(3) When a Proclamation of Emergency has been made and so long as such Proclamation is in force, His Majesty the Sultan and Yang Di-Pertuan may make any Orders whatsoever which he considers desirable in the public interest; ...
(4) Without prejudice to the generality of Clause (3), such Orders may be made with regard to any matters coming within the classes of subject hereinafter enumerated, that is to say—
(a) censorship, the control and suppression of publications, writings, maps, plans, photographs, communications and means of communication;

(c) control of the harbours, ports and territorial waters of Brunei Darussalam, and of the movements of vessels;
(d) transportation by land, air or water and the control of the transport and movement of persons, animals and things;

(f) supply and distribution of food, water, fuel, light and other necessities;
(g) appropriation, control, forfeiture and disposition of property and the use thereof;
(h) conferring powers on public officers and others;
(i) requiring persons to do work or render services;
(j) constituting a special police force;
(k) formation of tribunals and other bodies for the purpose of deciding any matters specified in any such Orders;
(l) modification, amendment, supersession or suspension of all or any of the provisions of any written law;
(m) entry into, and search of, premises or other places, and search and interrogation of persons;
(n) prescribing fees or other payments; and

(3) Apabila suatu Pemasyhuran Darurat telah dibuat dan selagi Pemasyhuran tersebut berkuatkuasa, Kebawah Duli Yang Maha Mulia Paduka Seri Baginda Sultan dan Yang Di-Pertuan boleh membuat apa jua Perintah pun yang Baginda fikirkan dikehendaki bagi kepentingan orang ramai; dan boleh menetapkan hukuman-hukuman yang boleh dikenakan kerana sebarang kesalahan terhadap mana-mana Perintah tersebut; dan boleh membuat peruntukan bagi perbicaraan orang-orang yang dituduh melakukan kesalahan-kesalahan tersebut oleh mana-mana mahkamah.

(b) penangkapan, penahanan, tegahan dari memasuki negeri dan pembuangan negeri;
(c) kawalan ke atas pelabuhan-pelabuhan dan perairan wilayah Negara Brunei Darussalam dan ke atas pergerakan kapal-kapal;
(d) pengangkutan dengan jalan darat, udara atau air dan kawalan pengangkutan dan pergerakan orang-orang, binatang-binatang dan barang-barang;
(e) perdagangan, penyimpanan, pengeksportan, pengimportan, pengeluaran dan pengilangan;
(f) pembekalan dan pembahagian makanan, air, bahan bakar, api dan keperluan-keperluan lain;
(g) pengambilan, kawalan, perampasan dan pelupusan harta dan penggunaannya;
(h) memberikan kuasa-kuasa kepada pegawai-pegawai Kerajaan dan lain-lain;
(i) mengarahkan orang-orang untuk membuat kerja atau memberikan perkhidmatan-perkhidmatan;
(j) menubuhkan sebuah pasukan polis khas;
(k) penubuhan tribunal-tribunal dan badan-badan lain bagi maksud memutuskan sebarang perkara yang dinyatakan dalam mana-mana Perintah sedemikian;
(l) pengubahsuaian, pindaan, penggantian atau penggantungan semua atau mana-mana peruntukan sebarang undang-undang bertulis;
(m) memasuki, dan menggeledah, bangunan-bangunan atau tempat-tempat lain, dan memeriksa dan menyoal siasat orang-orang;
(n) menetapkan bayaran atau pembayaran lain; dan

- English(1) A state of emergency may be declared only for the stated reasons, for a fixed period, and in relation to a designated territorial area. Concurrently with its declaration of the state of emergency, the government must specify which rights prescribed in individual statutes shall, in conformity with the Charter of Fundamental Rights and Basic Freedoms, be restricted, and to what extent, and which duties shall be imposed, and to what extent. Detailed provisions shall be laid down by statute.

- EnglishDuring the proclaimed state of war or emergency, the exercise of certain human rights and freedoms may be limited, to the necessary extent.
The limitations shall not be introduced on the grounds of sex, nationality, race, religion, language, ethnic or social origin, political or other beliefs, financial standing or any other personal feature.
There shall be no limitations imposed on the rights to: life, legal remedy and legal aid; dignity and respect of a person; fair and public trail and the principle of legality; presumption of innocence; defence; compensation of damage for illegal or ungrounded deprivation of liberty and ungrounded conviction; freedom of thought, conscience and religion; entry into marriage.
There shall be no abolishment of the prohibition of: inflicting or encouraging hatred or intolerance; discrimination; trial and conviction twice for one and the same criminal offence (ne bis in idem); forced assimilation.
Measures of limitation may be in effect at the most for the duration of the state of war or emergency. (Art. 25) - MontenegrinZa vrijeme proglašenog ratnog ili vanrednog stanja može se ograničiti ostvarivanje pojedinih ljudskih prava i sloboda, u obimu u kojem je to neophodno.
Ograničenje se ne smije činiti po osnovu pola, nacionalnosti, rase, vjere, jezika, etničkog ili društvenog porijekla, političkog ili drugog uvjerenja, imovnog stanja ili bilo kakvog drugog ličnog svojstva.
Ne mogu se ograničiti prava na: život; pravni lijek i pravnu pomoć; dostojanstvo i poštovanje ličnosti; pravično i javno suđenje i načelo zakonitosti; pretpostavku nevinosti; odbranu; naknadu štete za nezakonito ili neosnovano lišenje slobode i neosnovanu osudu; slobodu misli, savjesti i vjeroispovijesti; zaključenje braka.
Ne mogu se ukidati zabrane: izazivanja ili podsticanja mržnje ili netrpeljivosti; diskriminacije; ponovnog suđenja i osude za isto krivično djelo; nasilne asimilacije.
Mjere ograničenja mogu važiti najduže dok traje ratno ili vanredno stanje. (Član 25)

(1) Parliament or the legislature of a province may expressly declare in an Act of Parliament or of the legislature, as the case may be, that the Act or a provision thereof shall operate notwithstanding a provision included in section 28 or sections 7 to 159 of this Charter.
(2) An Act or a provision of an Act in respect of which a declaration made under this section is in effect shall have such operation as it would have but for the provision of this Charter referred to in the declaration.
(3) A declaration made under subsection (1) shall cease to have effect five years after it comes into force or on such earlier date as may be specified in the declaration.
(4) Parliament or the legislature of a province may re-enact a declaration made under subsection (1).
(5) Subsection (3) applies in respect of a re-enactment made under subsection (4). (Constitution Act 1982, Sec. 33) - French
(1) Le Parlement ou la législature d’une province peut adopter une loi où il est expressément déclaré que celle-ci ou une de ses dispositions a effet indépendamment d’une disposition donnée de l’article 2 ou des articles 7 à 15 de la présente charte.
(2) La loi ou la disposition qui fait l’objet d’une déclaration conforme au présent article et en vigueur a l’effet qu’elle aurait sauf la disposition en cause de la charte.
(3) La déclaration visée au paragraphe (1) cesse d’avoir effet à la date qui y est précisée ou, au plus tard, cinq ans après son entrée en vigueur.
(4) Le Parlement ou une législature peut adopter de nouveau une déclaration visée au paragraphe (1).
