Political Parties
- EnglishPolitical parties and groups shall contribute to the exercise of suffrage. They shall be formed and carry on their activities freely. They shall respect the principles of national sovereignty and democracy.
They shall contribute to the implementation of the principle set out in the second paragraph of article 1 as provided for by statute.
Statutes shall guarantee the expression of diverse opinions and the equitable participation of political parties and groups in the democratic life of the Nation. - English(1) Every political party shall—
(a) have a national character as prescribed by an Act of Parliament;
(b) have a democratically elected governing body;
(c) promote and uphold national unity;
(d) abide by the democratic principles of good governance, promote and practise democracy through regular, fair and free elections within the party;
(e) respect the right of all persons to participate in the political process, including minorities and marginalised groups;
(f) respect and promote human rights and fundamental freedoms, and gender equality and equity;
(g) promote the objects and principles of this Constitution and the rule of law; and
(h) subscribe to and observe the code of conduct for political parties.
(2) A political party shall not—
(a) be founded on a religious, linguistic, racial, ethnic, gender or regional basis or seek to engage in advocacy of hatred on any such basis;
(b) engage in or encourage violence by, or intimidation of, its members, supporters, opponents or any other person;
(c) establish or maintain a paramilitary force, militia or similar organisation;
(d) engage in bribery or other forms of corruption; or
(e) except as is provided under this Chapter or by an Act of Parliament, accept or use public resources to promote its interests or its candidates in elections. (Art. 91) - Swahili(1) Kila chama cha siasa-

(2) Chama cha siasa-
(a) hakitaanzishwa kwa msingi wa kidini, lugha, rangi, kabila, jinsia au kikanda au kutafuta kujihusisha na uenezajii wa chuki kwa msingi wowote wa aina hiyo;
(b) kujihusisha au kuchochea vurugu kwa, ama kwa kuwatisha wanachama wake, wafuasi, wapinzani au mtu mwingine yeyote;
(c) kuanzisha au kuendesha kikundi chenye mwonekano wa kijeshi, mgambo au vyombo kama hivyo;
(d) kujihusisha na rushwa au aina nyingineyo ya ufisadi; au

- EnglishFirst: The freedom to form and join associations and political parties shall be guaranteed, and this shall be regulated by law.
Second: It is not permissible to force any person to join any party, society, or political entity, or force him to continue his membership in it. (Art. 39) - Arabicاولاً :ـ حرية تأسيس الجمعيات والاحزاب السياسية، او الانضمام اليها، مكفولةٌ، وينظم ذلك بقانون.

- English(1) The United Republic is a democratic, secular and socialist state which adheres to multi-party democracy.
(2) All matters pertaining to the registration and administration of political parties in the United Republic shall be governed by the provisions of this Constitution and of a law enacted by Parliament for that purpose. (Art. 3)

(1) Persons who are committed to common political ideology, philosophy and program may, subject to laws made pursuant to sub-clause (c) of clause (2) of Article 17, form and operate political parties, and generate, or cause to be generated, publicity in order to secure support and cooperation from public-in-general for their ideology, philosophy and program or carry out other necessary activity for this purpose.
(2) A political party formed in accordance with clause (1) shall be required to be registered the party with the Election Commission upon fulfilment of the procedures as laid down by law.
(3) A petition to be filed for the purpose of registration of a party pursuant to clause (2) shall be accompanied by the constitution and manifesto of the concerned political party and such other documents as required by federal law.
(4) For a petition to be filed for the registration of a party pursuant to clause (2), the political party shall fulfil the following conditions:-
(a) Its constitution and rules shall be required be democratic;
(b) Its constitution shall provide for election of each of the officebearers of the party at the Federal and Provincial levels at least once in every five years;
Provided that nothing shall bar the making of provision in the constitution of a political party to hold such election within six months in the event of failure to hold election of its office-bearers within five years because of occurrence a special circumstance;
(c) There shall be a provision of such inclusive representation in its executive committees at various levels as may be reflecting the diversity of Nepal.
(5) In case the name, objective, insignia or flag of a political party is of such a nature as to jeopardize the religious and communal unity of the country or to fragment the country, that party shall not be registered. (Art. 269) - Nepali
(१) समान राजनीतिक विचारधारा, दर्शन र कार्यक्रममा प्रतिबद्ध व्यक्तिहरूले धारा १७ को उपधारा (२) को खण्ड (ग) अन्तर्गत बनेको कानूनको अधीनमा रही राजनीतिक दल गठन गरी सञ्चालन गर्न र दलको विचारधारा, दर्शन र कार्यक्रमप्रति जनसाधारणको समर्थन र सहयोग प्राप्त गर्नका लागि त्यसको प्रचार र प्रसार गर्न, गराउन वा सो प्रयोजनका लागि अन्य आवश्यक काम गर्न सक्नेछन् ।
(२)उपधारा (१) बमोजिम गठन भएका राजनीतिक दलले कानून बमोजिमको कार्यविधि पूरा गरी निर्वाचन आयोगमा दल दर्ता गराउनु पर्नेछ ।
(३) उपधारा (२) बमोजिम दल दर्ता गराउने प्रयोजनका लागि निवेदन पेश गर्दा सम्बन्धित राजनीतिक दलको विधान र घोषणापत्रका अतिरिक्त संघीय कानून बमोजिमका अन्य कागजात पेश गर्नु पर्नेछ ।
(४) उपधारा (२) बमोजिम दल दर्ताका लागि निवेदन दिंदा राजनीतिक दलले देहायका शर्त पूरा गर्नु पर्नेछ :–
(क) राजनीतिक दलको विधान र नियमावली लोकतान्त्रिक हुनु पर्छ,
(ख) राजनीतिक दलको विधानमा कम्तीमा पाँच वर्षमा एक पटक सो दलका संघीय र प्रदेश तहका प्रत्येक पदाधिकारीको निर्वाचन हुने व्यवस्था हुनु पर्छ,
तर विशेष परिस्थिति उत्पन्न भई पाँच वर्षभित्रमा पदाधिकारीको निर्वाचन सम्पन्न हुन नसकेमा छ महीनाभित्र त्यस्तो निर्वाचन गर्न सकिने गरी राजनीतिक दलको विधानमा व्यवस्था गर्न बाधा पर्ने छैन ।
(ग) दलको विभिन्न तहका कार्यकारिणी समितिमा नेपालको विविधतालाई प्रतिबिम्बित गर्ने गरी समावेशी प्रतिनिधित्वको व्यवस्था गरिएको हुनु पर्छ ।
(५) कुनै राजनीतिक दलको नाम, उद्देश्य, चिन्ह वा झण्डा देशको धार्मिक वा साम्प्रदायिक एकतामा खलल पार्ने वा देशलाई विखण्डित गर्ने प्रकृतिको रहेछ भने त्यस्तो राजनीतिक दल दर्ता हुने छैन । (धारा २६९)
