2. If the Constitutional Court declares that any rule contained in a piece of legislation, treaty, convention or international agreement is unconstitutional, it must be vetoed by the President of the Republic and returned to the body which had approved it.
3. In cases provided for under the previous point, the legislation, treaty, convention or international agreement may not be enacted, ratified or signed, as appropriate, unless the body that passed it expunges the rule that has been deemed unconstitutional.

The Council of State gives its opinion on the bills and proposals of law as well as on the amendments which might be proposed.
If it considers that a bill or proposal of law includes provisions which are nonconform with the Constitution, with the international treaties to which the Grand Duchy of Luxembourg is a party, with the juridical acts of the European Union or with the general principles of law [droit], it mentions it in its opinion.

2. The organic or formal unconstitutionality of international treaties or agreements that deal with matters falling within the jurisdiction reserved to the National Assembly or within the legislative power of the Government shall not impair the application of the rules of such treaties and agreements in the Cabo Verdean legal order, in case they are confirmed by the Government and approved by the National Assembly by a two-third majority of the Deputies present in the first plenary session following the date of the publication of the court’s decision.

To this end, the Government will submit them to the Court, within the six days subsequent to the sanction of the law.
