Whereas every person in Solomon Islands is entitled to the fundamental rights and freedoms of the individual, that is to say, the right, whatever his race, place of origin, political opinions, colour, creed or sex, but subject to respect for the rights and freedoms of others and for the public interest,

the provisions of this Chapter shall have effect for the purpose of affording protection of those rights and freedoms subject to such limitations of that protection as are contained in those provisions, being limitations designed to ensure that the enjoyment of the said rights and freedoms by an individual does not prejudice the rights and freedoms of others or the public interest. None of the provisions of the present Constitution may be interpreted in a way detrimental to the rights and interests of the Republic of Uzbekistan and the basic principles and norms stipulated in section one of this Constitution.
Laws and other normative legal acts of the Republic of Uzbekistan shall be adopted on the basis of and in fulfillment of the Constitution of the Republic of Uzbekistan. None of the laws or other normative legal acts may run counter to the norms and principles of the Constitution. (Art. 16) - Uzbek

During the period in which the state of siege decreed under article 137, I, is in force, only the following measures may be taken against persons:
I – obligation to remain at a specific place;
II – detention in a building not intended for persons accused of or convicted for common crimes;
III – restrictions regarding the inviolability of correspondence, the secrecy of communications, the rendering of information and the freedom of press, radio broadcasting and television, as established by law;
IV – suspension of freedom of assembly;
V – home search and seizure;
VI – intervention in public utility companies;

- English(1) The fundamental civil rights shall be irrevocable.
(2) Rights shall not be abused, nor shall they be exercised to the detriment of the rights or the legitimate interests of others.
(3) Following a proclamation of war, martial law or a state of emergency the exercise of individual civil rights may be temporarily curtailed by law, except for the rights established by Art. 28, Art. 29, Art. 31 paras 1, 2 and 3, Art. 32 para 1, and Art. 37. - English(1) Without prejudice to the power of Parliament to make provision in any situation or the provisions of section 38, nothing contained in or done under the authority of a law shall be held to be inconsistent with or in contravention of any provision of this Chapter to the extent that the law authorises the taking, during any period of public emergency, of measures that are reasonably justifiable for dealing with the situation that exists during that period.
(2) A law that is passed during a period of public emergency and is expressly declared to have effect only during that period shall have effect in terms provided in the section of this Chapter under which that law is passed. (Sec. 37)
