- EnglishNothing contained in or done under the authority of a law enacted by Parliament shall be held to be inconsistent with or in contravention of section 3 or section 13 of this Constitution to the extent that the law authorises the taking during any period of public emergency of measures that are reasonably justifiable for dealing with the situation that exists in Saint Vincent during that period. Emergency powers do not include the power to suspend or abrogate the Constitution, dissolve the Legislature, or suspend or dismiss the Judiciary; and no constitutionals amendment shall be promulgated during a state of emergency. Where the Legislature is not in session, it must be convened immediately in special session and remain in session during the entire period of the state of emergency.
b. The writ of habeas corpus shall remain available and exercisable at all times and shall not be suspended on account of any state of emergency. It shall be enjoyed in the most free, easy, inexpensive, expeditious and ample manner. Any person who suffers from a violation of this right may challenge such violation in a court of competent jurisdiction. (Art. 87)

(1) In the Republic of Moldova no law may be adopted which might curtail or restrict the fundamental rights and freedoms of the individual and citizen.
(2) The exercise of the rights and freedoms may not be subdued to other restrictions unless for those provided by the law, which are in compliance with the unanimously recognised norms of the international law and are requested in such cases as: the defence of national security, territorial integrity, economic welfare of the country, public order aiming at preventing mass riots and crimes, protection of the rights, freedoms and dignity of other persons, prevention of disclosing confidential information or the guarantee of the power and impartiality of justice.
(3) The provisions under para. (2) does not allow the restrictions of the rights laid down in Articles 20-24.
(4) The restriction has to be proportionate to the situation that caused it and shall not affect the existence of the right or freedom. (Art. 54) - Moldovian
(1) În Republica Moldova nu pot fi adoptate legi care ar suprima sau ar diminua drepturile şi libertăţile fundamentale ale omului şi cetăţeanului.
(2) Exerciţiul drepturilor şi libertăţilor nu poate fi supus altor restrîngeri decît celor prevăzute de lege, care corespund normelor unanim recunoscute ale dreptului internaţional şi sînt necesare în interesele securităţii naţionale, integrităţii teritoriale, bunăstării economice a ţării, ordinii publice, în scopul prevenirii tulburărilor în masă şi infracţiunilor, protejării drepturilor, libertăţilor şi demnităţii altor persoane, împiedicării divulgării informaţiilor confidenţiale sau garantării autorităţii şi imparţialităţii justiţiei.
(3) Prevederile alineatului (2) nu admit restrîngerea drepturilor proclamate în articolele 20-24.
(4) Restrîngerea trebuie să fie proporţională cu situaţia care a determinat-o şi nu poate atinge existenţa dreptului sau a libertăţii. (Art. 54)

- EnglishDuring a state of emergency, the President may, by law or orders, take any measures that shall not derogate from the provisions of this Constitution except as provided herein:
a. to suspend part of the Bill of Rights. However, there shall be no infringement on the right to life, prohibition against slavery, prohibition against torture, the right of non-discrimination on the basis of race, sex, religious creed, the right to litigation or the right to fair trial;
b. to dissolve or suspend any institution of the National Executive;
c. to dissolve or suspend any of the state organs or suspend such powers conferred upon the states under this Constitution; and
d. to take any such measures as deemed necessary to the state of emergency, which shall have the force of law. (Art. 190)
