(1) No person shall be appointed by the President as the Chairman or a member of any of the Commissions specified in the Schedule to this Article, except on a recommendation of the Council.
(2) The provisions of paragraph (1) of this Article shall apply in respect of any person appointed to act as the Chairman or as a member of any such Commission.
(3) It shall be the duty of the Council to recommend to the President fit and proper persons for appointment as Chairmen or members of the Commissions specified in the Schedule to this Article, whenever the occasion for such appointments arises, and such recommendations shall endeavour to ensure that such recommendations reflect the pluralistic character of Sri Lankan society, including gender. In the case of the Chairmen of such Commissions, the Council shall recommend three persons for appointment, and the President shall appoint one of the persons recommended as Chairman.

(2) The Commission shall consist of—
(a) the Chief Justice, who shall be the chairperson of the Commission;
(b) one Supreme Court judge elected by the judges of the Supreme Court;
(c) one Court of Appeal judge elected by the judges of the Court of Appeal;
(d) one High Court judge and one magistrate, one a woman and one a man, elected by the members of the association of judges and magistrates;
(e) the Attorney-General;
(f) two advocates, one a woman and one a man, each of whom has at least fifteen years’ experience, elected by the members of the statutory body responsible for the professional regulation of advocates;
(g) one person nominated by the Public Service Commission; and
(h) one woman and one man to represent the public, not being lawyers, appointed by the President with the approval of the National Assembly.

The unconditional equality of all Nicaraguans in the enjoyment of political rights[,] is established; in the exercise of them and in the fulfillment of their duties and responsibilities, [there] exists absolute equality between the man and the woman.
