Judicial Protection
- EnglishI. The Popular Action shall be filed during the period in which the violation or threat to the rights and collective interests continues. To file this action it is not necessary to exhaust the judicial or administrative processes that might exist.
II. Any person, in his or her individual name or on behalf of a collective, may file this action, and it shall be filed obligatorily by the Public Ministry and the Public Defender (Ministerio Público y el Defensor del Pueblo) when, in the exercise of their functions, they have knowledge of these acts. The procedure for the Action for Constitutional Protection shall be applied. (Art. 136) - SpanishI. La Acción Popular podrá interponerse durante el tiempo que subsista la vulneración o la amenaza a los derechos e intereses colectivos. Para interponer esta acción no será necesario agotar la vía judicial o administrativa que pueda existir.
II. Podrá interponer esta acción cualquier persona, a título individual o en representación de una colectividad y, con carácter obligatorio, el Ministerio Público y el Defensor del Pueblo, cuando por el ejercicio de sus funciones tengan conocimiento de estos actos. (3) For the purposes of determining whether or not any law, matter or thing is reasonably justified in a democratic society that has a proper regard for the rights and dignity of mankind, a court may have regard to-
(a) the provisions of this Constitution generally, and especially the National Goals and Directive Principles and the Basic Social Obligations; and
(b) the Charter of the United Nations; and
(c) the Universal Declaration of Human Rights and any other declaration, recommendation or decision of the General Assembly of the United Nations concerning human rights and fundamental freedoms; and
(d) the European Convention for the Protection of Human Rights and Fundamental Freedoms and the Protocols thereto, and any other international conventions, agreements or declarations concerning human rights and fundamental freedoms; and
(e) judgements, reports and opinions of the International Court of Justice, the European Commission of Human Rights, the European Court of Human Rights and other international courts and tribunals dealing with human rights and fundamental freedoms; and
(f) previous laws, practices and judicial decisions and opinions in the country; and
(g) laws, practices and judicial decisions and opinions in other countries; and
(h) the Final Report of the pre-Independence Constitutional Planning Committee dated 13 August 1974 and presented to the pre-Independence House of Assembly on 16 August 1974, as affected by decisions of that House on the report and by decisions of the Constituent Assembly on the draft of this Constitution; and
(i) declarations by the International Commission of Jurists and other similar organizations; and
(j) any other material that the court considers relevant. (Sec. 39)

- EnglishAll persons have the right to an action of amparo in order to demand before the courts, for themselves or by those who act in their name, immediate protection of their fundamental rights, not protected by habeas corpus, when they are violated or threatened by the action or omission of any public authority or of individuals, in order put into effect the fulfillment of a law or administrative act and in order to guarantee collective and diffuse rights and interests. In accordance with the law, the proceeding is preferential, summary, oral, public, free, and not subject to formalities.

The acts adopted during the States of Exception that violate protected rights that unreasonably cause suspended rights are subject to actions of amparo. (Art. 72) - SpanishToda persona tiene derecho a una acción de amparo para reclamar ante los tribunales, por sí o por quien actúe en su nombre, la protección inmediata de sus derechos fundamentales, no protegidos por el hábeas corpus, cuando resulten vulnerados o amenazados por la acción o la omisión de toda autoridad pública o de particulares, para hacer efectivo el cumplimiento de una ley o acto administrativo, para garantizar los derechos e intereses colectivos y difusos. - English1. Everyone shall be guaranteed judicial protection of his/her rights and freedoms envisaged in the present Constitution, laws, international treaties to which the Kyrgyz Republic is a party as well as universally recognized principles and norms of international law.
The state shall ensure the development of extrajudicial and pre-trial methods, forms and means to protect human and civil rights and freedoms.
2. Everyone shall have the right to protect his/her rights and freedoms by any means that are not prohibited by law.

Judicial Protection
- English1. Anyone who considers that a provision of the Constitution has been infringed in relation to him may, without prejudice to any other legal remedy available to him, apply to the Supreme Court for redress.
2. The Supreme Court has jurisdiction to determine the matter and to make such order as it considers appropriate to enforce the provisions of the Constitution.
3. When a question concerning the interpretation of the Constitution arises before a subordinate court, and the court considers that the question concerns a fundamental point of law, the court shall submit the question to the Supreme Court for its determination. (Art. 53) - French1) Quiconque estime qu'une disposition de la Constitution a été violée à son encontre peut, sans préjudice des autres recours légaux ouverts, saisir la Cour Suprême pour dénoncer cette violation et obtenir réparation.
2) La Cour Suprême a compétence pour déterminer si une disposition de la Constitution a été violée et pour faire une déclaration en conséquence.
3) Lorsqu'une question relative à l'interprétation de la Constitution est soulevée devant une juridiction inférieure et que celle-ci considère que la question a trait à un point de droit fondamental, cette juridiction doit, à titre préjudiciel, soumettre cette question à la Cour Suprême. (Art. 53)
