- EnglishThe right of the indigenous peoples to preserve and to develop their ethnic identity in the respective habitat is recognized and guaranteed. They have the right, likewise, to freely apply their systems of political, social, economic, cultural, and religious organization, as well as the voluntarily subjection to their customary norms for the regulation of [their] internal coexistence [convivencia], as long as they do not infringe upon the fundamental rights established in this Constitution. Concerning conflicts of jurisdiction the indigenous customary right will be taken into account. (Art. 63)
- SpanishQueda reconocido y garantizado el derecho de los pueblos indígenas a preservar y a desarrollar su identidad étnica en el respectivo hábitat. Tienen derecho, asimismo, a aplicar libremente sus sistemas de organización política, social, económica, cultural y religiosa, al igual que la voluntaria sujeción a sus normas consuetudinarias para la regulación de la convivencia interior siempre que ellas no atenten contra los derechos fundamentales establecidos en esta Constitución. The State recognizes, respects, and promotes their forms of life, customs, traditions, forms of social organization, the use of the indigenous attire by men and women, [and their] languages and dialects. The administration of justice guarantees the principle of legality; it protects [protege] and protects [tutela] the human rights, and guarantees the access to justice through the application of the law in the matters and processes of its competence.
The administration of justice recognizes citizen participation through the traditional leaders of the original Peoples of the Caribbean Coast and the Judicial Facilitators [Facilitadores Judiciales] in all the country, as alternative methods of access to justice and alternative resolution of conflicts, all in accordance with the law.

La administración de la justicia garantiza el principio de la legalidad; protege y tutela los derechos humanos, y garantiza el acceso a la justicia mediante la aplicación de la ley en los asuntos o procesos de su competencia.
La administración de justicia reconoce la participación ciudadana a través de los líderes tradicionales de los pueblos originarios de la Costa Caribe y los Facilitadores Judiciales en todo el país, como métodos alternos de acceso a la justicia y resolución alterna de conflictos, todo de conformidad con la ley.

- EnglishI. The rural native indigenous jurisdiction is based on the specific connection between the persons who are members of the respective nation or rural native indigenous people.
II. The rural native indigenous jurisdiction is exercised in the following areas of personal, material and territorial legal effect:
1. Members of the nation or rural native indigenous people are subject to this jurisdiction whether they act as plaintiffs or defendants, claimants or accusers, whether they are persons who are denounced or accused, or are appellants or respondents.
2. This jurisdiction hears rural native indigenous matters pursuant to that established in a law of Jurisdictional Demarcation.
3. This jurisdiction applies to the relations and juridical acts that are carried out, or the effects of which are produced, within the jurisdiction of a rural native indigenous people. (Art. 191) - SpanishI. La jurisdicción indígena originario campesina se fundamenta en un vínculo particular de las personas que son miembros de la respectiva nación o pueblo indígena originario campesino.
II. La jurisdicción indígena originario campesina se ejerce en los siguientes ámbitos de vigencia personal, material y territorial:
1. Están sujetos a esta jurisdicción los miembros de la nación o pueblo indígena originario campesino, sea que actúen como actores o demandado, denunciantes o querellantes, denunciados o imputados, recurrentes o recurridos.
2. Esta jurisdicción conoce los asuntos indígena originario campesinos de conformidad a lo establecido en una Ley de Deslinde Jurisdiccional.
3. Esta jurisdicción se aplica a las relaciones y hechos jurídicos que se realizan o cuyos efectos se producen dentro de la jurisdicción de un pueblo indígena originario campesino. (Art. 191)

- EnglishThe authorities of the indigenous communities, peoples, and nations shall perform jurisdictional duties, on the basis of their ancestral traditions and their own system of law, within their own territories, with a guarantee for the participation of, and decision-making by, women. The authorities shall apply their own standards and procedures for the settlement of internal disputes, as long as they are not contrary to the Constitution and human rights enshrined in international instruments.
The State shall guarantee that the decisions of indigenous jurisdiction are observed by public institutions and authorities. These decisions shall be subject to monitoring of their constitutionality. The law shall establish the mechanisms for coordination and cooperation between indigenous jurisdiction and regular jurisdiction. (Art. 171) - SpanishLas autoridades de las comunidades, pueblos y nacionalidades indígenas ejercerán funciones jurisdiccionales, con base en sus tradiciones ancestrales y su derecho propio, dentro de su ámbito territorial, con garantía de participación y decisión de las mujeres. Las autoridades aplicarán normas y procedimientos propios para la solución de sus conflictos internos, y que no sean contrarios a la Constitución y a los derechos humanos reconocidos en instrumentos internacionales.
El Estado garantizará que las decisiones de la jurisdicción indígena sean respetadas por las instituciones y autoridades públicas. Dichas decisiones estarán sujetas al control de constitucionalidad. La ley establecerá los mecanismos de coordinación y cooperación entre la jurisdicción indígena y la jurisdicción ordinaria. (Art. 171)
