Only a citizen of São Toméan origin, the child of a São Toméan father or mother, more than 35 years of age, who does not possess any other nationality and who over the three years immediately prior to the date of candidacy has had permanent residence in the national territory, may be elected President of the Republic.

(a) he is a citizen of Ghana by birth;
(b) he has attained the age of forty years; and
(c) he is a person who is otherwise qualified to be elected a Member of Parliament, except that the disqualifications set out in paragraphs (c), (d), and (e) of clause (2) of article 94 of this Constitution shall not be removed, in respect of any such person, by a presidential pardon or by the lapse of time as provided for in clause (5) of that article. a. the highest and second highest number of valid votes cast in the initial ballot; or
b. an equal number of the valid votes cast in the initial ballot, being the highest votes amongst the presidential candidates that stood for election to the office of President.
