The Council of State gives its opinion on the bills and proposals of law as well as on the amendments which might be proposed.
If it considers that a bill or proposal of law includes provisions which are nonconform with the Constitution, with the international treaties to which the Grand Duchy of Luxembourg is a party, with the juridical acts of the European Union or with the general principles of law [droit], it mentions it in its opinion.

The Constitutional Court pronounces whether state treaties are unlawful. Art. 140 shall apply to political, to law-modifying and to law-amending state treaties and to state treaties modifying the Treaty basis of the European Union, Art. 139 to all other state treaties with the following proviso,

- EnglishI. The Popular Action shall be filed during the period in which the violation or threat to the rights and collective interests continues. To file this action it is not necessary to exhaust the judicial or administrative processes that might exist.
II. Any person, in his or her individual name or on behalf of a collective, may file this action, and it shall be filed obligatorily by the Public Ministry and the Public Defender (Ministerio Público y el Defensor del Pueblo) when, in the exercise of their functions, they have knowledge of these acts. The procedure for the Action for Constitutional Protection shall be applied. (Art. 136) - SpanishI. La Acción Popular podrá interponerse durante el tiempo que subsista la vulneración o la amenaza a los derechos e intereses colectivos. Para interponer esta acción no será necesario agotar la vía judicial o administrativa que pueda existir.
II. Podrá interponer esta acción cualquier persona, a título individual o en representación de una colectividad y, con carácter obligatorio, el Ministerio Público y el Defensor del Pueblo, cuando por el ejercicio de sus funciones tengan conocimiento de estos actos. - EnglishIf the Chancellor of Justice finds that a legislative instrument passed by the legislative or executive branch of government or by a local authority is in conflict with the Constitution or a law, he or she makes a proposal to the body which passed the instrument to bring it into conformity with the Constitution or the law within twenty days. If the instrument is not brought into conformity with the Constitution or the law within twenty days, the Chancellor of Justice refers the matter to the Supreme Court who may declare the instrument invalid. (Sec. 142)
- EstonianKui õiguskantsler leiab, et seadusandliku või täidesaatva riigivõimu või kohaliku omavalitsuse õigustloov akt on põhiseaduse või seadusega vastuolus, teeb ta akti vastuvõtnud organile ettepaneku viia see kahekümne päeva jooksul põhiseaduse või seadusega kooskõlla.

– decide on the constitutionality of the laws and of the regulatory acts taken in the matters other than those arising within the domain of the law;
– assure the respect for this Constitution including the Charte des Droits fundamentaux [Charter of Fundamental Rights], by the organs of the State, [and] the other institutions;
– interpret the Constitution, at the demand of the President of the Republic, of the President of the National Assembly, of the President of the Senate, of one-quarter of the Deputies or of one-quarter of the Senators;
– decide on the regularity of the presidential elections, legislative [elections] and of the referenda and to proclaim the definitive results of them;
– receive the oath of the President of the Republic, of the Vice President of the Republic, of the Prime Minister and of the other Ministers before their entry into [their] functions;
– declare the vacancy of the post of President of the Republic.
– declare the vacancy of the seats of the parliamentarians.
The organic laws before their promulgation, the international treaties before submitting them to the vote of the Assemblies, the internal regulations of the National Assembly and of the Senate before their application, are submitted obligatory to the control of constitutionality. - EnglishThe Supreme Constitutional Court shall be solely competent to decide on the constitutionality of laws and regulations, to interpret legislative provisions, and to adjudicate on disputes pertaining to the affairs of its members, on jurisdictional disputes between judicial bodies and entities that have judicial jurisdiction, on disputes pertaining to the implementation of two final contradictory judgments, one of which is rendered by a judicial body or an authority with judicial jurisdiction and the other is rendered by another, and on disputes pertaining to the execution of its judgments and decisions.
The law shall determine the Court’s other competences and regulate the procedures that are to be followed before the Court.
