- English1. While the Constitutional Court is not legally installed, the administration of justice in matters of a legal and constitutional nature continues to be carried out by the Supreme Court of Justice that shall have the power:
a) To review for constitutionality and legality pursuant to Articles 277 and others thereafter, except as foreseen in paragraph 1, subparagraph b) of Article 278;
b) To verify the death and declare the permanent physical or mental incapacity of the President of the Republic, as well as declare temporary impediments to the exercise of his or her duties;
c) To verify the loss of office of the President in cases of conviction of crimes committed in the exercise of functions and in other cases foreseen in the Constitution;
d) To verify the death and declare the incapacity for the exercise of the presidential function by any candidate for President of the Republic;
e) To verify preventively the constitutionality and legality of national and local referendum proposals;
f) To perform all other functions as may be assigned by the Constitution and by the law.
2. Both the Supreme Court of Justice and the Constitutional Court, specifically, in matters concerning electoral procedures, shall have the power:
a) To receive and admit nominations for President of the Republic;
b) To judge in the final instance the regularity and validity of electoral procedures, under the terms of the law;
c) To judge, at the request of their members and under the terms of the law, appeals related to the loss of office and to the elections held in the National Assembly, in the assemblies of local administrations and, in general, in any elective collegial organs foreseen in the Constitution;
d) To perform all other functions assigned by law.
3. Both the Supreme Court of Justice and the Constitutional Court, specifically in matters concerning political party organizations, shall have the power:
a) To verify the legality of the constitution of political parties and their coalitions, as well as to assess the legality of their names, abbreviations and symbols;
b) To ensure, maintain and update the registration of political parties and their coalitions, under the terms of the law;
c) To declare the illegality of political parties and their coalitions, and order their dissolution, under the terms of the Constitution and the law;
d) To judge the challenges encountered in elections and decisions of organs of political parties that, under the terms of the law, are subject to appeal;

2. Compete, ainda, ao Supremo Tribunal de Justiça enquanto Tribunal Constitucional, especificamente, em matéria de processo eleitoral:
a) Receber e admitir candidaturas para Presidente da República;
b) Julgar em última instância a regularidade e a validade dos actos de processo eleitoral, nos termos da lei;
c) Julgar, a requerimento dos respectivos membros e nos termos da lei, os recursos relativos a perda de mandato e às eleições realizadas na Assembleia Nacional, nas assembleias das autarquias locais e, no geral, em quaisquer órgãos colegiais electivos previstos na Constituição;
d) Exercer as demais funções atribuídas por lei.
3. Compete também ao Supremo Tribunal de Justiça, enquanto Tribunal Constitucional, especificamente, em matéria de organizações político-partidárias:
a) Verificar a legalidade da constituição de partidos politicos e suas coligações, bem como apreciar a legalidade das suas denominações, siglas e símbolos;
b) Assegurar, conservar e actualizar o registo dos partidos politicos e suas coligações, nos termos da lei;
c) Declarar a ilegalidade de partidos políticos e suas coligações, ordenando a respectiva extinção, nos termos da Constituição e da lei;
d) Julgar as acções de impugnação de eleições e deliberações de órgãos de partidos políticos que, nos termos da lei, sejam recorríveis;
e) Exercer as demais funções atribuídas por lei. (Art. 294)

(1) The Constitutional Court:
a) exercises, upon appeal, the review of constitutionality over laws and decisions of the Parliament, decrees of the President, decisions and ordinances of the Government, as well as over international treaties to which the Republic of Moldova is a party;
b) gives the interpretation of the Constitution;
c) formulates its position on initiatives aimed at revising the Constitution;
d) confirms the results of republican referenda;
e) confirms the results of parliamentary and presidential elections in the Republic of Moldova;
f) ascertains the circumstances justifying the dissolution of the Parliament, the removal of the President of the Republic of Moldova or the interim office of the President, as well as the impossibility of the President of the Republic of Moldova to fully exercise his/her functional duties for more than 60 days;
g) solves the pleas of unconstitutionality of legal acts, as claimed by the Supreme Court of Justice;
h) decides over matters dealing with the constitutionality of a party.
(2) The Constitutional Court carries out its activity on the initiative brought forward by the subjects provided for by the Law on the Constitutional Court. (Art. 135) - Moldovian
(1) Curtea Constituţională:
a) exercită, la sesizare, controlul constituţionalităţii legilor şi hotărîrilor Parlamentului, a decretelor Preşedintelui Republicii Moldova, a hotărîrilor şi ordonanţelor Guvernului, precum şi a tratatelor internaţionale la care Republica Moldova este parte;

c) se pronunţă asupra iniţiativelor de revizuirea Constituţiei;

f) constată circumstanţele care justifică dizolvarea Parlamentului, demiterea Preşedintelui Republicii Moldova sau interimatul funcţiei de Preşedinte, precum şi imposibilitatea Preşedintelui Republicii Moldova de a-şi exercita atribuţiile mai mult de 60 de zile;
g) rezolvă cazurile excepţionale de neconstituţionalitate a actelor juridice, sesizate de Curtea Supremă de Justiţie;
h) hotărăşte asupra chestiunilor care au ca obiect constituţionalitatea unui partid.

- English1. Any question as to the interpretation of this Constitution shall be determined by the Court of Appeal sitting as the Constitutional Court.
2. When sitting as a Constitutional Court, the Court of Appeal shall consist of a bench of five members of that Court.
3. A person who alleges that-
a. an Act of Parliament or any other law or anything in or done under the authority of any law; or
b. any act or omission by any person or authority,
is inconsistent with or in contravention of a provision of this Constitution, may petition the Constitutional Court for a declaration to that effect, and for redress where appropriate.
4. Where upon determination of the petition under clause (3) of this article the Constitutional Court considers that there is need for redress in addition to the declaration sought, the Constitutional Court may-
a. grant an order of redress; or
b. refer the matter to the High Court to investigate and determine the appropriate redress.
5. Where any question as to the interpretation of this Constitution arises in any proceedings in a court of law other than a Field Court Martial, the Court-
a. may, if it is of the opinion that the question involves a substantial question of law; and
b. shall, if any party to the proceedings requests it to do so,
refer the question to the constitutional court for decision in accordance with clause (1) of this article.
6. Where any question is referred to the constitutional court under clause (5) of this article, the constitutional court shall give its decision on the question, and the court in which the question arises shall dispose of the case in accordance with that decision.

1. The Constitutional Court on the appeal of the President of the Republic of Kazakhstan, the Chairman of the Senate, the Chairman of the Majilis, at least one fifth of the total number of deputies of the Parliament, the Prime Minister shall:
1) decide, in case of a dispute, the issue of correctness of holding elections of the President of the Republic, deputies of the Parliament and holding a republican referendum;
2) consider the laws adopted by the Parliament for their compliance with the Constitution of the Republic before signing by the President;
2-1) consider the resolutions adopted by the Parliament and its Chambers for compliance with the Constitution of the Republic;
3) consider international treaties of the Republic for their compliance with Constitution before ratification;
4) give an official interpretation of the norms of the Constitution;
5) give conclusions in the cases provided for by paragraphs 1 and 2 of Article 47 of the Constitution.
2. The Constitutional Court shall consider the appeals of the President of the Republic in the cases provided for by subparagraph 10-1) of Article 44 of the Constitution, as well as the appeals of the courts in the cases established by Article 78 of the Constitution.
3. The Constitutional Court on the appeals of citizens, shall consider the regulatory legal acts of the Republic of Kazakhstan that directly affect their rights and freedoms, enshrined in the Constitution for compliance with the Constitution of the Republic.
The procedure and conditions for the appeals of citizens to the Constitutional Court shall be determined by the constitutional law.
4. The Constitutional Court, upon the appeals of the Prosecutor General of the Republic shall consider the issues specified in subparagraphs 3) and 4) of paragraph 1 of this article, as well as the regulatory legal acts of the Republic of Kazakhstan for their compliance with the Constitution of the Republic.
5. The Constitutional Court, on the appeal of the Commissioner for Human Rights shall consider the regulatory legal acts affecting the rights and freedoms of a person and citizen enshrined in the Constitution for compliance with the Constitution of the Republic. (Art. 72) - Kazak

The Constitutional Court shall decide on:
1. compliance of laws and other general acts with the Constitution, generally accepted rules of the international law and ratified international treaties,
2. compliance of ratified international treaties with the Constitution,
3. compliance of other general acts with the Law,
4. compliance of the Statute and general acts of autonomous provinces and local self-government units with the Constitution and the Law,
5. compliance of general acts of organizations with delegated public powers, political parties, trade unions, civic associations and collective agreements with the Constitution and the Law.
The Constitutional Court shall:
1. decide on the conflict of jurisdictions between courts and state bodies,
2. decide on the conflict of jurisdictions between republic and provincial bodies or bodies of local self-government units,
3. decide on the conflict of jurisdictions between provincial bodies and bodies of local self-government units,
4. decide on the conflict of jurisdictions between bodies of different autonomous provinces or bodies of different local self-government units,
5. decide on electoral disputes for which the court jurisdiction has not been specified by the Law,
6. perform other duties stipulated by the Constitution and the Law.
The Constitutional Court shall decide on the banning of a political party, trade union organization or civic association.

Уставни суд одлучује о:
1. сагласности закона и других општих аката са Уставом, општеприхваћеним правилима међународног права и потврђеним међународним уговорима,
2. сагласности потврђених међународних уговора са Уставом,
3. сагласности других општих аката са законом,
4. сагласности статута и општих аката аутономних покрајина и јединица локалне самоуправе са Уставом и законом,
5. сагласности општих аката организација којима су поверена јавна овлашћења, политичких странака, синдиката, удружења грађана и колективних уговора са Уставом и законом.
Уставни суд:
1. решава сукоб надлежности између судова и других државних органа,
2. решава сукоб надлежности између републичких органа и покрајинских органа или органа јединица локалне самоуправе,
3. решава сукоб надлежности између покрајинских органа и органа јединица локалне самоуправе,
4. решава сукоб надлежности између органа различитих аутономних покрајина или различитих јединица локалне самоуправе,
5. одлучује о изборним споровима за које законом није одређена надлежност судова,
6. врши и друге послове одређене Уставом и законом.
Уставни суд одлучује о забрани рада политичке странке, синдикалне организације или удружења грађана.
Уставни суд обавља и друге послове предвиђене Уставом. (Члан 167)

- English(1) Subject to the provisions of sections 22(5), 38(6), 42(8), 57(7), 115(8), 118(3) and 121(10) of this Constitution, any person who alleges that any provision of this Constitution (other than a provision of Chapter I3 thereof) has been or is being contravened may, if he has a relevant interest, apply to the High Court for a declaration and for relief under this section.
(2) The High Court shall have jurisdiction on an application made under this section to determine whether any provision of this Constitution (other than a provision of Chapter I thereof) has been or is being contravened and to make a declaration accordingly.
(3) Where the High Court makes a declaration under this section that a provision of this Constitution has been or is being contravened and the person on whose application the declaration is made has also applied for relief, the High Court may grant to that person such remedy as its considers appropriate, being a remedy available generally under the law of Dominica in proceedings in the High Court.
(4) The Chief Justice may make rules with respect to the practice and procedure of the High Court in relation to the jurisdiction and powers conferred on the Court by or under this section, including provision with respect to the time within which any application under this section may be made.
(5) A person shall be regarded as having a relevant interest for the purpose of an application under this section only if the contravention of this Constitution alleged by him is such as to affect his interests.
(6) The right conferred on a person by this section to apply for a declaration and relief in respect of an alleged contravention of this Constitution shall be in addition to any other action in respect of the same matter that may be available to that person under any other enactment or any rule of law.
(7) Nothing in this section shall confer jurisdiction on the High Court to hear or determine any such question as is referred to in section 40 of this Constitution. (Sec. 103)
