- English(1) The Constitutional Court—
(a) is the highest court in all constitutional matters, and its decisions on those matters bind all other courts;
(b) decides only constitutional matters and issues connected with decisions on constitutional matters, in particular references and applications under section 131(8)(b) and paragraph 9(2) of the Fifth Schedule3; and
(c) makes the final decision whether a matter is a constitutional matter or whether an issue is connected with a decision on a constitutional matter.
(2) Subject to this Constitution, only the Constitutional Court may—
(a) advise on the constitutionality of any proposed legislation, but may do so only where the legislation concerned has been referred to it in terms of this Constitution;

(d) determine whether Parliament or the President has failed to fulfil a constitutional obligation.
(3) The Constitutional Court makes the final decision whether an Act of Parliament or conduct of the President or Parliament is constitutional, and must confirm any order of constitutional invalidity made by another court before that order has any force.
(4) An Act of Parliament may provide for the exercise of jurisdiction by the Constitutional Court and for that purpose may confer the power to make rules of court.
(5) Rules of the Constitutional Court must allow a person, when it is in the interests of justice and with or without leave of the Constitutional Court—
(a) to bring a constitutional matter directly to the Constitutional Court;
(b) to appeal directly to the Constitutional Court from any other court;
(c) to appear as a friend of the court. (Sec. 167)

- English1. Preventive review of the constitutionality may be requested from the Constitutional Court:
a) By the President of the Republic, in respect of any rule contained in an international treaty or agreement that is referred to it for ratification, as well as in respect of any provision of legislation it has been sent for promulgation as a law, legislative decree or decree-law;
b) By, at least, fifteen Deputies in full exercise of their functions or by the Prime Minister in respect of any rule contained in a legislation act sent to the President for promulgation as law subject to approval by a qualified majority.

In cases when there are grounds to believe that a law or another legal act that should be applied in a concrete case is in conflict with the Constitution, the judge shall suspend the consideration of the case and shall apply to the Constitutional Court, requesting that it decide whether the law or another legal act in question is in compliance with the Constitution. - EnglishThe Federal Supreme Court shall have jurisdiction over the following:
First: Overseeing the constitutionality of laws and regulations in effect.
Second: Interpreting the provisions of the Constitution.
Third: Settling matters that arise from the application of the federal laws, decisions, regulations, instructions, and procedures issued by the federal authority. The law shall guarantee the right of direct appeal to the Court to the Council of Ministers, those concerned individuals, and others.
Fourth: Settling disputes that arise between the federal government and the governments of the regions and governorates, municipalities, and local administrations.
Fifth: Settling disputes that arise between the governments of the regions and governments of the governorates.
Sixth: Settling accusations directed against the President, the Prime Minister and the Ministers, and this shall be regulated by law.

A. Settling competency disputes between the federal judiciary and the judicial institutions of the regions and governorates that are not organized in a region.

اولاً:ـ الرقابة على دستورية القوانين والانظمة النافذة.

سابعاً :ـ المصادقة على النتائج النهائية للانتخابات العامة لعضوية مجلس النواب.
ثامناً :ـ
أ ـ الفصل في تنازع الاختصاص بين القضاء الاتحادي، والهيئات القضائية للأقاليم والمحافظات غير المنتظمة في أقليم.
ب ـ الفصل في تنازع الاختصاص فيما بين الهيئات القضائية للأقاليم، أو المحافظات غير المنتظمة في أقليم. (المادة 93)
