The National Commission of the Rights of Man is a monitoring organ [organe de suivi] of the promotion and of the protection of the rights of man. (Art. 215)

The functions of the Commission shall be defined and prescribed by Act of Parliament and shall include the duty—
(a) to investigate complaints of violations of fundamental rights and freedoms, injustice, corruption, abuse of power and unfair treatment of any person by a public officer in the exercise of his official duties;
(b) to investigate complaints concerning the functioning of the Public Services Commission, the administrative organs of the State, the Armed Forces, the Police Service and the Prisons Service in so far as complaints relate to the failure to achieve a balanced structuring of those services or equal access by all to the recruitment of those services or fair administration in relation to those services;
(c) to investigate complaints concerning practices and actions by persons, private enterprises and other institutions where those complaints allege violations of fundamental rights and freedoms under this Constitution;
(d) to take appropriate action to call for the remedying, correction and reversal of instances specified in paragraphs (a), (b) and (c) of this clause through such means as are fair, proper and effective,

(f) to educate the public as to human rights and freedoms by such means as the Commissioner may decide, including publications, lectures and symposia; and
(g) to report annually to Parliament on the performance of its functions. (Art. 218)

1. There shall bear an ombudsman, whose office shall be a public office.

(1) There shall be a Human Rights Commissions that shall be mandated to:
(a) Promote respect of human rights, and the culture of human rights;
(b) Promote the protection, development, and attainment of human rights; and
(c) Monitor and assess the observance of the conduct of human rights in the Federal Republic of Somalia.
(2) In accordance with the Constitution, the Human Rights Commission shall have powers to perform the following functions:
(a) To investigate and report on the observance of human rights;
(b) To take steps to secure appropriate redress where human rights have been violated;
(c) To carry out research; and
(d) To educate the public and state officials on international standards relating to human rights.
(3) The powers and the activities of the Human Rights Commission shall be stipulated in the Human Rights Commission Act.

The Council assures a mission of surveillance, of early warning and of evaluation in matters of the respect for the Rights of Man.
Without prejudice to the attributions of the judicial power, the Council examines any situations of infringement of the Rights of Man declared or brought to itscognizance, and it engages in any appropriate action. It brings the results of its investigations to the cognizance of the administrative authorities concerned and, asneed be, before the competent jurisdictions.
The Council initiates actions of awareness [sensibilsation], of information and of communication for the promotion of the Rights of Man.
It equally emits opinions, proposals and recommendations relative to the promotion and to the protection of the Rights of Man.
The Council elaborates an annual report that it addresses to the President of the Republic. This report is published by the President of the Council.
The law establishes the composition and the modalities of appointment of the members of the Council as well as the regulations relative to its organization and to its functioning. (Art. 212)

The Defender of the People is the high commissioned [person] of the Chamber of the Deputies and of the Senate, designated by them for the defense of the rights of the citizens comprehended in this Fundamental Law, to which effect, he can supervise the activity of the Administration, giving account to the Chamber of the Deputies and to the Senate. (Art. 122)

(11) The chairperson and vice-chairperson of a commission⁶ shall not be of the same gender.

(2) Aggrieved persons who claim that a fundamental right or freedom guaranteed by this Constitution has been infringed or threatened shall be entitled to approach a competent Court to enforce or protect such a right or freedom, and may approach the Ombudsman to provide them with such legal assistance or advice as they require, and the Ombudsman shall have the discretion in response thereto to provide such legal or other assistance as he or she may consider expedient.

Subject to Article 190 herein, no derogation from the rights and freedoms enshrined in this Bill shall be made. The Bill of Rights shall be upheld, protected and applied by the Supreme Court and other competent courts; the Human Rights Commission shall monitor its application in accordance with this Constitution and the law.
