The electoral system has for [its] objective to assure that elections [votaciones] translate the authentic expression, free and spontaneous of the citizenry; and that the ballots are an exact and opportune reflection of the will of the electors expressed in the ballot boxes [urnas] by direct suffrage.
It has [for its] basic functions[:] the planning, the organization and the execution of the electoral processes or [process] of referendum or other popular consultations; the maintenance and the custody of a single register of identification of persons; and the register of the acts that modify civil estate. 1. Election campaigns shall be conducted under the management of the election commisions at each level within the limit set by law, and equal opportunity shall be guaranteed.

There shall be an Election Commission which shall be responsible for the preparation, maintenance, and periodical updating of electoral rolls, the election schedule, and the supervision, direction, control, and conduct of elections to Parliament and Local Governments, as well as holding of National Referendums, in a free and fair manner.

The Electoral Commission shall have general responsibility for, and shall supervise, the registration of electors for the election of members of the Maneaba ni Maungatabu and the conduct of elections of such members and of referenda under this Constitution, and the Commission shall have such other functions relating to such registration, elections and referenda as may be prescribed.

A National Authority of Elections [Autorité Nationale des Elections], abbreviated A.N.E.[,] is instituted. (Art. 143)

1. There shall be a Chief Electoral Officer whose office shall be an office in the public service.
2. The functions of the Chief Electoral Officer shall be—
a. to register as electors the citizens of Lesotho who qualify to be registered as such;
b. to compile a general register of electors and constituency registers of electors for the several constituencies and to maintain such register or registers up to date;
c. to conduct elections of members of the National Assembly; and
d. to perform such other functions as may be conferred on him by or under any other law.

I. The Pluri-National Electoral Organ (Organo Electoral) shall be composed of:
1. The Supreme Electoral Court.
2. The Departmental Electoral Courts.
3. The Electoral Judges.
4. The Juries of the polling places.
5. The Electoral Notaries.
II. The jurisdiction, competency and powers of the Electoral Organ and its different levels are defined in this Constitution and the law. (Art. 205)

The Electoral Branch of Government shall guarantee the exercise of political rights as expressed by voting, as well as those referring to the political organization of the citizenry.
The Electoral Branch shall be comprised of the National Electoral Council and the Electoral Dispute Settlement Court. Both bodies shall have their seat in Quito and shall have national jurisdiction, administrative, financial, and organizational autonomy, and their own legal status. They shall be governed by the principles of autonomy, independence, publicity, transparency, equity, interculturalism, gender equality, swiftness and rectitude. (Art. 217)
