Limitations and/or Derogations
- EnglishIn no case, even when the state of siege or the state of urgency has been proclaimed in accordance with Articles 85 and 86 of this Constitution, can there be derogation of the rights and fundamental principles enumerated as follows:
1. the right to life;
2. the prohibition of torture and of cruel, inhuman or degrading punishments or treatment;
3. the prohibition of slavery and of servitude;
4. the principle of the legality of infractions and of penalties;
5. the right to [a] defense and the right to recourse;
6. the prohibition of imprisonment for debts;
7. the freedom of thought, of conscience and of religion. (5) During a period of public emergency, the President may make such regulations and take such measures as appear to him to be necessary or expedient for the purpose of maintaining and securing peace, order and good government in Sierra Leone or any part thereof.
(6) Without derogating from the generality of the powers conferred by subsection (5) and notwithstanding the provisions of this Chapter, the regulations or measures may, so far as appears to the President to be necessary or expedient for any of the purposes mentioned in that subsection—
a. make provision for the detention of persons, the restriction of the movement of persons within defined localities, and the deportation and exclusion of persons other than citizens of Sierra Leone from Sierra Leone or any part thereof;
b. authorise—
i. the taking of possession or control on behalf of the Government of any property or undertaking;
ii. the acquisition on behalf of the Government of any property other than land;
c. authorise the entering and search of any premises;
d. amend any law, suspend the operation of any law, and apply any law with or without modification:
Provided that such amendment, suspension or modification shall not apply to this Constitution;
e. provide for charging, in respect of the grant or issue of any licence, permit, certificate or other document for the purpose of the regulations, such fees as may be prescribed by or under the regulations;
f. provide for payment of compensation and remuneration to persons affected by the regulations;
g. provide for the apprehension, trial and punishment of persons offending against the regulations;
h. provide for maintaining such supplies and services as are, in the opinion of the President, essential to the life and well-being of the community:
Provided that nothing in this subsection shall authorise the making of regulations during a period of public emergency for the trial of persons who are not members of defence forces by military courts.

(18) Nothing contained in or done under the authority of any law shall be held to be inconsistent with or in contravention of this section to the extent that the law in question authorises the taking during a period of a state of public emergency of measures that are reasonably justifiable for the purpose of dealing with the situation that exists immediately before and during that period of a state of public emergency. - EnglishWhile a Proclamation of Emergency is in operation, nothing in articles 36, 37, 38, 39, 40 and 42 shall restrict the power of the State to make any law or to take any executive action which the State would, but for the provisions contained in Part III of this Constitution, be competent to make or to take, but any law so made shall, to the extent of the incompetency, cease to have effect as soon as the Proclamation ceases to operate, except as respects things done or omitted to be done before the law so ceases to have effect. 4. a. When a state of emergency is declared, the Council of Ministers shall, in accordance with regulations it issues, have all necessary power to protect the country's peace and sovereignty, and to maintain public security, law and order.
b. The Council of Ministers shall have the power to suspend such political and democratic rights contained in this Constitution to the extent necessary to avert the conditions that required the declaration of a state of emergency.
c. In the exercise of its emergency powers the Council of Ministers cannot, however, suspend or limit the rights provided for in Articles 1, 18, 25, and sub-Articles 1 and 2 of Article 39 of this Constitution.
5. The House of Peoples' Representatives, while declaring a state of emergency, shall simultaneously establish a State of Emergency Inquiry Board, comprising of seven persons to be chosen and assigned by the House from among its members and from legal experts.
6. The State of Emergency Inquiry Board shall have the following powers and responsibilities:
a. To make public within one month the names of all individuals arrested on account of the state of emergency together with the reasons for their arrest.
b. To inspect and follow up that no measure taken during the state of emergency is inhumane.
c. To recommend to the Prime Minister or to the Council of Ministers corrective measures if it finds any case of inhumane treatment.
d. To ensure the prosecution of perpetrators of inhumane acts.
e. To submit its views to the House of Peoples' Representatives on a request to extend the duration of the state of emergency. (Art. 93) - Amharic…
4. ሀ/ የአስቸኳይ ጊዜ አዋጅ በሚታወጅበት ጊዜ የሚኒስትሮች ምክር ቤት በሚያወጣቸው ደንቦች መሰረት የሀገርን ሰላምና ሕልውና፣ የሕዝብን ደህንነት፣ሕግና ሥርዓትን የማስከበር ሥልጣን ይኖረዋል፡፡
ለ/ የሚኒስትሮች ምክር ቤት ሥልጣን በሕገ መንግሥቱ የተቀመጡትን መሰረታዊ የፖለቲካና የዴሞክራሲ መብቶችን፣ የአስቸኳይ ጊዜ አዋጁን ለማወጅ ምክንያት የሆነውን ጉዳይ ለማስወገድ ተፈላጊ ሆኖ በተገኘውደረጃ፣ እስከ ማገድ ሊደርስ የሚችል ነው፡፡

(1) In the Republic of Moldova no law may be adopted which might curtail or restrict the fundamental rights and freedoms of the individual and citizen.
(2) The exercise of the rights and freedoms may not be subdued to other restrictions unless for those provided by the law, which are in compliance with the unanimously recognised norms of the international law and are requested in such cases as: the defence of national security, territorial integrity, economic welfare of the country, public order aiming at preventing mass riots and crimes, protection of the rights, freedoms and dignity of other persons, prevention of disclosing confidential information or the guarantee of the power and impartiality of justice.
(3) The provisions under para. (2) does not allow the restrictions of the rights laid down in Articles 20-24.
(4) The restriction has to be proportionate to the situation that caused it and shall not affect the existence of the right or freedom. (Art. 54) - Moldovian
(1) În Republica Moldova nu pot fi adoptate legi care ar suprima sau ar diminua drepturile şi libertăţile fundamentale ale omului şi cetăţeanului.
(2) Exerciţiul drepturilor şi libertăţilor nu poate fi supus altor restrîngeri decît celor prevăzute de lege, care corespund normelor unanim recunoscute ale dreptului internaţional şi sînt necesare în interesele securităţii naţionale, integrităţii teritoriale, bunăstării economice a ţării, ordinii publice, în scopul prevenirii tulburărilor în masă şi infracţiunilor, protejării drepturilor, libertăţilor şi demnităţii altor persoane, împiedicării divulgării informaţiilor confidenţiale sau garantării autorităţii şi imparţialităţii justiţiei.
(3) Prevederile alineatului (2) nu admit restrîngerea drepturilor proclamate în articolele 20-24.
(4) Restrîngerea trebuie să fie proporţională cu situaţia care a determinat-o şi nu poate atinge existenţa dreptului sau a libertăţii. (Art. 54)
