- English1. The Supreme Constitutional Court is charged with control over the constitutionality of the laws as follows:
a. If the President of the Republic or a fifth of the members of the People’s Assembly object to a law before it is passed, on the grounds of its unconstitutionality, it shall be suspended until the Court rules on it within 15 days of the date of lodging the objection at the Court. If the law is urgently needed, the Court shall rule on it within 7 days;
b. If a fifth of the members of the People’s Assembly object to a legislative decree, on the grounds of its unconstitutionality within 15 days of it is being presented to the Assembly, the Court shall rule on it within 15 days of lodging the objection at the Court;

2. Considering the claim of the unconstitutionality of a law or a legislative decree and ruling on it takes place as follows:
a. If an opponent making a challenge claimed the unconstitutionality of a legal text applied by the court whose ruling is being challenged, and if the court considering the challenge found that the claim was serious and should be ruled on, it halts the proceedings of the case and refers it to the Supreme Constitutional Court;

- EnglishAll of the judges of the Republic, within their respective spheres of competence and in accordance with the provisions of this Constitution and law, are obligated to ensure the integrity of the Constitution.
In the event of incompatibility between the Constitution and a law or other juridical provision, the provisions of the Constitution shall prevail, being the responsibility of the courts to rule accordingly in any case, even ex officio.
The Constitutional Division of the Supreme Tribunal of Justice, as court of constitutional competence, shall have the exclusive power to declare the nullity of laws and other acts of organs exercising Public Power which are issued by way of direct and immediate implementation of the Constitution or have the status of law. - EnglishThe Federal Supreme Court has the following powers:
1. Decide on different disputes among the member Emirates of the UAE, or between any one or more Emirates and the federal government in case that the dispute is remitted to the Court upon the request of any of the concerned parties.
2. Consider the constitutionality of a federal law if it is challenged by one or more Emirates on the grounds that it is in conflict with the Constitution of the UAE. The Court also has the power to consider the constitutionality of a legislation enacted by an Emirate if it is challenged by a federal authority on the grounds that it is in conflict with the Constitution of the UAE or the federal laws.
3. Consider the constitutionality of laws, legislations and regulations in general if it is so requested by any court in the country while hearing a relevant case. The concerned court shall comply with the decision of the Federal Supreme Court rendered in this connection.
4. Interpret the provisions of the Constitution, if it is so requested by any federal authority or by the Government of any Emirate. Any such interpretation is binding on everyone.
5. Call into account the ministers and senior officials of the UAE appointed by decree for their actions while performing their official duties upon the request of the Supreme Council and in accordance with the relevant law.
6. Decide on the crimes which directly affect the interests of the UAE, such as the crimes relating to the UAE’s internal or external security, forgery of the official records or seals of a federal authority, and counterfeiting of currency.
7. Hear the cases of conflict of jurisdiction between a federal court and a local court in an Emirate.
8. Hear the cases of conflict of jurisdiction between a court in an Emirate and a court in another Emirate. The rules governing these cases are regulated by a federal law.
9. Any other powers provided in the Constitution or which may be conferred upon the Federal Supreme Court by a federal law. (Art. 99) - Arabicتختص المحكمة الاتحادية العليا بالفصل في الأمور التالية:
1. المنازعات المختلفة بين الامارات الأعضاء في الاتحاد ، أو بين أية أمارة أو أكثر وبين حكومة الاتحاد ، متى أحيلت هذه المنازعات الى المحكمة بناء على طلب أي طرف من الأطراف المعنية

.4. تفسير أحكام الدستور اذا ما طلبت اليها ذلك احدى سلطات الاتحاد ، أو حكومة احدى الامارات . ويعتبر هذا التفسير ملزما للكافة
.5. مساءلة الوزراء ، وكبار موظفي الاتحاد المعينين بمرسوم ، عما يقع منهم من أفعال في أداء وظائفهم الرسمية بناء على طلب المجلس الأعلى ووفقا للقانون الخاص بذلك
.6. الجرائم التي لها مساس مباشر بمصالح الاتحاد ، كالجرائم المتعلقة بأمنه في الداخل أو الخارج ، وجرائم تزوير المحررات أو الأختام الرسمية لاحدى السلطات الاتحادية ، وجرائم تزييف العملة
.7. تنازع الاختصاص بين القضاء الاتحادي والهيئات القضائية المحلية في الامارات
.8. تنازع الاختصاص بين هيئة قضائية في امارة وهيئة قضائية في امارة اخرى وتنظم القواعد الخاصة بذلك بقانون اتحادي
.9. أية اختصاصات أخرى منصوص عليها في هذا الدستور أو يمكن أن تحال اليها بموجب قانون اتحادي. (المادّة 99)

- English1. The Constitutional Court shall have jurisdiction to hear appeals against any of the following court decisions:
a) Refusing to apply a legal rule on the grounds of its unconstitutionality;
b) Applying rules whose constitutionality may have been challenged during the proceedings.
2. The Constitutional Court shall also have jurisdiction to hear appeals against any of the following court decisions:
a) Refusing to apply the legal rule of a regional law on the grounds of its illegality by infringement of a law of superior force;
b) Refusing to apply the legal rule of a regional legislative on the grounds of its illegality by infringement of the Political and Administrative Statute of the Autonomous Region of Príncipe or of the general law of the Republic;
c) Refusing to apply the legal rule of a law emanating from a sovereign body on the grounds of illegality by infringement of the Political and Administrative Statute of the Autonomous Region of Príncipe;
d) Applying a rule, whose legality has been challenged during the proceedings on any of the grounds specified in subparagraphs a), b) and c).
3. If a rule, whose application has been refused, consists of an international convention, of a legislative act or of a regulatory decree, the appeals contemplated in subparagraph a) of paragraph 1 and paragraph a) of paragraph 2 of this article are required for public prosecution.
4. The appeals contemplated in subparagraphs b) and d) of paragraph 2 may be instituted only by the party who has challenged the unconstitutionality or illegality, and the law shall regulate the rules on admissibility of these appeals.
5. The Constitutional Court, mandatorily the Public Prosecutor’s Office, shall also have jurisdiction to hear appeals against the decisions of courts that apply a law previously judged unconstitutional or illegal by the Constitutional Court itself.
6. Appeals to the Constitutional Court shall be restricted to the question of unconstitutionality or of illegality, in conformance with the cases. (Art. 149) - Portuguese1. Cabe recurso para o Tribunal Constitucional das decisões dos tribunais:
a) Que recusem a aplicação de qualquer norma com fundamento na sua inconstitucionalidade;

2. Cabe igualmente recurso para o Tribunal Constitucional das decisões dos tribunais:
a) Que recusem a aplicação de norma constante de acto legislativo com fundamento na sua ilegalidade por violação de lei com valor reforçado;
b) Que recusem a aplicação de norma constante de diploma regional com fundamento na sua ilegalidade por violação do Estatuto Político-Administrativo da Região Autónoma do Príncipe ou de lei geral da República;
c) Que recusem a aplicação de norma constante de diploma emanado de um órgão de soberania com fundamento na ilegalidade por violação do Estatuto Político-Administrativo da Região Autónoma do Príncipe;
d) Que apliquem norma cuja ilegalidade haja sido suscitada durante o processo com qualquer dos fundamentos referidos nas alíneas a), b) e c).
3. Quando a norma cuja aplicação tiver sido recusada constar de convenção internacional, de acto legislativo ou de decreto regulamentar, os recursos previstos na alínea a) do número 1 e na alínea a) do número 2 deste artigo são obrigatórios para o Ministério Público.
4. Os recursos previstos nas alíneas b) e d) do número 2 só podem ser interpostos, pela parte que haja suscitado a questão da inconstitucionalidade ou da ilegalidade, devendo a lei regular o regime de admissão desses recursos.
5. Cabe ainda recurso para o Tribunal Constitucional, obrigatório para o Ministério Público, das decisões dos tribunais que apliquem norma anteriormente julgada inconstitucional ou ilegal pelo próprio Tribunal Constitucional.
6. Os recursos para o Tribunal Constitucional são restritos à questão da inconstitucionalidade ou da ilegalidade, conforme os casos. (Art. 149)

- EnglishThe Constitutional Court shall, in the manner stipulated by the Law on the Constitutional Court:
1) Determine the conformity with the Constitution of laws, decisions of the National Assembly, orders and decrees of the President of the Republic, decisions of the Government and the Prime Minister, and sub-legislative normative legal acts;
2) Prior to the adoption of the draft Constitutional Amendments, as well as drafts of legal acts put to a referendum, determine their conformity with the Constitution;
3) Prior to the ratification of an international treaty, determine the conformity with the Constitution of obligations enshrined therein;
4) Resolve disputes arising between constitutional bodies with respect to their constitutional powers;
5) Resolve disputes related to decisions adopted with respect to the results of a referendum or the results of elections of the National Assembly and the President of the Republic;
6) Render a decision on termination of the powers of a parliamentarian;
7) Issue an opinion on the existence of a ground for impeaching the President of the Republic;
8) Render a decision on the impossibility for the President of the Republic to discharge his powers;
9) Solve the question of imposing disciplinary liability on a judge of the Constitutional Court;
10) Solve the question of terminating the powers of a judge of the Constitutional Court,
11) Solve the question on initiating criminal prosecution against a judge of the Constitutional Court or consenting to depriving him of liberty with respect to the performance of his duties; and
12) In cases stipulated by law, render a decision on suspending or prohibiting the activities of a party. (Art. 168) - ArmenianՍահմանադրական դատարանը Սահմանադրական դատարանի մասին օրենքով սահմանված կարգով՝
1) որոշում է օրենքների, Ազգային ժողովի որոշումների, Հանրապետության նախագահի հրամանագրերի և կարգադրությունների, Կառավարության և վարչապետի որոշումների, ենթաօրենսդրական նորմատիվ իրավական ակտերի համապատասխանությունը Սահմանադրությանը.

8) որոշում է կայացնում Հանրապետության նախագահի լիազորությունների կատարման անհնարինության մասին.
9) լուծում է Սահմանադրական դատարանի դատավորին կարգապահական պատասխանատվության ենթարկելու հարցը.
10) լուծում է Սահմանադրական դատարանի դատավորի լիազորությունները դադարեցնելու հարցը.
11) լուծում է իր լիազորությունների իրականացման կապակցությամբ Սահմանադրական դատարանի դատավորի նկատմամբ քրեական հետապնդում հարուցելու կամ նրան ազատությունից զրկելու վերաբերյալ համաձայնություն տալու հարցը.
12) օրենքով սահմանված դեպքերում որոշում է կայացնում կուսակցության գործունեությունը կասեցնելու կամ արգելելու վերաբերյալ։ (Հոդված 168)

The Constitutional Court shall give opinions on proposals by the President, the Presidium of the All-Belarusian People's Assembly, the Chamber of Representatives, the Council of the Republic, the Supreme Court and the Council of Ministers:
on the interpretation of the Constitution;
on the constitutionality of laws, presidential decrees, decrees of the Council of Ministers and the regulations of other state bodies.
The Constitutional Court issues opinions on the President's proposals:
on the constitutionality of draft laws amending and supplementing the Constitution;
on the constitutionality of laws passed by Parliament before they are signed by the President;
on the constitutionality of questions submitted to a republican referendum;
on the conformity with the Constitution of the international treaties of the Republic of Belarus which have not entered into force.
In cases provided for in the Constitution, the Constitutional Court shall issue opinions within two weeks:
on the proposal of the Presidium of the All-Belarusian People's Assembly that there are facts of systematic or gross violations of the Constitution by the President;
on the proposal of the President on the existence of a systematic or gross violation of the Constitution by the Houses of Parliament.
The Constitutional Court, on the proposal of the Presidium of the All-Belarusian People's Assembly, shall issue opinions on the constitutionality of the elections of the President, members of the House of Representatives and members of the Council of the Republic.
The Constitutional Court shall rule in the manner prescribed by law:
upon complaints by citizens of violations of their constitutional rights and freedoms by verifying the constitutionality of the laws applied in a particular case, where all other judicial remedies have been exhausted;
upon requests from the courts, checking the constitutionality of legal acts to be applied in specific cases before the courts.
The opinions and judgments of the Constitutional Court are final and cannot be appealed or contested. (Art. 1161) - Belarusian

Канстытуцыйны Суд па прапанове Прэзідыума Усебеларускага народнага сходу дае заключэнні аб канстытуцыйнасці правядзення выбараў Прэзідэнта, дэпутатаў Палаты прадстаўнікоў і членаў Савета Рэспублікі.
Канстытуцыйны Суд у парадку, устаноўленым законам, выносіць рашэнні:
па скаргах грамадзян на парушэнні іх канстытуцыйных правоў і свабод, правяраючы канстытуцыйнасць законаў, прымененых у канкрэтнай справе, калі вычарпаны ўсе іншыя сродкі судовай абароны;

Конституционный Суд по предложениям Президента, Президиума Всебелорусского народного собрания, Палаты представителей, Совета Республики, Верховного Суда, Совета Министров дает заключения:
о толковании Конституции;
о соответствии Конституции законов, указов Президента, постановлений Совета Министров, нормативных правовых актов других государственных органов.
Конституционный Суд по предложениям Президента дает заключения:
о конституционности проектов законов о внесении изменений и дополнений в Конституцию;
о соответствии Конституции законов, принятых Парламентом, до их подписания Президентом;
о конституционности вопросов, выносимых на республиканский референдум;
о соответствии Конституции не вступивших в силу международных договоров Республики Беларусь.
В случаях, предусмотренных Конституцией, Конституционный Суд в двухнедельный срок дает заключения:
по предложению Президиума Всебелорусского народного собрания о наличии фактов систематического или грубого нарушения Президентом Конституции;
по предложению Президента о наличии фактов систематического или грубого нарушения палатами Парламента Конституции.
Конституционный Суд по предложению Президиума Всебелорусского народного собрания дает заключения о конституционности проведения выборов Президента, депутатов Палаты представителей и членов Совета Республики.
Конституционный Суд в порядке, установленном законом, выносит решения:
по жалобам граждан на нарушения их конституционных прав и свобод, проверяя конституционность законов, примененных в конкретном деле, если исчерпаны все другие средства судебной защиты;
по запросам судов, проверяя конституционность нормативных правовых актов, подлежащих применению при рассмотрении судами конкретных дел.
Заключения и решения Конституционного Суда являются окончательными, обжалованию и опротестованию не подлежат. (Статья 1161)

(3) The Constitutional Court-
(a) is the highest court of the Republic; and
(b) may decide -
(i) constitutional matters; and
(ii) any other matter, if the Constitutional Court grants leave to appeal on the grounds that the matter raises an arguable point of law of general public importance which ought to be considered by that Court; and
(c) makes the final decision whether a matter is within its jurisdiction.
(4) Only the Constitutional Court may -
(a) decide disputes between organs of state in the national or provincial sphere concerning the constitutional status, powers or functions of any of those organs of state;
(b) decide on the constitutionality of any parliamentary or provincial Bill, but may do so only in the circumstances anticipated in section 79 or 121;
(c) decide applications envisaged in section 80 or 122;
(d) decide on the constitutionality of any amendment to the Constitution;
(e) decide that Parliament or the President has failed to fulfil a constitutional obligation; or
(f) certify a provincial constitution in terms of section 144.
(5) The Constitutional Court makes the final decision whether an Act of Parliament, a provincial Act or conduct of the President is constitutional, and must confirm any order of invalidity made by the Supreme Court of Appeal, the High Court of South Africa, or a court of similar status, before that order has any force.
(6) National legislation or the rules of the Constitutional Court must allow a person, when it is in the interests of justice and with leave of the Constitutional Court—
(a) to bring a matter directly to the Constitutional Court; or
(b) to appeal directly to the Constitutional Court from any other court.
(7) A constitutional matter includes any issue involving the interpretation, protection or enforcement of the Constitution. (Sec. 167)
