To guarantee the rights and freedoms recognized in this Constitution, the Institution of the National Commissioner of Human Rights is created.
The organization, prerogatives and attributions of the National Commissioner of Human Rights will be the object of a special law. - English(1) The Human Rights Commission established under the Human Rights Commission Decree 2009 continues in existence as the Human Rights and Anti-Discrimination Commission.
(2) The Commission consists of—
(a) a chairperson, who must be a person who is or is qualified to be appointed as a judge; and
(b) 4 other members, appointed by the President on the advice of the Constitutional Offices Commission.

(4) Subject to this Constitution, the Commission is responsible for—
(a) promoting the protection and observance of, and respect for, human rights in public and private institutions, and to develop a culture of human rights in Fiji;
(b) education about the rights and freedoms recognised in this Chapter, as well as other internationally recognised rights and freedoms;
(c) monitoring, investigating and reporting on the observance of human rights in all spheres of life;
(d) making recommendations to Government concerning matters affecting the rights and freedoms recognised in this Chapter, including recommendations concerning existing or proposed laws;
(e) receiving and investigating complaints about alleged abuses of human rights and take steps to secure appropriate redress if human rights have been violated, including making applications to court for redress or for other forms of relief or remedies;
(f) investigating or researching, on its own initiative or on the basis of a complaint, any matter in respect of human rights, and make recommendations to improve the functioning of public or private entities;
(g) monitoring compliance by the State with obligations under treaties and conventions relating to human rights; and
(h) performing any other functions or exercising any powers as are conferred on the Commission by a written law.
(5) Subject to this Constitution, any person has the right to lodge a complaint with the Commission, alleging that a right or freedom in this Chapter has been denied, violated or infringed, or is threatened.

a. monitor the state of human rights throughout Lesotho;
b. monitor the human rights situation of detainees;
c. investigate violations of human rights and, if necessary, be responsible for instituting proceedings against such violation in the courts of law;
d. sensitise the public on its work, the nature and meaning of human rights;
e. develop and deliver education and training programmes as necessary to the general public;
f. submit opinions, recommendations, propositions and reports to public institutions on human rights issues, using the media and other means;
g. advocate for ratification, and recommend the domestication of international and regional human rights instruments;
h. promote and monitor the harmonisation of national laws and practices with international and regional human rights instruments ratified by Lesotho;
i. develop and maintain working relations with organisations and representatives of civil society in Lesotho;
j. work in cooperation with the United Nations, regional mechanisms, national human rights institutions of other countries, in the areas of the promotion and protection of human rights, and
k. undertake any other activities or responsibilities that are consistent with the spirit of the promotion and protection of human rights. (Sec. 133F)

- EnglishThe functions of the Ombudsman shall be defined and prescribed by an Act of Parliament and shall include the following:
(a) the duty to investigate complaints concerning alleged or apparent instances of violations of fundamental rights and freedoms, abuse of power, unfair, harsh, insensitive or discourteous treatment of an inhabitant of Namibia by an official in the employ of any organ of Government (whether central or local), manifest injustice, or conduct by such official which would properly be regarded as unlawful, oppressive or unfair in a democratic society;
(b) the duty to investigate complaints concerning the functioning of the Public Service Commission, administrative organs of the State, the defence force, the police force and the correctional service in so far as such complaints relate to the failure to achieve a balanced structuring of such services or equal access by all to the recruitment of such services or fair administration in relation to such services;

(d) the duty to investigate complaints concerning practices and actions by persons, enterprises and other private institutions where such complaints allege that violations of fundamental rights and freedoms under this Constitution have taken place;
(e) the duty and power to take appropriate action to call for the remedying, correction and reversal of instances specified in the preceding Sub-Articles through such means as are fair, proper and effective, including:
(aa) negotiation and compromise between the parties concerned;
(bb) causing the complaint and his or her finding thereon to be reported to the superior of an offending person;
(cc) referring the matter to the Prosecutor-General;
(dd) bringing proceedings in a competent Court for an interdict or some other suitable remedy to secure the termination of the offending action or conduct, or the abandonment or alteration of the offending procedures;
(ee) bringing proceedings to interdict the enforcement of such legislation or regulation by challenging its validity if the offending action or conduct is sought to be justified by subordinate legislation or regulation which is grossly unreasonable or otherwise ultra vires;
(ff) reviewing such laws as were in operation before the date of Independence in order to ascertain whether they violate the letter or the spirit of this Constitution and to make consequential recommendations to the President, the Cabinet or the Attorney-General for appropriate action following thereupon;

(1) It shall be the duty of the National Human Rights Commission to respect, protect and promote human rights and ensure effective enforcement thereof.
(2) For the accomplishment of the duty referred to in clause (1), the National Human Rights Commission shall perform the following functions:
(a) To inquire, on its own initiative or on petition or complaint presented in or sent to the Commission by a victim or any person on his or her behalf or on information received by the Commission from any source, into and investigate complaints of violations of human rights of an individual or group or abetment thereof, and make recommendation for action against the perpetrators;
(b) In case any official who has the responsibility or duty to prevent violations of human rights fails to fulfil or perform his or her responsibility or duty or shows reluctance in the fulfilment or performance of his or her responsibility or duty, to make recommendation to the concerned authority to take departmental action against such official;
(c) In case it is required to institute a case against any person or organization who has violated human rights, to make recommendation to file a case in the court in accordance with law;
(d) To coordinate and collaborate with civil society in order to enhance awareness on human rights;
(e) To make recommendation, accompanied by the reasons and grounds, to the concerned body for taking departmental action against and imposing punishment on those who are violators of human rights;
(f) To carry out periodic reviews of the relevant laws relating to human rights and make recommendation to the Government of Nepal for necessary improvements in and amendments to such laws;
(g) In case Nepal has to become a party to any international treaty or agreement on human rights, to make recommendation, accompanied by the reasons therefor, to the Government of Nepal; and monitor whether any such treaty or an agreement to which Nepal is already a party has been implemented, and in case it is found not to have been implemented, to make recommendation to the Government of Nepal for its implementation;
(h) To publish, in accordance with law, the names of the officials, persons or bodies who have failed to observe or implement any recommendations or directives made or given by the National Human Rights Commission in relation to the violations of human rights, and record them as violators of human rights.

(१) मानव अधिकारको सम्मान, संरक्षण र संवर्धन तथा त्यसको प्रभावकारी कार्यान्वयनलाई सुनिश्चित गर्नु राष्ट्रिय मानव अधिकार आयोगको कर्तव्य हुनेछ ।
(२) उपधारा (१) मा उल्लिखित कर्तव्य पूरा गर्नका लागि राष्ट्रिय मानव अधिकार आयोगले देहाय बमोजिमका काम गर्नेछ ः–

(ग) मानव अधिकार उल्लंघन गर्ने व्यक्ति वा संस्थाका विरुद्ध मुद्दा चलाउनु पर्ने आवश्यकता भएमा कानून बमोजिम अदालतमा मुद्दा दायर गर्न सिफारिस गर्ने,
(घ) मानव अधिकारको चेतना अभिवृद्धि गर्न नागरिक समाजसँग समन्वय र सहकार्य गर्ने,
(ङ) मानव अधिकारको उल्लंघनकर्तालाई विभागीय कारबाही तथा सजाय गर्न कारण र आधार खुलाई सम्बन्धित निकाय समक्ष सिफारिस गर्ने,
(च) मानव अधिकारसँग सम्बन्धित कानूनको आवधिक रूपमा पुनरावलोकन गर्ने तथा त्यसमा गर्नु पर्ने सुधार तथा संशोधनका सम्बन्धमा नेपाल सरकार समक्ष सिफारिस गर्ने,
(छ) मानव अधिकारसँग सम्बन्धित अन्तर्राष्ट्रिय सन्धि वा सम्झौताको नेपाल पक्ष बन्नु पर्ने भएमा त्यसको कारण सहित नेपाल सरकारलाई सिफारिस गर्ने र नेपाल पक्ष बनिसकेका सन्धि वा सम्झौताको कार्यान्वयन भए वा नभएको अनुगमनगरी कार्यान्वयन नभएको पाइएमा त्यसको कार्यान्वयन गर्न नेपाल सरकार समक्ष सिफारिस गर्ने,
(ज) मानव अधिकारको उल्लंघनका सम्बन्धमा राष्ट्रिय मानव अधिकार आयोगले गरेको सिफारिस वा निर्देशन पालन वा कार्यान्वयन नगर्ने पदाधिकारी, व्यक्ति वा निकायको नाम कानून बमोजिम सार्वजनिक गरी मानव अधिकार उल्लंघनकर्ताको रूपमा अभिलेख राख्ने ।

- EnglishThe powers of the Office of the Public Defender, in addition to those established in the Constitution and the law, are the following:
1. To file actions of Unconstitutionality, of Liberty, of Constitutional Protection, of Protection of Privacy, Popular actions, actions for Compliance and the direct appeal of nullity, without the requirement of having a mandate.
2. To present bills and modifications of laws, decrees and non-judicial resolutions in matters of its competence.
3. To investigate, on its own or at the request of a party, the acts or omissions that imply violations of rights, individual and collective, that are established in the Constitution, laws and international instruments, and request that the Public Ministry initiate the corresponding legal actions.
4. To request information from the authorities and public servants with respect to the investigations that the Public Defender is carrying out, to which no objection may be posed.
5. To formulate recommendations, reminders of legal duties, and suggestions for the immediate adoption of corrective measures for all the organs and institutions of the State, and to issue public censure for acts or behavior contrary to these formulations.
6. To have free access to the center of detention and prisons, to which no one may pose an objection.
7. To exercise its functions without interruption of any kind, even in the case of a declaration of a state of emergency.
8. To attend to the persons who request its services promptly and without discrimination.
9. To draft the regulations needed for the exercise of its functions. (Art. 222) - SpanishSon atribuciones de la Defensoría del Pueblo, además de las que establecen la Constitución y la ley:

2. Presentar proyectos de ley y proponer modificaciones a leyes, decretos y resoluciones no judiciales en materia de su competencia.
3. Investigar, de oficio o a solicitud de parte, los actos u omisiones que impliquen violación de los derechos, individuales y colectivos, que se establecen en la Constitución, las leyes y los instrumentos internacionales, e instar al Ministerio Público al inicio de las acciones legales que correspondan.
4. Solicitar a las autoridades y servidores públicos información respecto a las investigaciones que realice la Defensoría del Pueblo, sin que puedan oponer reserva alguna.
5. Formular recomendaciones, recordatorios de deberes legales, y sugerencias para la inmediata adopción de correctivos y medidas a todos los órganos e instituciones del Estado, y emitir censura pública por actos o comportamientos contrarios a dichas formulaciones.
6. Acceder libremente a los centros de detención e internación, sin que pueda oponerse objeción alguna.
7. Ejercer sus funciones sin interrupción de ninguna naturaleza, aun en caso de declaratoria de estado de excepción.
8. Asistir con prontitud y sin discriminación a las personas que soliciten sus servicios.
9. Elaborar los reglamentos necesarios para el ejercicio de sus funciones. (Art. 222)
