure following from the moment of summons for decision [sentencia], after which the judicial procedure of the partial question in the sphere of the resolution concerning the unconstitutionality must be suspended. - EnglishIf the High Court is satisfied that a case pending in a court subordinate to it involves a substantial question of law as to the interpretation of this Constitution the determination of which is necessary for the disposal of the case, it shall withdraw the case and may—
(a) either dispose of the case itself, or
(b) determine the said question of law and return the case to the court from which the case has been so withdrawn together with a copy of its judgment on such question, and the said court shall on receipt thereof proceed to dispose of the case in conformity with such judgment. - English1. The Constitutional Court may consider and declare with generally binding force:
a) The unconstitutionality of any norm;
b) The illegality of any norms contained in a legislative act, on the grounds of the breach of a law with superior legal force;
c) The illegality of any norms contained in a regional legislative act, on the grounds of the breach of the autonomous region's statute;
d) The illegality of any norms contained in a legislative act issued by an entity that exercises sovereignty, on the grounds of a breach of those of an autonomous region's rights that are enshrined in its statute.
2. The following may ask the Constitutional Court for a declaration of unconstitutionality or illegality with generally binding force:
a) The President of the Republic;
b) The President of the Assembly of the Republic;
c) The Prime Minister;
d) The Ombudsman;
e) The Attorney General;
f) One tenth of the Members of the Assembly of the Republic;
g) When the grounds for the request for a declaration of unconstitutionality are the breach of the rights of the autonomous regions, or the grounds for the request for a declaration of illegality are the breach of the respective statute, Representatives of the Republic, Legislative Assemblies of the autonomous regions, presidents of Legislative Assemblies of the autonomous regions, presidents of Regional Governments, or one tenth of the members of the respective Legislative Assembly.
3. The Constitutional Court may also consider and declare with generally binding force the unconstitutionality or illegality of any norm, on condition that it has already held the norm unconstitutional or illegal in three concrete cases. a) A inconstitucionalidade de quaisquer normas;
b) A ilegalidade de quaisquer normas constantes de acto legislativo com fundamento em violação de lei com valor reforçado;
c) A ilegalidade de quaisquer normas constantes de diploma regional, com fundamento em violação do estatuto da região autónoma;
d) A ilegalidade de quaisquer normas constantes de diploma emanado dos órgãos de soberania com fundamento em violação dos direitos de uma região consagrados no seu estatuto.
2. Podem requerer ao Tribunal Constitucional a declaração de inconstitucionalidade ou de ilegalidade, com força obrigatória geral:
a) O Presidente da República;
b) O Presidente da Assembleia da República;
c) O Primeiro-Ministro;
d) O Provedor de Justiça;
e) O Procurador-Geral da República;
f) Um décimo dos Deputados à Assembleia da República;
g) Os Representantes da República, as Assembleias Legislativas das regiões autónomas, os presidentes das Assembleias Legislativas das regiões autónomas, os presidentes dos Governos Regionais ou um décimo dos deputados à respectiva Assembleia Legislativa, quando o pedido de declaração de inconstitucionalidade se fundar em violação dos direitos das regiões autónomas ou o pedido de declaração de ilegalidade se fundar em violação do respectivo estatuto.
3. O Tribunal Constitucional aprecia e declara ainda, com força obrigatória geral, a inconstitucionalidade ou a ilegalidade de qualquer norma, desde que tenha sido por ele julgada inconstitucional ou ilegal em três casos concretos. (Art. 281)

1. Subject to sections 41(5), 64(5) and 101(1)4, where any person alleges that any provision of this Constitution (other than Chapter II) has been contravened and that his interests are being or are likely to be affected by such contravention, then, without prejudice to any other action with respect to the same matter which is lawfully available, that person may apply to the Supreme Court for a declaration and for relief under this section.
2. The Supreme Court shall have jurisdiction, in any application made by any person in pursuance of subsection (1) or in any other proceedings lawfully brought before the court, to determine whether any provision of this Constitution (other than Chapter II) has been contravened and to make a declaration accordingly:
Provided that the Supreme Court shall, not make a declaration in pursuance of the jurisdiction conferred by this subsection unless it is satisfied that the interests of the person by whom the application under subsection (1) is made or, in the case of other proceedings before the court, a party to these proceedings, are being or are likely to be affected.
3. Where the Supreme Court makes a declaration in pursuance of subsection (2) that any provision of the Constitution has been contravened and the person by whom the application under subsection (1) was made or, in the case of other proceedings before the court, the party in those proceedings in respect of whom declaration is made, seeks relief, the Supreme Court may grant to that person such remedy, being a remedy available against any person in any proceedings in the Supreme Court under any law for the time being in force in Mauritius, as the court considers appropriate.
4. The Chief Justice may make rules with respect to the practice and procedure of the Supreme Court in relation to the jurisdiction and powers conferred on it by this section (including rules with respect to the time within which applications shall be made under subsection (1)).
5. Nothing in this section shall confer jurisdiction on the Supreme Court to hear or determine any such question as is referred to in section 375 or paragraph 2(5), 3(2) or 4(4) of the First Schedule otherwise than upon an application made in accordance with that section or that paragraph, as the case may be. 1. The President of the Republic;
2. The Attorney [Fiscal] of the Nation;
3. The President of the Judicial Power, with agreement of the Plenary Chamber of the Supreme Court of Justice;
4. The Defender of the People;
5. Twenty-five percent of the legal number of members of the Congress;
6. Five thousand citizens with signatures verified by the National Jurado of Elections. If the norm is a municipal ordinance, one percent of the citizens of the respective territorial domain [ámbito], are enabled to impugn it, whenever this percentage does not exceed the number of signatures specified above;
7. The Regional Governors, with the agreement of the Regional Council or the provincial mayors with agreement of their Council, in matters of their competence;

Están facultados para interponer acción de inconstitucionalidad:
1. El Presidente de la República.
2. El Fiscal de la Nación.
3. El Presidente del Poder Judicial, con acuerdo de la Sala Plena de la Corte Suprema de Justicia.
4. El Defensor del Pueblo.
5. El veinticinco por ciento del número legal de congresistas.
6. Cinco mil ciudadanos con firmas comprobadas por el Jurado Nacional de Elecciones. Si la norma es una ordenanza municipal, está facultado para impugnarla el uno por ciento de los ciudadanos del respectivo ámbito territorial, siempre que este porcentaje no exceda del número de firmas anteriormente señalado.
7. Los Gobernadores Regionales con acuerdo del Consejo Regional, o los alcaldes provinciales con acuerdo de su Concejo, en materias de su competencia.
