- English(1) Where a Proclamation of Emergency is in operation, the President may by order declare that the right to move any court for the enforcement of such of the rights conferred by Part III (except articles 20 and 21) as may be mentioned in the order and all proceedings pending in any court for the enforcement of the rights so mentioned shall remain suspended for the period during which the Proclamation is in force or for such shorter period as may be specified in the order.
(1A) While an order made under clause (1) mentioning any of the rights conferred by Part III (except articles 20 and 21) is in operation, nothing in that Part conferring those rights shall restrict the power of the State as defined in the said Part to make any law or to take any executive action which the State would but for the provisions contained in that Part be competent to make or to take, but any law so made shall, to the extent of the incompetency, cease to have effect as soon as the order aforesaid ceases to operate, except as respects things done or omitted to be done before the law so ceases to have effect:
Provided that where a Proclamation of Emergency is in operation only in any part of the territory of India, any such law may be made, or any such executive action may be taken, under this article in relation to or in any State or Union territory in which or in any part of which the Proclamation of Emergency is not in operation, if and in so far as the security of India or any part of the territory thereof is threatened by activities in or in relation to the part of the territory of India in which the Proclamation of Emergency is in operation.
… (Art. 359) - Hindi(1) जहां आपात की उद्घोषणा प्रवर्तन में है वहाँ राष्ट्रपति, आदेश द्वारा यह घोषणा कर सकेगा कि अनुच्छेद 20 और अनुच्छेद 21 को छोड़ कर भाग 3 द्वारा प्रदत्त ऐसे अधिकारों को प्रवर्तित कराने के लिए, जो उस आदेश में उल्लिखित किए जाएँ, किसी न्यायालय को समावेदन करने का आधिकार और इस प्रकार उल्लिखित अधिकारों को प्रवर्तित कराने के लिए किसी न्यायालय में लंबित सभी कार्यवाहियाँ उस अवधि के लिए जिसके दौरान उद्घोषणा प्रवृत्त रहती है या उससे लघुतर ऐसी अवधि के लिए जो आदेश में विनिर्दिष्ट की जाए, निलंबित रहेंगी।

परंतु जहां आपात की उद्घोषणा भारत के राज्यक्षेत्र के केवल किसी भाग में प्रवर्तन में है वहाँ, यदि और जहां तक भारत या उसके राज्यक्षेत्र के किसी भाग की सुरक्षा, भारत के राज्यक्षेत्र के उस भाग में या उसके संबंध में, जिसमें आपात की उद्घोषणा प्रवर्तन में है, होने वाले क्रियाकलाप के कारण संकट में है तो और वहाँ तक, ऐसे राज्य या संघ राज्यक्षेत्र में या उसके संबंध में, जिसमें या जिसके किसी भाग में आपात की उद्घोषणा प्रवर्तन में नहीं है, इस अनुच्छेद के अधीन ऐसी कोई विधि बनाई जा सकेगी या ऐसी कोई कार्यपालिका कार्रवाई की जा सकेगी।

- EnglishHuman rights and fundamental freedoms provided by this Constitution may exceptionally be temporarily suspended or restricted during a war and state of emergency. Human rights and fundamental freedoms may be suspended or restricted only for the duration of the war or state of emergency, but only to the extent required by such circumstances and inasmuch as the measures adopted do not create inequality based solely on race, national origin, sex, language, religion, political or other conviction, material standing, birth, education, social status or any other personal circumstance.
The provision of the preceding paragraph does not allow any temporary suspension or restriction of the rights provided by Articles 17, 18, 21, 27, 28, 29 and 41. (Art. 16) - SloveneS to ustavo določene človekove pravice in temeljne svoboščine je izjemoma dopustno začasno razveljaviti ali omejiti v vojnem in izrednem stanju. Človekove pravice in temeljne svoboščine se smejo razveljaviti ali omejiti le za čas trajanja vojnega ali izrednega stanja, vendar v obsegu, ki ga tako stanje zahteva, in tako, da sprejeti ukrepi ne povzročajo neenakopravnosti, ki bi temeljila le na rasi, narodni pripadnosti, spolu, jeziku, veri, političnem ali drugem prepričanju, gmotnem stanju, rojstvu, izobrazbi, družbenem položaju ali katerikoli drugi osebni okoliščini.

- EnglishIn the case of the national sovereignty or the territorial integrity being seen as in grave and imminent danger by external armed aggressions, the Executive Power, without prejudice to the inherent abilities of his office, may request from the National Congress the declaration of State of Defense. 11. The right to the recognition of juridical personality, following the provisions of Articles 43 and 55, number 7.
12. The judicial, process, and institutional guarantees indispensable for the protection of those rights, following the provisions of Article 69, 71, and 72. 11) El derecho al reconocimiento de la personalidad jurídica, según las disposiciones de los artículos 43 y 55, numeral 7);
12) Las garantías judiciales, procesales e institucionales indispensables para la protección de estos derechos, según las disposiciones de los artículos 69, 71 y 72. (Art. 263)

- English(1) If an Act of Parliament recites that action has been taken or threatened by any substantial body of persons, whether inside or outside the Federation—
(a) to cause, or to cause a substantial number of citizens to fear, organized violence against persons or property; or
(b) to excite disaffection against the Yang di-Pertuan Agong or any Government in the Federation; or
(c) to promote feelings of ill-will and hostility between different races or other classes of the population likely to cause violence; or
(d) to procure the alteration, otherwise than by lawful means, of anything by law established; or
(e) which is prejudicial to the maintenance or the functioning of any supply or service to the public or any class of the public in the Federation or any part thereof; or
(f) which is prejudicial to public order in, or the security of, the Federation or any part thereof,
any provision of that law designed to stop or prevent that action is valid notwithstanding that it is inconsistent with any of the provisions of Article 5, 9, 10 or 13, or would apart from this Article be outside the legislative power of Parliament; and Article 79 shall not apply to a Bill for such an Act or any amendment to such a Bill.

maka apa-apa peruntukan undang-undang itu yang bermaksud untuk memberhentikan atau mencegah tindakan itu adalah sah walaupun peruntukan itu tidak selaras dengan mana-mana peruntukan Perkara 5, 9, 10 atau 13, atau walaupun, jika tidak kerana Perkara ini, peruntukan itu akan terkeluar daripada kuasa perundangan Parlimen; dan Perkara 79 tidaklah terpakai bagi Rang Undang-Undang untuk sesuatu Akta yang sedemikian atau bagi apa-apa pindaan kepada sesuatu Rang Undang-Undang yang sedemikian.

- English1. In this Chapter “period of public emergency” means any period during which-
a. Kiribati is at war; or
b. there is in force a proclamation made under this section.
2. The Beretitenti, acting in accordance with the advice of the Cabinet, may at any time declare that a state of public emergency exists and make regulations for the purpose of dealing with the public emergency.

5. Nothing contained in or done under the authority of any law or regulation shall be held to be inconsistent with or in contravention of section 5, 6(2), 9, 11, 12, 13, 14, or 15 of this Constitution to the extent that the law or regulation in question makes in relation to any period of public emergency provision, or authorizes the doing during any such period of any thing, that is reasonably justifiable in the circumstances of any situation arising or existing during the period for the purpose of dealing with that situation.

- English(1) Subject to paragraphs (3) and (6), every person, as contemplated by the respective international treaties set out in the Fourth Schedule to which Guyana has acceded is entitled to the human rights enshrined in the said international treaties, and such rights shall be respected and upheld by the executive, legislature judiciary and all organs and agencies of Government and, where applicable to them, by all natural and legal persons and shall be enforceable in the manner hereinafter prescribed.

(5) Nothing contained in this article shall be construed so as to abrogate any human right, not enumerated herein, which a person had at the time of the commencement of this Article.
(6) The State may divest itself or otherwise limit the extent of its obligation under any of the treaties listed in the Fourth Schedule, provided that two thirds of the elected members of the National Assembly have voted in favour of such divestment or limitation. (Art. 154A)

- English(1) Nothing contained in Articles 15, 16, 17, 18, 19, and 24 shall, while a proclamation of Emergency is in force, restrict the power of the State as defined in Article 7 to make any law or to take any executive action which it would, but for the provisions in the said Articles, be competent to make or to take, but any law so made shall, to the extent of the incompetency, cease to have effect, and shall be deemed to have been repealed, at the time when the Proclamation is revoked or has ceased to be in force.
(2) While a Proclamation of Emergency is in force, the President may, by Order, declare that the right to move any court for the enforcement of such of the Fundamental Rights conferred by Chapter 1 of Part II7 as may be specified in the Order, and any proceeding in any court which is for the enforcement, or involves the determination of any question as to the infringement, of any of the Rights so specified, shall remain suspended for the period during which the Proclamation is in force, and any such Order may be made in respect of the whole or any part of Pakistan.

(٢) جس دوران ہنگامی حالت کا اعلان نافذالعمل ہو، صدر بذریعہ فرمان یہ اعلان کرسکے گا کہ حصہ دوم کے باب اول کی رو سے عطاکردہ بنیادی حقوق میں سے ان کے نفاذ کے لئے جن کی فرمان میں صراحت کر دی جائے کسی عدالت سے رجوع کرنے کا حق اور کسی عدالت میں کوئی کاروائی جو اس طرح مصرحہ حقوق میں سے کسی کے نفاذ کے لئے ہو یا جس میں اس حقوق میں سے کسی کی خلاف ورزی کے متعلق کسی سوال کا تعین مطلوب ہو، اس مدت کے لئے معطل رہے گی جس کے دوران مذکورہ اعلان نافذالعمل رہے اور ایسا کوئی فرمان پورے پاکستان یا اس کے کسی حصہ کے بارے میں صادر کیا جا سکے گا۔
