- English1. Subject to subarticle (2) regulations made by the Council of Ministers in accordance with Article 694 shall have effect notwithstanding the provisions of Chapter 2, Part I5 except that no regulation shall –
a. derogate from the right to life and the freedom from inhuman treatment and forced labour; and
b. make provision for the detention of a person without trial for more than 1 month unless such person is an enemy alien.
2. Regulations made by the Council of Ministers in accordance with Article 69 shall be such as are reasonably necessary in the circumstances of the emergency to which they relate and as are justifiable in a democratic society. - EnglishThe interpretation and regulation of the fundamental rights and guarantees, recognized in the present Constitution, shall be ruled by the following principles:
1. They do not have limiting character and consequently, do not exclude other rights and guarantees of an equal nature.
2. Only by law, in the cases permitted by this Constitution, may the exercise of the fundamental rights and guarantees be regulated, respecting their essential content and the principle of reasonableness.
3. Treaties, pacts, and conventions related to human rights, adopted and ratified by the Dominican State have constitutional hierarchy and are for direct and immediate application by the courts and other organs of the State.
4. The public powers interpret and apply the norms related to fundamental rights and their guarantees, in the sense most favorable to the person in possession of the same, in the case of conflict between fundamental rights, they shall attempt to harmonize the assets and interests protected by this Constitution. 1. During the state of war or state of emergency the rights and freedoms provided for in Articles: 15; 18; 19; 20; 21; 24; 25; 29; 30; 31; 32; 34; 39, paragraph 1; 41, paragraphs 1, 2, 3, and 5; 42; 43; 48; 54; 55 may not be limited.
2. During the state of natural disaster the rights and freedoms provided for in Articles: 37; 38; 41, paragraph 4; 49; 51 may be limited.

- English1. The President of the Republic, when the circumstances demand it, can declare by way of decree the state of alarm, the state of exception or that of siege, informing the Chamber of the Deputies and the Senate.
2. The proclamation of the state of alarm, of exception or of siege must expressly determine the effects of it and, the territorial scope to which its duration is extended.
3. The law regulates the states of alarm, of exception and of siege, as well as the corresponding competences and limitations.
4. While any of the states comprehended in this Article have been declared[,] the dissolution of the Chambers of Parliament may not proceed.
5. For the creation [actuaci6n] of armed bands or of terrorist elements, with the necessary judicial intervention and the adequate parliamentary control, the rights and guarantees recognized in this Fundamental Law can be suspended in individual or collective form for specific persons[,] in accordance with the Law. (2) The provisions of Title 1 of Part 26 shall have effect for the purpose of affording protection to the aforesaid fundamental rights and freedoms of the individual subject to such limitations of that protection as are contained in those provisions, being limitations designed to ensure that the enjoyment of the said rights and freedoms by any individual does not prejudice the rights and freedoms of others or the public interest. (4) Nothing in, or done under the authority of, a law shall be held to be inconsistent with, or in contravention of, this article to the extent that the law in question makes provision—
(a) for the imposition of restrictions by order of a court, that are required in the interest of defence, public safety or public order, on the movement or residence within Ghana of any person; or
(b) for the imposition of restrictions, by order of a court, on the movement or residence within Ghana of any person either as a result of his having been found guilty of a criminal offence under the laws of Ghana or for the purposes of ensuring that he appears before a court at a later date for trial for a criminal offence or for proceedings relating to his extradition or lawful removal from Ghana; or
(c) for the imposition of restrictions that are reasonably required in the interest of defence, public safety, public health or the running of essential services, on the movement or residence within Ghana of any person or persons generally, or any class of persons; or
(d) for the imposition of restrictions on the freedom of entry into Ghana, or of movement in Ghana, of a person who is not a citizen of Ghana; or
(e) that is reasonably required for the purpose of safeguarding the people of Ghana against the teaching or propagation of a doctrine which exhibits or encourages disrespect for the nationhood of Ghana, the national symbols and emblems, or incites hatred against other members of the community;
except so far as that provision or, as the case may be, the thing done under the authority of that law is shown not to be reasonably justifiable in terms of the spirit of this Constitution.
