- EnglishWithin the framework of political-administrative organization, indigenous or Afro-Ecuadorian territorial districts may be formed. These shall have jurisdiction over the respective autonomous territorial government and shall be governed by the principles of interculturalism and plurinationalism, and in accordance with collective rights.
Parishes, cantons and provinces comprised in their majority of indigenous, Afro-Ecuadorian, coastal back-country (montubio) or ancestral communities, peoples or nations may take up this special administration system following a referendum passed by at least two thirds of the valid votes. Two or more districts administered by indigenous or pluricultural territorial governments may integrate and form a new district. The law shall set forth the rules for the structure, operation and competences of such districts. - EnglishThe legitimate authorities of the native peoples shall have the power to apply within their territorial competence levels of administration of justice based on their ancestral traditions and affecting their members only, in accordance to their own rules and proceedings, provided the same are not contrary to this Constitution, law and public order. The manner in which this special competence shall be coordinated with the national judicial system shall be determined by law. (Art. 260)

Notwithstanding the preceding provisions, the Constitutional Council may also be composed of one or more members of the indigenous peoples recognized in Law No. 19,253, which establishes norms for the protection, promotion, and development of indigenous peoples and creates the National Corporation for Indigenous Development, in force as of the date of publication of this reform. The following special rules shall apply for these purposes:
1. Indigenous individuals who are citizens with the right to vote may declare their candidacies, and the general disqualifications, incompatibilities, and prohibitions for being a member of the Constitutional Council shall also apply to them. Candidacies must prove their status as members of an indigenous people by means of the corresponding certificate of indigenous status issued by the National Corporation for Indigenous Development.

Sin perjuicio de las normas precedentes, el Consejo Constitucional podrá estar integrado, además, por uno o más miembros de los pueblos originarios reconocidos en la ley N° 19.253, que establece normas sobre protección, fomento y desarrollo de los indígenas, y crea la Corporación Nacional de Desarrollo Indígena, vigente a la fecha de publicación de la presente reforma. - EnglishI. The rural native indigenous jurisdiction is based on the specific connection between the persons who are members of the respective nation or rural native indigenous people.
II. The rural native indigenous jurisdiction is exercised in the following areas of personal, material and territorial legal effect:
1. Members of the nation or rural native indigenous people are subject to this jurisdiction whether they act as plaintiffs or defendants, claimants or accusers, whether they are persons who are denounced or accused, or are appellants or respondents.
2. This jurisdiction hears rural native indigenous matters pursuant to that established in a law of Jurisdictional Demarcation.
3. This jurisdiction applies to the relations and juridical acts that are carried out, or the effects of which are produced, within the jurisdiction of a rural native indigenous people. La jurisdicción indígena originario campesina se fundamenta en un vínculo particular de las personas que son miembros de la respectiva nación o pueblo indígena originario campesino.
II. La jurisdicción indígena originario campesina se ejerce en los siguientes ámbitos de vigencia personal, material y territorial:

- EnglishIn conformity with the Constitution and the laws, the indigenous territories will be governed by councils formed and regulated according to the usages and customs of their communities and will exercise the following functions:
1. To see to the application of the legal norms concerning the uses of the soil and settlement of their territories.
2. To design the policies and the plans and programs of economic and social development within their territory, in harmony with the National Plan of Development.
3. To promote the public investments in their territories and see to their appropriate execution.
4. To receive and distribute their resources.
5. To see to the conservation of the natural resources.
6. To coordinate the programs and projects promoted by the different communities in their territory.
7. To collaborate with the maintenance of the public order within their territory in accordance with the instructions and provisions of the National Government.
8. To represent the territories before the National Government and the other entities into which they are integrated; and
9. The ones that the Constitution and the law specify to them.
PARAGRAPH
The exploitation of the natural resources in the indigenous territories shall be done without impairment of the cultural, social, and economic integrity of the indigenous communities. In the decisions that are adopted with respect to said exploitation, the Government shall encourage the participation of the representatives of the respective communities. (Art. 330) - SpanishDe conformidad con la Constitución y las leyes, los territorios indígenas estarán gobernados por consejos conformados y reglamentados según los usos y costumbres de sus comunidades y ejercerán las siguientes funciones:
1. Velar por la aplicación de las normas legales sobre usos del suelo y poblamiento de sus territorios.
2. Diseñar las políticas y los planes y programas de desarrollo económico y social dentro de su territorio, en armonía con el Plan Nacional de Desarrollo.
3. Promover las inversiones públicas en sus territorios y velar por su debida ejecución.
4. Percibir y distribuir sus recursos.
5. Velar por la preservación de los recursos naturales.
6. Coordinar los programas y proyectos promovidos por las diferentes comunidades en su territorio.
7. Colaborar con el mantenimiento del orden público dentro de su territorio de acuerdo con las instrucciones y disposiciones del Gobierno Nacional.
8. Representar a los territorios ante el Gobierno Nacional y las demás entidades a las cuales se integren; y
9. Las que les señalen la Constitución y la ley.
PARAGRAFO
La explotación de los recursos naturales en los territorios indígenas se hará sin desmedro de la integridad cultural, social y económica de las comunidades indígenas. En las decisiones que se adopten respecto de dicha explotación, el Gobierno propiciará la participación de los representantes de las respectivas comunidades. (Art. 330)
