- English1. The Constitutional Court shall review and declare with general mandatory force:
a) The unconstitutionality of any rules;
b) The illegality of any provision of legislative acts on the grounds of infringement of a law of superior force;
c) The illegality of any legal rule of a regional legislative on the grounds of infringement of the Political and Administrative Statute of the Autonomous Region of Príncipe or of the general law of the Republic;
d) The illegality of any set of legal rules of legislatives issued by sovereign bodies on the grounds of infringement of the laws of the Autonomous Region of Príncipe enshrined in its Statute.
2. The Constitutional Court may be requested by the following officials to declare the unconstitutionality or the illegality, with general mandatory force:
a) The President of the Republic;
b) The Chairman of the National Assembly;
c) The Prime Minister;
d) The Attorney General of the Republic;
e) One tenth of the Deputies of the National Assembly;
f) The Regional Legislative Assembly and the President of the Regional Government of Príncipe.
3. The Constitutional Court shall review and furthermore declare, in general mandatory force, the unconstitutionality or illegality of any rule, so long as it has judged by it as unconstitutional or illegal in three concrete cases. (Art. 147) - Portuguese1. O Tribunal Constitucional aprecia e declara, com força obrigatória geral:
a) A inconstitucionalidade de quaisquer normas;
b) A ilegalidade de quaisquer normas constantes de actos legislativos com fundamento em violação da lei com valor reforçado;

2. Podem requerer ao Tribunal Constitucional a declaração da inconstitucionalidade ou de ilegalidade, com força obrigatória geral:
a) O Presidente da República;
b) O Presidente da Assembleia Nacional;
c) O Primeiro-Ministro;
d) O Procurador Geral da República;
e) Um décimo dos Deputados à Assembleia Nacional;
f) A Assembleia Legislativa Regional e o Presidente do Governo Regional do Príncipe.
3. O Tribunal Constitucional aprecia e declara ainda, com força obrigatória geral, a inconstitucionalidade ou a ilegalidade de qualquer norma, desde que tenha sido por ele julgada inconstitucional ou ilegal em três casos concretos. (Art. 147)

- EnglishAny person may file an initiative to start the procedure for the assessment of constitutionality and legality.
The procedure before the Constitutional Court for the assessment of constitutionality and legality may be initiated by the court, other state authority, local self-government authority and five Members of the Parliament.
The Constitutional Court itself may also initiate the procedure for the assessment of constitutionality and legality.
During the procedure, the Constitutional Court may order to stop the enforcement of an individual act or actions that have been taken on the basis of the law, other regulation or general act, the constitutionality, i.e. legality of which is being assessed, if the enforcement thereof could cause irreparable damage. (Art. 150) - MontenegrinSvako može dati inicijativu za pokretanje postupka za ocjenu ustavnosti i zakonitosti.
Postupak pred Ustavnim sudom za ocjenu ustavnosti i zakonitosti može da pokrene sud, drugi državni organ, organ lokalne samouprave i pet poslanika.
Ustavni sud može i sâm pokrenuti postupak za ocjenu ustavnosti i zakonitosti.
U toku postupka, Ustavni sud može narediti da se obustavi izvršenje pojedinačnog akta ili radnje koji su preduzeti na osnovu zakona, drugog propisa ili opšteg akta čija se ustavnost ili zakonitost ocjenjuje, ako bi njihovim izvršenjem mogle nastupiti neotklonjive štetne posljedice. (Član 150)

- EnglishThe Constitutional Court is the judge of the exceptions of unconstitutionality raised before or by a jurisdiction.
Any person may refer the Constitution Court to [a matter concerning] the unconstitutionality of any legislative or regulatory act.
In addition, he may refer the Constitutional Court to [a matter], by the procedure of the exception of unconstitutionality invoked in a matter concerning him before a jurisdiction.
That [jurisdiction] stays [its] decision and refers the Constitutional Court to [it], all [other] matters ceasing. (Art. 162) - FrenchLa Cour constitutionnelle est juge de l’exception d’inconstitutionnalité soulevée devant ou par une juridiction.

(3) The Constitutional Court-
(a) is the highest court of the Republic; and
(b) may decide -
(i) constitutional matters; and
(ii) any other matter, if the Constitutional Court grants leave to appeal on the grounds that the matter raises an arguable point of law of general public importance which ought to be considered by that Court; and
(c) makes the final decision whether a matter is within its jurisdiction.
(4) Only the Constitutional Court may -
(a) decide disputes between organs of state in the national or provincial sphere concerning the constitutional status, powers or functions of any of those organs of state;
(b) decide on the constitutionality of any parliamentary or provincial Bill, but may do so only in the circumstances anticipated in section 79 or 121;
(c) decide applications envisaged in section 80 or 122;
(d) decide on the constitutionality of any amendment to the Constitution;
(e) decide that Parliament or the President has failed to fulfil a constitutional obligation; or
(f) certify a provincial constitution in terms of section 144.
(5) The Constitutional Court makes the final decision whether an Act of Parliament, a provincial Act or conduct of the President is constitutional, and must confirm any order of invalidity made by the Supreme Court of Appeal, the High Court of South Africa, or a court of similar status, before that order has any force.
(6) National legislation or the rules of the Constitutional Court must allow a person, when it is in the interests of justice and with leave of the Constitutional Court—
(a) to bring a matter directly to the Constitutional Court; or
(b) to appeal directly to the Constitutional Court from any other court.
(7) A constitutional matter includes any issue involving the interpretation, protection or enforcement of the Constitution. (Sec. 167)

A party to any judicial proceedings, including proceedings on appeal, may, at any stage thereof, raise the question of the unconstitutionality of any law or decision or any provision thereof material for the determination of any matter at issue in such proceedings and thereupon the Court before which such question is raised shall reserve the question for the decision of the Supreme Constitutional Court and stay further proceedings until such question is determined by the Supreme Constitutional Court.
