Obligations of the State
- EnglishThe State shall, as required, make legal provisions for the implementation of the rights conferred by this Part, within three years of the commencement of this Constitution. (Art. 47)

- English1. The constitutional precepts with regard to rights, freedoms and guarantees are directly applicable and are binding on public and private entities.
2. The law may only restrict rights, freedoms and guarantees in cases expressly provided for in the Constitution, and such restrictions must be limited to those needed to safeguard other constitutionally protected rights and interests.
3. Laws that restrict rights, freedoms and guarantees must have a general and abstract nature and may not have a retroactive effect or reduce the extent or scope of the essential content of the constitutional precepts. (Art. 18) - Portuguese1. Os preceitos constitucionais respeitantes aos direitos, liberdades e garantias são directamente aplicáveis e vinculam as entidades públicas e privadas.
2. A lei só pode restringir os direitos, liberdades e garantias nos casos expressamente previstos na Constituição, devendo as restrições limitar-se ao necessário para salvaguardar outros direitos ou interesses constitucionalmente protegidos.
3. As leis restritivas de direitos, liberdades e garantias têm de revestir carácter geral e abstracto e não podem ter efeito retroactivo nem diminuir a extensão e o alcance do conteúdo essencial dos preceitos constitucionais. (Art. 18)

The Republic of San Marino receives generally recognised rules of international law as integral part of its constitutional order, to which it shall conform its acts and conduct. It recognises the provisions set forth in the international declarations on human rights and fundamental freedoms.
… It rejects war as a means to settle disputes between States and, in its international policy, adheres to the principles enshrined in the Charter of the United Nations.
San Marino constitutional order recognises, guarantees and enforces the rights and fundamental freedoms set forth by the European Convention for the Protection of Human Rights and Fundamental Freedoms.
Regularly signed and implemented international agreements on the protection of human rights and freedoms shall prevail over domestic legislation in case of conflict. (Art. 1) - Italian
La Repubblica di San Marino riconosce, come parte integrante del proprio ordinamento, le norme di diritto internazionale generalmente riconosciute e conforma ad esse i suoi atti e la condotta. Si uniforma alle norme contenute nelle dichiarazioni internazionali in tema di diritti dell’uomo e delle libertà fondamentali.
