- EnglishWhen a judge, by virtue of his/her office or at the request of a party, considers that a legal norm is contrary to the Constitution or to international human rights instruments that provide for rights that are more favorable than those enshrined in the Constitution, it shall suspend the case and refer it for consultation to the Constitutional Court, which within no more than forty-five (45) days shall rule on the constitutionality of the norm.
If the Court issues no ruling within the established time-limits, the affected party is entitled to file the corresponding complaint. (Art. 428) - SpanishCuando una jueza o juez, de oficio o a petición de parte, considere que una norma jurídica es contraria a la Constitución o a los instrumentos internacionales de derechos humanos que establezcan derechos más favorables que los reconocidos en la Constitución, suspenderá la tramitación de la causa y remitirá en consulta el expediente a la Corte Constitucional, que en un plazo no mayor a cuarenta y cinco días, resolverá sobre la constitucionalidad de la norma.

- EnglishIf the Chancellor of Justice finds that a legislative instrument passed by the legislative or executive branch of government or by a local authority is in conflict with the Constitution or a law, he or she makes a proposal to the body which passed the instrument to bring it into conformity with the Constitution or the law within twenty days. If the instrument is not brought into conformity with the Constitution or the law within twenty days, the Chancellor of Justice refers the matter to the Supreme Court who may declare the instrument invalid. – decide on the constitutionality of the laws and of the regulatory acts taken in the matters other than those arising within the domain of the law;
– assure the respect for this Constitution including the Charte des Droits fundamentaux [Charter of Fundamental Rights], by the organs of the State, [and] the other institutions;
– interpret the Constitution, at the demand of the President of the Republic, of the President of the National Assembly, of the President of the Senate, of one-quarter of the Deputies or of one-quarter of the Senators;
– decide on the regularity of the presidential elections, legislative [elections] and of the referenda and to proclaim the definitive results of them;
– receive the oath of the President of the Republic, of the Vice President of the Republic, of the Prime Minister and of the other Ministers before their entry into [their] functions;
– declare the vacancy of the post of President of the Republic.
– declare the vacancy of the seats of the parliamentarians.
The organic laws before their promulgation, the international treaties before submitting them to the vote of the Assemblies, the internal regulations of the National Assembly and of the Senate before their application, are submitted obligatory to the control of constitutionality. - EnglishThe Law Commission shall have the powers—
a. to review and make recommendations regarding any matter pertaining to the laws of Malawi and their conformity with this Constitution and applicable international law;
b. to review and make recommendations regarding any matter pertaining to this Constitution;
c. to receive any submissions from any person or body regarding the laws of Malawi or this Constitution; and
d. to report its findings and recommendations to the Minister for the time being responsible for Justice who shall publish any such report and lay it before Parliament. (Sec. 135)

- English1) A Constitutional Court shall be established by way of a specific law as a court of public law to protect the rights guaranteed by the Constitution, to decide in conflicts of jurisdiction between the Courts and the administrative authorities, and to act as a disciplinary court for the Ministers.
2) The Constitutional Court shall also have jurisdiction to review the constitutionality of laws and international treaties and the legality of Government ordinances; in such matters, it may declare their annulment. Finally, it shall also act as an electoral tribunal. 2) In seine Kompetenz fallen weiter die Prüfung der Verfassungsmässigkeit von Gesetzen und Staatsverträgen sowie der Gesetzmässigkeit der Regierungsverordnungen; in diesen Angelegenheiten urteilt er kassatorisch. Endlich fungiert er auch als Wahlgerichtshof. (Art. 104)
